Yes mate, court date for the 6th of April, is there a template anywhere that i can send to the ICO, im useless to say the least at typing letters Thanks for your help btw EDIT: "Barclaysharks" lol, i like that, must use that from now on lol -

Hi guys! I first sent my DPA request to Barclaycard on the 15th September 06!! I have received statements from May 04 as the rest they say are "held on microfiche". I have started a claim for charges from statements which i have from May 04. Court was ongoing when Barclaycard offered me £390 at the end of Jan 07. I rejected this and also told them to send me statements prior to May 04. They sent me a letter on the 6th Feb saying they were disappointed i had rejected their offer etc etc and they had arranged to get the statements which they claim had been held on microfiche sent out. "Great" i thought! So i waited & waited & still no statements. On the 28th Feb I sent them a letter giving them 7 days to produce the microfiche statements! (as my original DPA request was on 15th Sept 06)! Now on the 13th March I still havent had any microfiche statements - what will i do???

Ok, so Mortgage Express have deducted my £10 DPA money from "my bill" & have not complied with my request in well over 50 days now. Please help, what is the next step from here? I am looking to enforce complience through the courts if necessary. What will i write to Mortgage Express & will i make a complaint to the Information Commissioner? Cheers guys. -

Hiya, many thanks for your answer! They never contact me by phone, because they dont have a number - which is good! I have previously made 4 successful claims, prepared several court bundles, but never got to court, (2 NI banks, MBNA & Cap One) so im not exactly new to this, but i am new to this situation. This is why i need & appreciated everyones help!! Many thanks for your answer, i will do a bit of reading up & try to enforce the DPA request. Does anyone else see anything to help me in my case:???: Thanks again -

Well, i checked my settlement sheet!The £1000 is not mentioned on the settlement sheet. Though they say they "reserve the right to vary the total to redeem". They had sent a covering letter along with the redemption statement to my solicitor. Here it is. On the actual redemption statement is says: Total to redeem as at XX October 2005 £XX,XXX. (This amount was paid). Sorry i dont want to give the amount as they might be watching!! The £1000 cheque we sent them bounced long before this date, im not sure when though, as ill explain in a mintue! There will be some small charges to claim (missed payments). There was no ERC, though i do notice on the redemption statement there is a "Redemption Fee" of £175. Now, I sent off my DPA request to them almost 50 days ago & they had not responded until the 49th day. However, it was not the response i expected. They have sent a letter giving me 14 days in which to pay £990. They took my £10 DPA request from the £1000 & never sent the statements! Cheeky buggers! At the time of sending the DPA request, i had actually written them another letter in which i said i would be contesting any alleged debt & that i would make sure they had a more detailed response with 30 days. (To date i have not sent them a "more detailed response" - naughty me, am i in trouble now)? Please please help me out here... Im somewhat out of my depth! Any help is greatly appreciated! *Also in the letter i got, it said the shortfall had occurred because of a "new computer system". ***After some reading on the forum concerning mortgage companies, am i wise to proceed with this??*** Mortgage Express had previously said they would be taking £5 per month for the debt of £1000. I did get letters at my moms house from them but I have lost all letters sent from them saying this. I also dont know how they intended to do this (they dont have our bank details etc). Previous to this communication re DPA, I ignored all letters from them, maybe not wise but i did. The only thing i have to prove they were willing to take £5 per month is my credit file, where you can see they have a non payment for £5 against me each month. (perhaps trying to mess up my credit file?) Should i now offer to pay them the £5 per month? Would they have to accept it? Please please help, im in a right pickle & i dont have much time -

The guys who sent the offer is Graham Daley (executive office). Total amount im claiming for is around £1700. They have refused to pay the £893 contractual but will pay £94.22 in interest - wherever that figure comes from + the 8% interest which is £271. In total the offer is around £500 short of my court claim. The £500 short consists of the remainder of the contractual interest. I hope you understand & im sure anyone who has recieved a similar letter will understand. Like i say, this seems to be a new tack (last few weeks) from them & would like to hear of any similar situations.

