  1. OH MY GOD! OH MY GOD! Had a dream last night that they paid up! So today, even though it's a Saturday I checked my a/c online and ALL of the money is there!! Oh my God! I want to scream I am sooooooooooooooo happy, thank you SO much to the ppl that run this site and for everyone elses advice I will deffo make a donation, thank you. My husband was dubious and now that he has seen the fruits of my labour he is going to get the ball rolling with Lloyds. Thank you a million times again!! I will post a proper post in the Successes thread with timescales etc, to assist others! Thank you. xxx

  3. Wow! Lucky you! Well done. Mine was acknowledged on 30/11.. Nope, nothing in my a/c, I have checked every day!! How much was your claim for? Did they ask for the extra 14 days??

  5. So some have actually gone to court then? Their seems no ryhme or reason to Halifax, some ppl get full settlements without it going to court and some get full amount after filing claim, some defend... Some don't! Arrrgh! Thanks though.
  6. I took Halifax to court on the 21/11, they acknowledged my claim and requested the extra 14 days to file a defence which takes us up to Christmas-bloody-Day! So, will they actually file a defence before this date or will they just pay up before then in to my bank a/c? What happens if they file a defence? I presume it goes to court? Has any cases gone to court? If they do not file any defence I can request a Judgement when the courts open again after Boxing Day?? Questions, questions, I am SO skint, that money would be so handy right now!
  7. Hi, I took Halifax to court and last week they asked the court for a further 14 days, which takes us up to 28 days in total from they receiving my claim, which takes us up to Christmas Day! It's really dragging out now, this has been going on since my first correspondence on September the 15th. They have been awkward at every turn and when I sent the letter before action they ignored me, then on their last day before action I rang them and asked if they'd be getting back to me, they said that they would not, so the next day I filed my claim, then the day after I receive a letter dated the day I rang them(?!) offering me £150 and £180 for two a/c's (Total claim was originally £848, but with interest and costs it's now £1175.) So I turned the offer down as I'd already started my claim for the full amount, they then write to me and say that they are sorry I turned their offer down and that they catagorically won't be paying my full amout... so hubby thinks that they are confident of winning court case, maybe that is why they filed a defence?? Any advice or hope offered, gratefully received. And to top it all, paying out the court costs has left me so utterly skint and depressed. Bradders. x

  9. I have looked on thr Search function for an answer but can't find one! My claim has been issued, but now it's asking: Do you wish to enter Judgment by Default or by Admission? Please select one of the options below: The defendant has not filed an admission or defence to my claim (Judgment by Default) You will need to decide, how and when you want the defendant to pay. You can ask for the Judgment to be paid by instalment or in one payment. The defendant admits that all the money is owed (Judgment by Admission) If the defendant has given a new address on the form of admission to which correspondence should be sent, update the defendant's details within the following Judgment request. Um.... I dunno!!! LOL! Please help!

I am calling Cust Rel now for a fax number or email address so that I can get that sent today and then carry on with action, that should be okay shouldn't it?

  13. Hi All, Halifax not interested despite today being their deadline before action they said they won't respond to my timeframes and will get back to me by mid-December! So, three question regarding taking action, my claim is for just over £800, but with interest it takes it to £1045. Does that mean that my costs rise from £80 to £120? Or are the costs for the original sum? Also, do I get the costs paid back? I am having to borrow them as it is! Finally, how long does the process take of taking it to court to getting the money? Thanks, Bradders.

