Great, you are on the right track, the partial settlement offer is in the library if you wish to use that....
-
You need to amend it to show the total claimed, you dont want to give them any reason for wanting the claim to be struck out, it is not complicated, you amend your schedule, you fill in the N244 and follow MCOL's instructions, its a fair bit of money to lose out on in my opinion for 1/2 hr or so of your time. Up to you though.

Okay you need to send your letter of non compliance from the templates section to the bank (where your sar request was) you also need to go here ICO – Information Commissioner's Office and report them to the Imformation Commisioner.
The bit about manual intervention is standard, we all get it, they have been given an opportunity to reveal it and have choose not to which is all good news......so get your letter done and in the post....

I believe if you can reclaim it the money will then be used to offset some of your debts....I meant you couldn't reclaim it and then have the money yourself...
-
Personally if you have already sent an LBA, only give them another 7 days to reconsider, 14 days is very generous, you MAY have your money back by christmas if you keep to 7 days...."may" not "will"

Wait, where has the 122.63 and 69.39 come from?
I want to clarify before advising you.
-
Your 8% should have been sent on the schedule of charges you sent to MCOL, also it should have been included in your MCOL claim an reflect as such in the total claim you are making.....you can amend it however, do a new schedule, you will need to as I already said ring MCOL telling them you have made an error with your figures and pay to amend it.....

answered on your thread.
-
I do not think that if you have been delcared bankrupt that you can reclaim these charges. Sorry

How did you file? Online or through your local county court?
-
Try here, also do a search for lloyds defence, it brings up lots of pages of defences.
-
You can claim compound interest you know? Do a search for information about it, some are doing it and it does seem to add up to ALOT of money.
-
Yes I am sure its the standard one, if it is from Peter Townsend and states they are under no obligation to discuss manual intervention and quoting rubbish about microfiche thats the very one we have all received!

Hi Guys
Thanks to the clear guide lines from this fab website I have had no problems thus far and things have gone exactly as shown on the forum -
However Its almost been 2 weeks since the LBA was sent to Barclays and im about to start my MCOL application and get LEGAL on there asses!
I have completed a Dry run and all looks fine apart from:
1. Which defendant address for Barclays should I Use (I have been corresponding through customer services Leicester for all my previous letters) - Should I use this one or the head office address in London? Head office - London address - churchill place
2. I don't think it does but just to check do I tick the yes or no box for the "does this involve the human rights act of 1998"? NO
3. Is there an option to attach my schedule of charges onto MCOL? if not how do I get this to them? No you will need to post a schedule to both the bank and MCOL asking MCOL to attach it to your claim as there was no facility online to do so.
4. Do I have to send yet another copy of my schedule of charges to the bank (my local branch or the Customer service dept at Leicester) and if so why? See above. They will get a copy of your claim from MCOL and make act stupid and say there is no basis for the claim as there is no breakdown of charges with claim.
Any answers to these troubling questions would be awesome
Thanks in Advance
Jas
Hope that all helps!