Hiya all! Ive just had an offer from Capital One. I am at the court stage & the return date is the 12th March. They have not replied to the court as of yet. Basically they have offered to refund the charges, the 8% interest & the court fee. However they say they will not refund the contractual interest. I have entered a court claim. I have went through the Northern Ireland Court Service. It states on the NI Courts Service online (where i can track my claim), that there is a "return date" in my case of the 12th March 2007. This is when Capital One need to enter a defence. Its slighty different taking an English based company through NI Courts. This seems a relatively new tactic employed by Capital One & im just wondering if anyone has has had a similar letter lately? There are a few threads on it, but not a lot. Im trying to gain more info with regards to accepting there offer or not. Has anyone else had an offer like this? What next???:-?

OK! Please help me here! We sold our house last year & paid the mortage company off. Then a few months later they sent us letters saying we actually owed them an extra £1000 as we had bounced a cheque payment during our agreement (for £1000). the cheque bounced long before we had asked for a settlement figure & paid them off. We had asked them "how much do we owe?" & we paid them then months later they said "oh you owe an extra grand, becuae you bounced a cheque". What can i do here? Please they are on my back big time!!

I am challenging the debt because my credit limit was £1500 (i didnt spend a penny over this amount) but i ended up owing £2700. Then it was passed to the DCA. So i now owe the DCA £2,700. In total, i am owed over £3,000 in charges. Also, i have just sent my LBA to MBNA today. Now, i have heard that MBNA offed to refund charges to someone else but said they would pay it to the DCA. Obviously i dont want to hand the DCA £2,700 in 1 swoop, so do you know if MBNA can do this i.e. refund the DCA instead of me? I did post this on the MBNA thread but noone seems to know the answer Your a star for your fast replies BTW m8 - appreciated -

Alan... A quick question for you buddy! Cutting a long story short, after my MBNA acount was passed to a DCA (arrow global ltd, account managed by fredrickson Int Ltd??), they sent me a nasty letter (revieved 18th October 2006 ) asking for £383 within 9 days! I immediately got on here and responded with a CCA request along with a £1po sent on 23rd October. Then Fredrickson International (who Arrow Global Ltd say manage my account) Wrote me a letter dated 25th October 2006 saying they have passed a letter to Arrow requesting a copy of the agreement and information regarding the transfer of the debt & information to Arrow. Arrow also said they were now the data controller of my personal data (which i also believe is illegal as i signed nothing). What i want to know is... Will i just leave things as they are, as no news is good news?? -
Hi all. MBNA sold my account to a Debt Collection Agency a few months ago... Washing their hands of it apparently. I now have a LBA sent to them to recoup my charges i have paid. What i want to know is.... After someone said that they were in a similar position & that MBNA had said they were going pay the money to the DCA, are they allowed to do this? Anyone in a similar position/know the law on this? Cheers all!

Thanks Rob m8! I was told that i could send a LBA straight away as they couldnt use the excuse that they didnt have enough warning anymore (must be with all the claims are putting in). I think ill just send an LBA now & see how it goes. Thanks you VERY much for all your work & help

Hi folks! I just got a printout of my statements today from MBNA! I need to know the answer to 2 questions The first charge i am claiming for is from January 2001 & the last charge on the list is June 2006. Now, as there was nothing about interest on my sheets (i didnt get statements just a list of charges & transactions) i want to know at what % i will add the contractual interest to my spreadsheet of charges?? What is the norm folks? Also, when i count up my charges alone without any interest & it comes to £2000, which is the most i can claim through a court in Northern Ireland. When i add the charges it will for arguments sake be £3000. So i will write mbna a letter asking for £3000 back? I thought i couldnt claim the interest until it went to court? Cheers folks, looking to get this sent off ASAP. MBNA have made my life hell at times & im looking for revenge
