  1. just a thought.. is the CEO's opinion the law? "Who had reason to believe that the following contravention had occured" Doesn't mean it happened just means in this person's opinion it did am I clutching at straws???
  2. Yeah I thought that - thank you both for taking the time to reply. Personally I think its terrible that they have someone sneaking about at kick off time just there to grab people who are at the footy and parking somewhere that is not causing anyone any problems at all. Oh well - we live and learn...

I got a parking ticket on Sunday 09/05/2010 parking here: BL6 6JW - Google Maps My car was parked as per this picture in (i) http://img232.imageshack.us/img232/5170/parkingc.jpg Excuse the poor markings - drawing has never been my forté There was a car parked in (iii) who also received a ticket but the car parked in position (ii) didn't have one on the windscreen unless someone had removed it. The ticket: There were no signs on the entrance to the industrial estate, other than the double lines.. I was not parked on the curb, nor was I blocking the pathway (except the bit I was parked on), nor was I blocking the car parked by the lamppost. The estate road is also a dead end so I was not blocking any through-fare of traffic. Am I being stupid in thinking that I could challenge this? Any help would be appreciated. Thanks

  6. What a coincidence... Lowell sent me this today.. Does this mean they will remove the default also or will that remain until I take them to court... in other words should I still commence with legal proceedings until the default is removed?
  7. Thanks Hettie .... The 14 days are now up and they have not responded... How do I now preceed? Is there anyone who can offer advice now please as I'm now stuck on how to bring these people to justice...
  8. I will be sending this first thing tomorrow: Thank you for your letters 18 October 2009, 22 October 2009, 27 October 2009 and 4 November 2009. However you have still not provided me with any documents requested in my letter 12 October 2009 in which I requested, as is my right under the legislation contained within section 77 (1) and section 78 (1) of the Consumer Credit Act 1974, a copy of my credit agreement. I also requested a full statement of account, a signed true copy of the executed Deed of Assignment for the above referenced agreement and also a true copy of the Fair Processing Notice. This is an obligation, whether you are the original creditor or not, under section 189 of the Consumer Credit Act 1974. I am sure you are aware that non-compliance with my request is a criminal offence under the above act. In summary, this means that you have not produced a document that could be enforced by a court under s127(3) of the CCA 1974 and neither have you complied with your obligations under s78(1). In fact, you have committed an offence under s78(6) of the Act. Notwithstanding the above, I have noticed you have put a default on my credit file. This is an enforcement action which is unlawful by virtue of s78(6) of the Act. Furthermore since you cannot demonstrate that I have an agreement with you; this enforcement action also violates the Data Protection Principles given in schedule 1 of the Data Protection Act 1998 and is therefore also unlawful under that Act. I now give you 14 days from the date of this letter to rectify your various omissions and unlawful enforcement actions. This means I expect to receive a notification from you that you either have removed the default marker on my credit file or with a date when you will have done so, and an undertaking that you will cease all enforcement actions until you have provided me with the documentation that I am entitled to under the CCA 1974. If you do not comply with this request within 14 days, I will send you a letter before action giving you a further 14 days to comply before I commence proceedings in the County Court, which I will do without any further communication. I also reserve the right to report your various non-compliances and unlawful actions to the relevant authorities including the Financial Ombudsman Service, Trading Standards and the Information Commissioner's Office.   9. Looks like Lowell may have done me a big favour... The Marbles default has disappeared from my credit report.... This one from Lowell remains but it appears as if they can't find the correct paper work nor have they issued me with any paperwork regarding the default... I shall be asking them to provide me with the correct paperwork, remove the default within 14 days or face prosecution... Not sure why I continue to post here really.. no-one respond to me anyway...

  12. Howell have today lodged a default against me on my credit file Now I have one with Halifax and Howell for the same amount. Howell haven't even issued me with Default Notice.... In fact neither has Halifax - it was issued by HFC!!!!

