Hi everyone dont know where to start with this one - i have 3 catalogues i have recently gone on a dmp and transferred all of these debts to the debt management company i contacted additions & littlewoods and they would not accept my offer of payment so i have put it throu the debt management company to deal with and the payment will be alot lower. my question is additions have charged me £200 in charges and littlewoods have charged me £720 in charges and both keep adding approx £20 per month in admin charge & interest. can i claim admin charges & interest back the balance on my littlewoods is £950 so is made up of £720 in charges just thought if they would refund my charges i would be in a better position to pay off the remainder. I suffer with severe depression which doesn't help - littlewoods are ringing me approx 8 times per day between 8am & 9pm they have even done a search and got my mobile number so they are hounding me this way too now - but its a 0151 number so i cant bar it with BT. can i just send a standard bank charges first letter. also i am claiming back account cover - which i have never signed any contract or anythin with my catalogue & i have been unempolyed all the time that i have held catalogues. additions have not rung me once they just keep adding the charges - littlewoods have added a default to my credit file and still keep hounding me. i am willing to take this all the way - i did with my bank charges so i am doing with catalogues. any advice would be very very helpful please thankyou for reading my essay ha ha ha ha clare x

  3. can you claim back, interest??? late payment charge??? and admin fee??? i am getting charged approx. 50 per month interest in total dont know how to approach this - also i never requested account cover - i am unemployed and cannot afford the repayments i want to claim back all charges they have added to the account can i do this??? thanking you x clare
  4. hi there just wanted some advise please i made a claim for bank charges 18 months ago and lloyds paid out - since then i have hardly used the account tthey then constantly charged me again total of £800 in charges within a few months - do you think it would be worth me trying to claim again??? also i had an overdraft of £1000 which they put onto a loan and are constantly charging me on here too - also going to try to get £960 off hsbc - has anyone dealt with hsbc or lloyds recently are they paying out at all. and at what stage?? thanks for help guys clare x
  5. a few days after they received my refusal they offered me full amount - hang in there - fingers crossed for a good xmas!!!!
  6. forgot to say: didnt stick to dates as when they replied to my first letter they basically said 'sod off' and no further reply would be given so i felt there was no point in waiting the extra days and issued the LBA immediately and gave them 5 days notice befor court proceedings and that is when they paid up.
  7. HI THERE had 2 current accounts with rbos and they paid out both in full after LBA sent. no court contact needed. had an account with lloyds tsb i sent them LBA in july and i am going to court in january 2007 as they are still defending charges. hope i explained better
  8. hi guys just want to give you all some encouragement I put my first letter to lloyds middle of october for 2 different accounts - one for 2300 & one for 5000 they sent me sod off letter 3 days later i then immediately sent lba letter - 3 days later i received 2 offers of - 1500 & 2300 I immediately sent letter of refusal back wednesday of this week - today I received offer letter for full amounts on both accounts and cheques will be with me this week cant believe how quick they are payin out i have another claim with lloyds which is for 3k - started this in july have a court date of january 2007 - they are worst ever - rbos have been fantastic may i add my account has been closed for the last 3 years with rbos. STICK WITH IT YOU WILL GET YOUR MONEY !!!
  9. hi there yes you will receive a copy of their AQ asking for 4 weeks to settle probably & telling you they are not available for November then 4 weeks will pass - you will not hear anything then you should get a court date then you need to put all your paperwork together & give to the court- i handed my allocation questionairre in september & i have had no correspondance from lloyds at all. you might be one of the lucky ones & get paid out quickly - unfortunately on this thread we are all in the same boat. basically you will just have to wait & wait and eventually we should all get our pay outs - it will be worth it in the end. xxx let us know how you go on clare
  10. hi there again guys well after having a long drawn out process of 6 months with lloyds and still not in court till january thought i would start my dealings with RBOS. well absolutely gobsmacked sent my first letters giving 5 days to repay £2200 on 1 account and £5000 on 2 account got usual rubbish fob off letter after 4 days - i then sent another letter explaining that unless money was in my bank within 7 days i will be starting court proceedings on 25th October to my SHOCK horror yesterday i had 2 offer letters on account 1 offering me £1500 and on account 2 offering £2850 rang RBOS to say i had received them and i would take as partial settlement and i would send them a letter off with signed papers. the guy on the other end of the phone said "you cannot get partial settlement " "it is all or nothing" - is this the case?? has anyone else received partial payment - my account has been closed for 3 years didnt expect them to offer straight away - could do with money for xmas dont know what to do about account 1 claim?? definately not accepting account 2 claim - but could do with money just looking at some previous threads and they have had a nightmare with courts etc. and taking a really long time - bit like me with lloyds and i think should i take the settlement of 1500 or if i ask for partial settlement and they dont give it me it could take yet another 6 months to sort dont want to shoot myself in foot..... thanks guys in this situation what would you do ???? be honest - would be nice to hear your views.
