  1. Does anyone know whether I could take action against them for breach of contract as they are taking my money but not providing the service they promised and are contracted to provide.
  2. It's now March 6th, still no email, still no phone. Last time I spoke to customer services I was told that I should not have been advised it would take two days to solve the phone problem it takes 39!!!! I am on the verge of writing directly to Sky Chairman to see if he realises what a bloody awful service he is providing (or not in my case).
  3. I stupidly decided to take Sky Broadband and Sky Talk as I have Sky tv already. It appeared to be a good deal and I've always had polite, immediate action when there was a problem with the t.v. service. On 4th February I hooked up my broadband but, when it came to getting into the emails I found that they had forgotton to send my password. Bit annoyed but waited for them to send it by post. This arrived 4 days later and, it would not allow me to log on. In the meantime my dialup was 100 times faster than the broadband. On the 8th February I tried to use my telephone and instead of being able to dial out I had a message to contact Sky. They told me that the phone service had been cancelled, they could see it wasn't by me but it would take two days to fix. I phoned on the 10th, 15th, 16th, and 17th as my broadband nor my phone was working properly and I still couldn't gain access to my emails. I told them on the 17th that I wanted to cancel. I was told that the only way I could cancel was to write to the Customer Care Department and complain. This I have done but, I don't know how long it will be before I get the broadband and phone removed. In the meantime, I have to dial 1280 to get a BT line and I still cannot access email. It takes 20 to 30 minutes to access the internet and every time you want a new search that takes just as long. Anyone else having these problems with Sky?
  4. I've just been told by the court that they have received a letter from Saatchi and co that they are going to pay the full amount into my account. I can't believe it. For anyone who thinks they cannot do it, believe, and keep reading CAG forums. THANK YOU, THANK YOU, THANK YOU. Donation will be paid on receipt of the readies from LLoyds. :lol:
  5. Thanks Gary, sorry had a big problem with my broadband so I've been without email. Read through it and have modified it where necessary however, believe it or not, I don't have a statement which shows a charge for a small amount and I would like to have a copy of the letter you mentioned where it is stated that the charges are penalties or defaults. Is it possible for you to send this please? I'll send you a private message with my address. Thanks so much, it's a really big job making sure everything is right before sending it off to court, but so worth it.
  6. I've been asked to file a "skeleton legal argument (if points of law are to be argued). I have until the 17th to do this. Is there a template for this?
  7. Thank you so much Gary. I did use the template and made especially sure that I edited it to my particular details i.e. my bank account details, amount of the claim etc so I was concerned when I received the Defence. I havene't had notice from the court to amend but I shall use your new template just to show them that they havn't scared me off. Thank you so much.

  9. Their Defence has arrived! It says, briefly (it is 2 1/2 pages long) that the "Statement of Claim is insufficnetly particularised and is embarassing. "The Particulars of Claim do not comply with the Civil Procedure Rules as they do not identify an account and make no specific allegations agains the Defendant as to why the Defendant should be liable...." " There is no breach of contract, the charge cannot therefore be a penalty consequently there is no requirement that the charge be a pre-estimate of the bank's loss" The charges are fair and reasonable and it is denied they are unlawful" "the charges are for banking services and are not damages nor a penalty" The bank is entitled by contract to impose the charges which are fair and reasonable. The claim is denied in it's entirety. I don't like the sound of this at all. HELP!!!! Hearing date: March 7th 2007
  10. Had a nightmare with them myself. Paid for "employment protection cover" and when my husband was off work as it was possible his leg would be amputated, they said I wasn't covered. I wasn't receiving any wages and couldn't pay my monthly account and they just took the michael with the charges. Just sent off my SAR.
  11. Hi, Thanks for your response. I sent the SAR on 13.8.06 then a non complaince letter on 5th October which I would say was giving them more than enough time to respond. Should I reply now saying thanks I'll take the £80 as a part settlement but I intend to pursue the rest together with contractual interest? Really appreciate your help with this, lots of people would give up I think without the support of this site. Best wishes,
  12. I can't seem to find a thread for this firm. So am I posting this in the wrong place in the first instance, if so please accept my apologies. I'm sending the DPL today but can I clarify if it is £10.00 or £12.00 that I should send when asking for statements. Had a letter from Barclaycard which said it was £12.00. Any help appreciated.