Can they do what they want - whenever they want - seems they are not governed by the law anymore.... 07/10/2009 - Letter from Aqua giving notice of assignment to Lowell Portfolio - I have never heard of either of them before 07/10/2009 - Letter from Lowell Portfolio (sent in same envelope as above) asking for repayment of debt. 12/10/2009 - I sent a letter requesting CCA - recorded of course. 18/10/2009 - Letter from Lowell Financial - we are in receipt of your CCA request and we are getting it from your original lender 22/10/2009 - Letter from Lowell Portfolio - letter stating they are still waiting for CCA from SAV - also states account is on hold 27/10/2009 - Letter from Lowell Financial - Sorry still hasn't arrived with them but you will be forced to pay as soon as it is. 05/11/2009 - Default from Lowell for the same amount appears on my credit report. Can someone help me prepare a letter to them and the OFT please...

  16. I received a letter from Lowell today 02/11/09 dated 27/10/2009: Yeah whatever... less of the threats and just send me what I've asked for..... They have now gone over the initially 12 days of the CCA request which was sent 12/10/2009 recorded. I know I should give them more time because of the postal problems but what can I do if the CCA does not come within say 30 days?
  17. Hi... someone please help I have always paid my council tax by direct debit, always, always... I had a letter from Birmingham City Council (BCC) 29-Sep-2008 stating I owed them £130.39. I knew this to be untrue as I aways paid by DD (as stated above ). I tried to phone them to get some answers but was always told someone would call me back, they never did. I then got a court summons for £130.39 which would have £54 added on for costs. I tried to phone another 4 times but got same answers as before. So I thought "Sod 'em" I'll see them in court. I gathered all my statements, booked a day off work and trotted along to the court where I met Amanda a BCC member. I explained everything to her and she trotted off with my statements proving I owed nothing. I then received a letter telling me it was a mistake on their behalf. I sent them a letter asking for a full break down of my account over the years to see if they had made any more mistakes. Low and behold they seem to have made a right mess of my account. 2003-2004 - I had just moved into the property (with my now wife who had lived here for 15 old years previously) - their charge for this year was £77.97, they say I paid £84.58, according to my statements I paid £126.00. 2005-2006 Charge £885.52 Less credit from 2003-2004 according to their calculations £6.61 (diff. £84.58 & £77.97) Cort costs of £47.00 plus bailiff costs of £90.00 = £137.00 Total: £1015.91. Strange this as I have never had a summons before the first one mentioned but they seem to have applied costs for a summons that I was never summoned for. I have sent them a letter asking them to explain this. They replied stating "Birmingham City Council moved to a new computer system in January 2006 but at the time of the issue of the bill and summons detailed above the reference number #####18886 (this was my wifes living on her own reference number) was quoted. Therefore you would not have received a summons quoting reference number #####01059 (mine and my wifes reference number)" So they have added court costs and bailiff costs to our joint account without even summoning me and not even allowing me to defend this amount. I have sent them a letter asking for a copy of this summons as I have never seen it. I have also asked them to reimburse me for the following: I sent a letter 21st Sept giving them 30 days or I would start legal preoceedings but I have still not received any payment or even the common courtesy of a reply. Any suggestion how I now proceed with this? I thought of stopping my current council tax payments but I'm sure that will land me in more trouble. Thanks for reading - I know it's a long long post
  18. I wonder if someone could help me please. Having looked at my credit report at Equifax online I found something very confusing. I have a credit card with LloydsTSB which I have been paying off over the last 2 years. Upon seeing my credit report there was an entry and the only entry for LloydsTSB was marked as - satisfied in April 2009. So, as I didn't have a recent statement, I stopped my next SO from going out and was looking forward to a rebate from Lloyds as I had now overpaid them by about 4 months. I then received a phone call from Lloyds stating they hadn't received my latest payment so I paid them over the phone. I have now received my latest statement from Lloyds stating I do actually still owe them over £3k yet my credit report which I have checked again today states I owe them nothing. I do actually think their statement amount is correct but just need to know why my credit report would be shown as satisfied. Can anyone explain this please or maybe suggest what I should do?