  15. Halifax now have 2 days until the deadline I gave them before action. Not heard a bean from them, so rang them today to see if they had tried contacting me and they said they hadn't. I reminded them that they'd had 14 days to reply, 12 of which have gone, she snootily replied "Yes, that's YOUR time scale and not ours." and added "That's what you are told to put on your letter by the Consumer Action Group, but we work to our own timescales and are within our rights to." I asked what their timescale was and she said "They will get back to me one way or another by 21/12/06!!" I said that if she is saying that they won't respond to me by Thursday then I might as well start action today then, to which she replied that she didn't say that they definitely won't, but that it may not be until December 21st! So I said "Fine, I will take action on Thursday as planned then." she replied "Fine." back to me. Are they playing games with me or what? I assume this means that they won't pay up and I will have to take action now? How long is the process from taking action to getting the actual money? Will I deffo win?? Has anyone lost? I am starting to lose my bottle a bit now.
  16. Quick brain-pick please! Halifax now have 7 days left until the day I told them that I am taking action, I rang them ealier to make sure that they had a correct contact number for me in case they wanted to call and discuss it, (Turned out that they did have the wrong number!) I also asked if there was any progess on my claim and they said the last note was from a week ago to say that they had received my Letter Before Action and that's all they had added on my file! I advised the chap that I spoke to that if he could add a note to say that I rang with a contact number and to also add a note to say that I am reminding them that they had now just 7 days before action, he said he would update that. SO.. My question is; Next Thursday if they haven't got back to me what do I do next?! LOL! I have signed up with moneyclaim already. Do I give Halifax until close of business next Thursday or can I put my claim in at say midday? Also, how much am I claiming for? I see these posts about 8% interest, but don't understand them, then do I add my legal costs too? I'm not too good with all this, Wondering what I started now! Please help!
  17. Sorry, no, I've prob complicated things.. The crux of the arguement is that he is sure that he gave them correct a/c details for the S.O but they say he didn't, he wants them to email him that recorded telephone conversation and they want to charge him £10, so be facetious he said that if he has to pay £10 for that (Which he doesn't see why he should as sending an email costs nothing and takes no time.) then he'll have all of his statements too cos if he's paying £10 for data relating to him then he wants all of it, regardless of whether it's written or audio.. But they say £10 for recording and another £10 for statements, but surely data is data?!
  18. I know this is going off the subject a bit; I am in the process of claiming charges of Halifax at present but have a gripe with A&L who we currently bank with. In July last year we moved banks to A&L and this July my husband rang A&L and asked them to set up a Standing Order to his previous bank a/c so that he could clear his overdraft with them in chunks each month... He then thought nothing of it. Two months later his previous bank call to query why O/D wasn't decreasing, he said he didn't know as he set a S.O up with A&L. He rang A&L and they confirmed it was set up and that it was his other bank rejecting, so hubby called previous bank and they said they were not rejecting and to see how next payment goes. Another month passes, another rejected payment, this time he gets a call from prev bank to say that as it’s been three missed payments and as payments are being returned they are charging him £30 to be added to his O/D! So hubby calls A&L again, after much to-ing and fro-ing it transpires that A&L had keyed the wrong bank a/c details! Hubby explains that he would not have given wrong details as he banked with prev bank for 14 years and knew his a/c number off by heart and as it's A&L's mistake he expects them to refund him the £30 charge, they say they need to review recorded phone call and get back to him within two weeks and that they will refund the charge if they are at fault. Three weeks pass, no call back. Hubby calls them tonight, they insist that they didn't call him back as did not have our phone number(?!) Err... despite calling us the other week regarding joint a/c.. Then say recording shows that hubby gave wrong a/c number so they cannot refund him £30. My hubby is ADAMANT that he did not give wrong details, so asked if they could email him the recording, they said yes but at the cost of £10, Hubby explains that it costs nothing to email him an .mpeg file, let alone £10 and that he is entitled to this info. The agent then says she will put him on hold and listen to it herself, hubby asked to have a 3-way conference call so he can hear, he's told they can't, he asks if this is down to technology or policy, he's advised policy! So hubby says, if I give you £10 I want not only recording, but all my bank statements listing previous A&L charges too as it's an S.A.R, but is told, no, its £10 for statements and £10 for recording!! Surely data is data, regardless of medium? Also how come it's acceptable for them to listen to recording as they cannot take hubby’s word but he can't unless he pays when he won't take their word? Any advice? PLEASE! Where does he stand?

Right, I sent the prelim approach for payment last week and got a response last night which appears to be standard saying that they “are sorry I am disappointed..” and “they do not agree with the OFT’s findings”.. and that they are basically not going to give me my money, but helpfully enclosed a leaflet for complaining to the Ombudsman. How kind. However, they added a bit and said that “as a goodwill gesture” they have refunded the interest charge on my agreed overdraft for October… (BTW, I cleared the overdraft last week.) and I am wondering what to do next now. If they have refunded this interest charge this doesn’t mean I accept this is anyway as being a settlement or something silly does it?! Also, what letter do I send next, letter 3 refers to them not responding to prelim letter and letter 4 looks too far ahead and means nothing to my tiny brain! Help! Please!
  20. We left Halifax last year cos of their stinking attitude and stupid charges. We eventually paid off the joint a/c O/D and closed the a/c and I'm in the process of paying my O/D off so I can close it. Then I heard about claiming unfair banks charges back on MSE and this site. So, sent my SAR off with my £10 chq, which they cashed in under a week, received no confirmation later and almost at the 40 days I had received no statements, I rang then to query as the chq had been cashed so long ago I thought statements might be lost in post, but oh no they say to me "We are well within our 40 days Madam." sure enough I receive statements two days later, all in one package and it cost them over a fiver to post! Good! Went thru' statements, joint a/c has £608 in charges and my own a/c just £210.. LOL! There's me going thru' statements sayin g "C'mon, gve me more charges!" Yes, give me an indication of how crap I have handled my money eh?! Bring it on! So I am sending the 2nd letter today asked for £818 back, plus my £10 fee that I paid for my statements.. I am sure they will wait until day 13 until they respond! My hubby is sceptical and has lots of charges on his own Lloyds TSB a/c... I told him to go down the route I am going to get them back, but he wants to "Wait and see if I am successful first!" I think he's mad, we could end up with a windfall all at once if he pursued his own claim. I used to have a Credit Card with Halifax, been closed for a while, as has my Halifax Loan, can I apply for those charges too? Anyway, wish me luck... I love this site BTW! Bradders. x