  13. I sent the DPA letter with cheque and received no response, so off went the breach letter still no response. Yesterday I received a letter saying that they don't agree with the OFT decision etc, etc but as a gesture of goodwill are sending me a cheque for £80, which I also received yesterday, "which is the difference between the charges incurred and the £12 (I thought it was £10) fee. They have not sent me any statements but from the ones that I have already (I closed my account in 2003) I estimate that the charges amount to £160. What do I do now? Anybody had this happen to them?
  14. Hi I've issued my claim and ever since they have been ringing me twice a day. My account is still open and there is £778OD (as they have removed my overdraft facility) and they want it back. I did set up a direct debit for £10.00 a month to show willing but I don't know what to do about the phone calls. Has anyone been in the same position and if so, how did they deal with it? Claim number: 6TW02404 Issued: 31.10.06 Court: Trowbridge County Court Charges: £1,1,042.40 Interest: £416.95 Costs: £0.00 Total Claim: £1459.35
  15. Thank you so much. I thought it a bit strange that I have now even received an acknowledgement so, I think I will go down the route of sending them a new LBA recorded at the contact address that Jonnie provided. Thank you all so much for your help. I'll keep posting my progress.
  16. I sent the DPA letter on the 13th August. I left it until the 5th October to send the non compliance letter but have received nothing, no acknowledgement or anything. I didn't send it recorded delivery. Do you think I should send it again recorded this time?
  17. I've sent the D.P.A letter and followed that up with the Non compliance letter to Barclaycard but have still not received anything. I cannot calculate the charges if they won't send me the information. What now? Any help appreciated. Thanks Andrea.
  18. I am over my overdraft limit and will be sending my court claim today. I am over the limit only because of the charges and interest they have imposed. I have had a few calls from the Collections Centre about this but, when I told them I am posting a claim to the court today, they said they won't ring or wite to me as this is not something the Collections Department deal with. Don't know if that is of any assistance.
  19. I'm just about to send my claim form off to court and I will need a bit of electronic hand holding too. I have a sent the DPA letter to Barclays and TSB. Their Collections Centre kept ringing me but now that I have told them I am about to post my claim, they said they won't ring or write to me again. That's a result in itself.   21. Sent my Data Protection letter on 11th August with cheque. No acknowledgement ever received, cheque remains uncashed. However, I have received statements of charges for the past 6 years. I was expecting actual bank statements. Does anyone know if the statements will be sent separately or not at all? Getting geared up for Stage 2.
  22. I sat next to a bank teller who allegedly refunded my charges whilst I was watching her only to find that when my statement arrived at the end of the month, the charges were there loud and clear with no refund!!!
  23. This site is soooo wonderful. Had so much ***t from Lloyds over the years. I have sent off my data protection letter and I am reading all the threads, FAQ's and anything else I can get my hands on. It's about time that bank customers had the opportunity to say "what you are doing is wrong, you cannot do this to me". My 5 year loan run for 4 years without a problem. 6 months ago they started charging me £25 a month as they said there was no direct debit set up on the account. Can I set it up over the phone, no that is too ridiculous. Whose authority have they to take the money if there is no direct debit, appartently they don't need your authority. So what is the point of the direct debit in the first place?!!! They said they had refunded the money, nope, there it was on my statement again at the end of the month. On checking my statements apart from the usual £30 here and there at one point they charged me £60 for a returned DD. So far, I'm claiming £460 but I am a couple of years short of statements. I have also sent a DPL to Barclarycard and my claim will be £180 both without the interest calculated. I'll calculate the interest when it gets to that stage. I can't thank you enough for giving me this opportunity to be able to do this.
  24. I had a loan running with Lloyds for 5 years no problems. Suddenly started getting £25.00 charges every month as "there is no direct debit on this account and we are having to take it manually" When I queries whose authority did they have to take the money if there was no direct debit, I was told "we don't need your authority". So what is the point of the direct debit and why were they charging me £25 a month?!!!!! When I complained in person, I was told they would refund the charges and it looked like that's what they did when I was there. Lo and behold the next month's statement had the charges back on it. AAAAhhhhh!!!! I have now sent my Data Protection letter as they completely did my head in financially as well as psychologically.
