After several mpnths of research, i've decided to follow up my ongoing claim against NATWEST with a claim against Cap One This particular credit card was closed down in 2003 but still managed to accrue £396 of charges prior to that happening. I've been readin heavily on the CCI route and decided this is the way i should approach things. Could anyone please provide me with a link to a latest version of the pre-lim letter which includes the blurb surrounding claiming contractual interest. Also - the cash interest rate of my card at the time it was valid was 1.625% per month which works out at 21.34% annually. Can anyone advise if this is the rate i should use to claim back CCI?   4. I have finally recieved a letter from courts stating that a preliminary hearing has been set to decide how to proceed with my case for the 31st May 2007 - over 3 months away. Can anyone confirm whether this is standard procedure? If so - is it now i need to prepare my court bundle for myself, the courts and solicitor. Thanks in advance

  6. Sorry to hijack the thread guys. I'm at the final stages of my claim against natwest and basically just waiting for the judge to set a court date. Cobbetts were requested to provide a copy of their Part 18 request by 01/02/07 which was completed. I'm now considering ameding my claim to try and claim back the contractual interest which will significantly increase the value if successful. Would anyone strongly suggest not to do this at such a late stage? If not - do i progress with an N244 like Josamolly. Thanks in advance for your advice and apologies
  7. Hello everyone, Whilst processing my claim against Natwest I thought it was about time to start my claim against Capital one. I originally intended to start proceedings before xmas but have been ingrossed with the whole contractual interest debate and therfore decided it would be a good idea to spend some time trying to understand before going down this route. Whilst exhausting a lot of time trying to grasp the contractual interest method, I still can't claim to fully understand it, and no doubt never will. Whilst this is the case, can someone please advise which spreadsheet they have used to progress via this method. I've obtained a spreadsheet which i believe was developed by Mandzai - but he/she seems to imply its only relevant to bank accounts (not credit cards). Theres also the spreadsheets developed by Vampiress but i get the impression these are designed to calculate simple interest only. Apologies for requesting info which is no doubt already available but i want to make sure I approach this claim correctly, and I can also assure that I have read up thoroughly before requesting this info. Mods please can you convert this thread to one specific to my claim so i can continue posting updates/questions. Many thanks in advance for your help/patience G

  9. Hello everyone, I'm about to start my claim against Capital One but i'm unsure about what interest (if any) can be claimed back. I've had a brief look at some of the other cases and noticed people talk about compound interest and also using interest rates over 30% in order to calcualte what interest they are entitled to claim back. Can anyone explain in simple terms so i can understand exactly what i'm entitled to claim for. Thanks in advance

  12. I have now recieved a Defence and a CPR Part 18 request from Cobbetts on behalf of Natwest. Am i correct in thinking that there is no reason for me to respond to this CPR request unless the court requests it? If so - can anyone advise where to find the relevant letter template to reject this request and move my case on to the next step. Thank in advance

  14. From my calculation, my claim was served to Natwest via MCOL, 28 days ago at the end of today. Assuming that Natwest/Cobblets enter a defence at the end of today, can anyone advise what i'm to expect next?

  16. Thanks for your help deller. I've already sent a copy of the schedule of charges to MCOL with cover letter. I have since received info from the courts that the claim has been served and that Natwest / cobbetts intend to enter a defence giving them 28days from the 15th Nov. Do i need to send any info to Cobbetts? What else should i prepare for? I've read info wrt to questionnaire's and also having to pay an additional £100 to courts but don't fully understand the background. Any help would be greatly appreciated.
  17. Deller / Ally, Sorry to highjack your post but your several steps ahead of me so i'm just confirming what to do next. My online claim has been served and the courts have sent me a copy of the document which states natwest / cobbetts intend to defend. Do i need to send any information to Cobbetts (and/or anyone else) and is there any other advise you can provide me that will speed things up? Many Thanks

  20. Apologies if this questions has already been asked. I raised a case against Natwest via MCOL on 10/11/06. Can anyone confirm where within MCOL site it states when the case has been served to the defendant? Also, can someone please confirm what documentation needs to be sent (ie schedule of charges etc) and who it needs to be sent too now that I have raised a claim agianst the bank.   22. Advice required please. I recently rejecting Natwests full refund of £177 because of the terms & conditions that i had to agree too. Natwest has stated that unless i sign the letter accepting the T&C's i will not get the refund. What is the next step for me? If i sign the letter does this mean i will not be able to claim back for any future charges on this account? Should i progress to the stage of raising a court case against them? Thanks in advance Gaz
  23. Natwest have recently accepted my request of a full refund on my joint account. Hooray! The letter states 'Acceptance by you of this payment will be in full and final settlement of all claims you may have relating to our charges'. Whilst i'm obviously going to make every effort not to be charged again on this account, I cannot predict what may happen in the future. Can anyone advise whether Natwest will remove this condition if I reject the offer based on this particular condition of the settlement? And if so, is there a letter template which someone has already used succesfully? Any advice would be greatly appreciated

  25. I have recently contacted the customer services department at Natwest Credit Card Services requesting copies of my Natwest Mastercard and Visa Card statements. Both these accounts are now closed and settled in full. The person i spoke to stated they would request copies of my statements and send them free of charge. Since then this person has contacted my home and stated that if i require copies of these statements i will have to submit a written request and also pay £3 per statement. Can anyone advise what the best way to go about this is and is there anyway i gain access to my statement info without paying £3 per statement. Many thanks in advance Gary