  11. sorry jadest - mines 25th too!! i am sending copy statements, - some of other lloyds success cases, showing all same scenarios as what we have had, mcnamara interview, OFT report and also test case between lloyds v elliott if i can find info and anything else i come across on internet. i have to go into chetsrfield court again on friday to issue another claim against them for additional charges and also for my credit card charges with them - so all in all i am going to have 3 claims against lloyds all running at the same time. did you make a note of all times and dates when you called solicitors as a list of this would be useful for judge - i didn't do this but if you did it would stand good for you to show the judge that you have tried to contact and make negotiation and they just were not playing.
  12. hi there just to let you know i have had a letter this morning from chesterfield county court - my hearing is to take place 24th january 2007 the court have ordered that i send all particulars of my claim & evidence of other claims within 28 days - when they receive my particulars then they will write to Lloyds asking for their particulars and also for the breakdown cost of charges and evidence that they are correct - they also have 28 days from date court receive mine. if they do not reply with particulars the judge has requested then the defence will be struck out. i am going to take my stuff into court on thursday - hope that lloyds dont get theirs in - also been thinking that LLoyds have not given anyone a breakdown of costs and if the judge has asked for it they have to give it - or pay up (i hope) On their AQ they have asked for 4 weeks to settle - that was 2 weeks ago - the court have decided not to allow the extra month and to proceed with court proceedings - just annoyed with how far away it is - but if they dont give all particulars required could have my money by end of november fingers crossed) just thought i would let you know as i know alot of you are at the same stage as me
  13. when i spoke to chesterfield county court today - the lady informed me that because they have alot of similar cases they are going to put all cases in court around the same days & times - i.e all in january
  14. hi mollymoo its so frustrating - when 1st posted on this site in july - everyone said oh it will be quick pay out when they gt claim form - then in septmeber when i got AQ everyone said - they will probably pay out day before AQ deadline - then now everyone is saying - they will pay day before court i now think i will end up in court as by january they will have found a way to worm out of it - i am claiming 4k and claiming 8k off RBOS. I have never had any money given me or never won any either - so i am not holding my breath but its worth a try. just gettin fed up of waitiing - i kept telling myself - it will be sorted for xmas but now it wont be. - think i might send a letter to solicitors - but once i have received court date from court the solicitors will receive their notice too so they are not gonna pay out in the 4 weeks they said on AQ as they will now know they have till January.

Just Spoke To My Court - My Aq Deadline Was 2nd October - Lloyds Asked For 4 Weeks To Pay And Not Available All October - Court Have Told Me That A Date Has Been Set For Court For January And They Are Sending Me The Order Through Post Rang Sechairi Clark & Mitchell To Say ' You Wanted 4 Weeks To Settle - Whats Happening?' - Their Reply Was - 'we Are Awaiting Further Instruction From Lloyds And When They Have Contacted Us On What To Do On Your Case - We Will Be In Touch' Helpful As Usual I Am So Fed Up - Needed Money For Xmas
  16. hi all what courts are giving january dates? - i am with Chesterfield (derbyshire) my AQ deadline date was 2nd October & received copy of SC & M AQ and surprise surprise mine said not available for October & need 1 month to settle - only 14 days left - heard nothing - has anyone heard back from letters sent to SC & M asking for settlement - thinking of sending a letter to give them a push i will be keeping check on all your threads as most of you are about a week in front of me i think - my deadline was 2nd october good luck guys x
  17. hi there just after a bit of aadvice really I am just sending 1st letter to rbos - i have 2 accounts - 1 has 3k of charges and the other has 5,200 - what i wanted to know is - is it better to put claim through small claims and just claim 5k instead of 5,200 and wipe the 200 off the charges - i am also claiming with lloyds and i am just waiting to hear from them following the return of their AQ where they asked for 4 weeks to settle with me. LLoyds have been a night mare - they have prolonged the claim in every angle - just wondered if any of you have had any experiences with rbos and could warn me if i am going to have a bumpy ride - personally i think they will go to bitter end as in total i am claiming £8,200. thanks

