no reply from BACON (just as i expected) so just heard from the court today they're moving my case to my local court and i've a questionare to fill in as Nationwide have still put in a defence----- pretty straightforward the first question SETTLEMENT do i wish to postpone the claim for a month to discuss with the other party as to reach an agree-able resolution? i said no as he's had more than his fair share of time or am i being hasty? - do you think it will go that far or is he stalling again?

Well All Done Sent Off The Letter Today With My Demands And A Further 7 Days To Comply Or Off To Court We Go (with An Extra 8% To Add On Top If They're Not Interested) And I Will Be Deducting Their Goodwill Payment From The Total Claim!!!!!!!!!!!!!!

Hi I Sent Off My D.p.a. Request On 2nd May 06 To Recieve A Letter Back Saying I Hadn't Signed The Original Letter So Resent It Again On The 17th May -----40 Days Are Up On The 26th June 06 And Yet I Still Haven't Recieved My Statements Or Any Response??????? I Think The Next Course Of Action Is The Commisioners Office For Complaint -- Does Anyone Know How Long And What Happens If I Have To Go Down This Root Without Hearing From Capital One Please??

am now in receipt of my d.p.a plus the s.a.r (which i didn't ask for)and like most others on this forum they can only supply me with statements up to 2004 the rest at a cost of £3. per statement seems to be the norm for barclaycard!!! can anyone help i've got late fees and exceeded limit fees but most of my account is made up of two interest charges one standard balance interest and the other cash balance interest more than the minimum amount i was paying so have no hope of paying off this debt! can i claim for any of the interest incurred or is this legal???? would be most grateful for some advise. saying that though haven't heard from them since the previous letters nor paid anything in!!!

i don't know when it was deposited as i don't use the account--have to wait for a statement--- i did get a letter though saying they tried to phone me to try to resolve my " money worries and payment difficulties" and gave me a freephone number to call back on ----- yeh right!!!!! they find me at work ok when i don't make a payment!!!!! i'll send the letter off tomorrow with my terms we shall see???

thanks i e-mailed mr bacon tonight - politely reminding him the claim was not settled in full and that i didn't charge him the 8%interest which i was entitled to and that he had 7 days in which to refund me the shortfull before i inform the courts that the claim is not settled

hi sorry should'v posted earlier but been busy with nationwide - well sent my dpa got a lovely printout --just a few pages with all the charges they've incurred on my account -didn't have to do alot--next my preliminary letter basic rubbish back --if i've got a complaint blah blah gonna look into it may take 28 days-- so next the lba and got back basicely the same letter as the one before 28 days blah blah --so deadline was 20th june to start action and low and behold i had a letter offering me a good will gesture (£590.00)which they have deposited into the account as a full and final payment for my complaint. so i'm about to write and thank them for the advance which i will deduct from the total before i take court action unless they want to settle out under my terms!!! i'll keep you all posted

sorry its been a while but since my last post i made a claim- nationwide said they would put in a defence and then the money appeared in my account! so i've been waiting for my statement to see exactely what they have paid and have now recieved a letter from court asking if the claim is settled. i just need another bit of advise please the claim was for £4063.79p + £120.00 court costs they have paid me £3678.68 inc costs which makes the total £505.11p light seeing as i didn't take them for the 8% interest as i felt this would take me over the £5.000. small claims limit should i continue to claw back the rest (seeing as my account with them is due for closure at the end of the month anyway) or cut my losses? would be very grateful for your advise thanks
