  1. I have been paid the charges I was claiming, statutory interest at 8% and £120 court costs. I had claimed the alternatives of 24.9% unauthorised contractual interest or 7.75% authorised contractual rate. Having read all the lengthy threads about contractual interest I didn't have the bottle (or the expertise) to risk going for either of those alternatives. DDD.

  3. Letter today from Nationwide with details of what they have paid. I claimed for my charges and followed Redsue's example by asking for unauthorised contractual interest at 24.9%, alternatively 7.75% contractual interest or failing that 8% statutory interest. They have paid the charges, 8% interest and my £120 court fee. I have been warned to be a good girl or they will close my account if I don't comply with their terms and conditions! At least they are not closing my account. I have just posted my LBA to Capital One. It feels GOOD!! DDD.

  5. Cap One have sent me a Complaint Settlement Form, offering me £192 instead of £504. I don't think so! I have just had a payout from Nationwide today, so I'm all fired up! DDD.

  7. They have paid up!!! I think I have got 7.75% contractual interest compounded. I claimed £4949.90 and they have paid in £4962. After all the complicated arguments about unauthorised contractual interest, I am not going to go back for more. I don't understand all the arguments and I'm not about to look a gift horse in the mouth. Please can a mod transfer this to the "I've WON!!" thread. DelightedDollyDayDream. :D

  9. I haven't had any money or any letters, so I'm feeling left out!! I try not to check my account more than twice a day, but it gets addictive. Perhaps I will get a letter tomorrow. :o DDD.
  10. Are Nationwide slowing up their paying out now? It is 3 weeks since I filed my N1 and it was deemed served on Feb 15th. It's getting me quite edgy! I don't really want to be the one for the high jump!! DDD.
  11. Nothing yet - and I keep checking my account. I plan to have a rather staid holiday visiting family and friends in the West Country and visit some gardens too!! I have never been to the Eden Project and that is high on the list. I will also get to a couple of County Record Offices to carry on with my family history quest. (I have got back to about 1650 with my mother's family in Somerset). I am on my own now, so I don't fancy exotic holidays alone. I need to have some household and garden stuff done too, which I hope I shall be able to afford thanks to NW. DDD.

  13. I retired at the end of 2003. For some months before I retired I was overpaid because I was mistakenly given a tax credit I had not applied for and which should have been paid to another employee. The Payslips were not the clearest I have ever seen and I just thought I was getting some kind of tax refund! After I retired the payroll dept carried on apying my salary for a few months too. I went away to visit some friends and it took me a while to realise what was happening. I do not get an occupational pension but receive the state pension and also a share of my ex-husband's pension, so money is fairly tight. They eventually wrote to me and asked for the money back - over £7000. I agreed to pay £100 a month, but then was ill and forgot about it. Yesterday I received a letter from a firm of solicitors notifying me that I have to pay the full amount within 7 days or the matter will be passed to a debt collection agency. I would like to be able to pay it off at £100 a month. I have absolutely no savings and live pretty well hand to mouth. Am I likely to be able to persuade them to agree to this, and is there any advice about dealing with this, please? I know I have been careless about this, and to be honest, I hoped it had been forgotten. DDD.

  15. I have now got my Acknowledgement of Service, dated Feb 27th, so we are nearly running in parallel. Needless to say, they intend to defend all of the claim, although for some reason they have left off the name of the solicitors acting for NW. I keep looking at my account to see if there is any more money in there. Sadly, none yet!! DDD.
  16. I have just received an acknowledgement of service and "the defendant responded to the claim indicating an intention to defend all of the claim". Sadly although it says the acknowledgement was filed by the solicitors acting for the defendant they have left off the name and address for service of documents!! Should I just wait to see what happens or do I need to contact the court to find out which solicitors they are using? DDD.
  17. Are you reluctant to do it yourself? It is a bit mindblowing at first, but there is lots of help here. I am a pensioner and quite mathematically challenged (lol) but I have received my acknowledgement from the court and am waiting, very impatiently, for some money. I would have said that if I can do it, anyone can!! DDD.
  18. Sorry, forgot to post to say that Prelim letter is now on the way, so that makes March 10th for LBA. I hope all the publicity is helping our cause - especially Judge Collin's comments. DDD.
  19. I used N1 at my local court and got a Notice of Issue (specified amount). It says: Your claim was issued on 15 February 2007. The court sent it to the defendant by first class post on 21 February 2007 and it will be deemed to be served on 23 February 2007. The defendant has until 09 March to reply. I am thinking about a nice holiday! DDD.
  20. Mine was issued on Feb 15th so they have until March 9th. I am trying hard not to count my chickens before they hatch!!
  21. Hi Redsue Here's hoping your saga ends favourably soon! Actually I went through the whole of the Nationwide claims and there are nearly 1000 going back about a year and they must have been settled by now. That's why I was so surprised to find so few posted in the successes. I just had a nasty thought! Perhaps they just slink away without making a donation. No, they wouldn't, would they? DDD.
  22. While I am trying to be patient waiting for a payout (I hope!) I decided to look at the Nationwide Successes and was amazed at how few there are when compared with the total number of claims that have been made. Presumably lots of people are just taking the money and running. I suppose that is understandable, but it would be good to find out more of the detail in these cases. Many thanks to those who have posted their successes which encourage those who follow behind them. DDD.

There is a lot about this in The Independent again today, including a report that Nationwide "is to begin refusing to investigate any complaint made about unauthorised borrowing charges until regulators have ruked on the controversy. From this weekend, Britain's biggest building society will write to all customers who demand refund of such fees, warning thier cases will nit now bw considered until the Office of Fair Trading (OFT) publishes its judgement on whether the disputed charges are illegal." DDD.
  24. Notice of issue has just arrived. I feel excited but have a strange feeling at the pit of my stomach at the same time, just as most other posters reaching this stage seem to have experienced. However, I am hoping that all the publicity this week will make NW get a move as they face an avalanche of claims. I am so grateful for all the help and support here, and for Vamp's wonderful spreadsheets. Thank you all, DDD.
  25. Prelim letter now printed and ready to send. The claim is for £504 - I added one charge twice originally because they sent me two copies of one page of my statements. I am on my way to the post now! DDD.