Hey there everyone - hope you are all well and having success with claims i am at my stage with lloyds where i am claiming just under 4k - I have followed the correct procedure all the way through and i am now at the waiting stage my deadline for allocation questionnaire was 2nd october and sechairi clark also got theirs in on time - they have sent me a copy and they have said they are not available for the month of october and have asked for 4 weeks to allow time to settle with my self (another plan to prolong no doubt) I rang solicitors last week to let them know i have recievd allocation questionnaire and stated that they asked for 4 weeks - i asked what for?? and they said they are awaiting further instruction from lloyds I dont know what is going to happen I have a funny feeling they will not get in touch so thats another month they have gained and let the judge give a court date - can i contest against a court date and state to court that lloyds wanted time to settle and they have not so why should they get extra time?? any one any ideas as to what will happen now - i have heard nothing from lloyds yet of any offer or anything - gettin worried. hope it all makes sense. thanks guys x
  19. hi there i am in same situation really - i received the same defence from the solicitors as everyone else (its a standard letter) then after i received this from court (4 days after the deadline date they had till) i then received a allocation questionnaire - i had 2 weeks to fill in this form and return back - due date back to court is 2nd October - i returned mine same day there is an additional £100 to pay but add this to the claim for costs incurred. i rang the solicitors to tell them i had returned mine to court and have sent them a copy. in the meantime i have lloyds tsb calling me from their collections department telling me i have to pay money into my account and they have no record of any claim on there system and get this ............... Could I send them copies of all letters and court papers etc. (could I do it) - in not so many words i told her to contact there solicitors and get copies from them as i sent them original prelim letters then dealt with solictors - its not my fault they have incompetent solicitors - told them i would not be paying monies off my overdraft as it is under dispute. i will keep you updated with my court date etc. their defence was received on 6th September - so is about another month for allocation questionnaire to be returned then lloyds will no doubt ask for extra time to discuss settlement which is a further 4 weeks. I think at this stage court dates are been set for November / December - I started my claim end of June. Takes ages - will keep checking to see how you are going. clare x
  20. thanks for that rang lloyds today to request visa statements - because it is a visa that has been closed for 6 months they want £6 for each copy statement for the amount of statements i require its costing me £92 (now they are gettin wise) also spoke to court today and they told me i cant add the £500 on now its too far into claim - will have to make seperate claim i wont agree to any conditions as i want to claim visa & this extra £500 does anyone know - can i claim charges on an account that has been closed for 2 years??
  21. hi all i have cancelled all direct debits and credits onto my lloyds account now use my new hsbc fine on a smooth day to day running i have changed all my child benefit monies over to hsbc too as for the last 3 months not used any of it as it is paying my charges - i got charged £500 chaarges this month i only put 700 in to pay the bills so there is never enough to pay my bills and the whole viscous circle starts again - no payment - incur charges - no payment again - incur more charges it is ridiculous me & my husband get 14k to keep mortgage going and raise 2 young kids and in 2 years totalling 28k income lloyds have had 4k of it. i am going for the lot now - all my old visas - can i still claim even if visa account was closed last year????? sod em' i will just keep taking them all to court
  22. checked today i have received £500 additional bank charges when/if they pay me out tht is £500 off my winning cost i have opened up a new account which is up & running fine just wondered if there is anyway of notifying lloyds before hand that i wish to claim for the extra £500 - can you add to your claim once at AQ stage i am one of the lucky ones and i am exempt from paying court costs so i could take them to court over & over again - doesn't really faze me its just the 3 months waiting that gets you down. i am also going to contact them for visa statement s - how much do i pay for these??? does anyone know how much capital one charge for copy statements???? any one else had refund ?? how long from completing AQ to receiving monies good luck to everyone else
  23. hi there just to let you know - lloyds have taken me all the way -i am not been put off though i have just filled in my allocation questonaire and i am awaiting my court date . i will let you know the out come of my claim - follow all steps on this website - i did 1. 1st letter sent out received back 'get lost' letter 2. 2nd letter sent out received another ' get lost' letter 3. court order sent they asked for extra time then filed their defence 4. allocation questionairre rceived from court i have checked my letters received from lloyds and they are standard letters checked against everyone elses on this website and all letters same word for word. unfortubately lloyds are the worst and they will fight to the bitter end - dont back down!! clare amount claiming - £3500
