Nothig else has happened! Checked moneyclaim and they havent put a defence in yet roll on 19th April!

Think I will typr up the LBA in a bit and get it sent today. Do you think I should return the cheques as well?

Capital One have aknowledged my claim on 23rd March and I sent the rejection letter today to Mr Udy telling him its too late i have already filed claim! Hopefully not long now:)

Has it gone past the 40 days? If so report them to the ICO you can print a form off the internet and send it off with copies of your letters. Send them the letter on the bank templates library dpa non compliance i think. I had to send this to them as they lost about 7 months worth of statements, funnily enough they are from around the time my account was sent to debt collection because I couldnt afford to pay the charges! GE seem to be losing quite a lot of statements that have charges on when they send you the statements!

I am at the same stage as you! They sent me two cheques for the charges amount but no interest! I sent them the rejection letter and havent cashed the cheques. If I dont hear anything soon I will return them with the LBA.

I did one SAR and put all my account numbers on it they are quite quick to offer you cash as well. They offered me all my charges back including the ones i had to estimate cause they couldnt find any records of the missing statements! I havent accepted though cause i want interest. Good Luck

I've still not had a reply from my rejection letter, do you think I should send the LBA now as the 14 days from the pre lim has now expired?

Got another letter from Mr Udy today saying he is still sticking to his last offer as final settlement and telling me I should accept so not to waste the courts valuable time! Too late Mr Udy I have already commenced legal action.

I got this letter from sarah wainwright too! I reported them to the ICO and they investigsted and now they are sending my complaint to GE, i was a bit dissapointed really i expected something to happen! GE offered me the charges but not the interest so i am waiting to hear back from the LBA now.

Got a letter from the court today to say they sent the claim form off on the 20th and it will be deemed served on the 25th. Cant wait!

Yes i did, i got one from someone on here who has done capital one before and then i just changed the account details and amounts.
