  2. Ok claim has now been acknowledged by the bank. Does that mean if no reply in 28 days the money is mine. If someone could answer the last few questions id be grateful cheers

  4. Congrats welsh dan. How long was it after you filed for a claim on money claim site that they refunded. I have issued my claim 7 days ago but not heard a thing so i am curious myself
  5. Week gone now since the claim was issued and accepted, still yet to hear anything. Is there anything i should check to make sure ive done everything right?

Just to check Claim Description - Unlawful Penalty Charges The type of defendant is Organisation, Halifax Bank Address is Halifax PLC Trinity Road Halifax West Yorkshire HX1 2RG Particulars Of Claim = Claimant has account ****** with Defendant since 2003 conducted on their standard terms and conditions. Claimant is claiming the return of £864 taken by Defendant in charges since 21st June 2006. The Defendant's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. They are also invalid under the Unfair Contracts Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999.Para.8 and sch.2.1.e. In the event that the charges are not a penalty they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. Defendant has declined justification of charges despite repeated requests. The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from 21/06/2006 to 31/10/2006 of £11.02 and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of 19p. Can someone please confirm that i am correct that the daily interest rate is 19p and also on the money were it says Amount Claimed = 864.00 should I change it to 875.02 to account for the interest too? Also i notice that it asks for reference details on the money claim site. I have left this blank but it made me think will the bank be able to identify me by using just my account number thats in the particulars of the claim? Ok thanks alot hopefully someone can answer these questions so i can continue with filing today.

I am unsure what to put here, i worked out interested by using spreadsheet templated. Also on the money claim site were it says Amount Claimed = 864.00 should I change it to 875.02 to account for the interest too? Apart from the above two questions is everything else ok?   11. Thanks for your help, i have read the FAQS. The threat i made was if i havent recieved the money i will file for a claim. But i could not file for a claim because i did not have the money. I have the money now and i am ready to file. But i was just checking if anyone else thinks i should either send the bank a letter just letting them know that i am filing for a claim as i gave them 8 weeks to reply and have still heard nothing. Or if i should just file for a claim.

  13. Ok i have not stuck to my guidelines purely because when its come to filing for a claim i just havent had the money. But im going to send this letter again before a file for a claim. Can anyone see any problems or recommend anything thanks alot.
  14. I still havent filed for this claim yet. Totally forgot all about it. It charges now stand at £569.81 that includes interest. If i file tomorrow for the claim will i have any problems because ive left it a month later than scheduled partly due to not getting paid last month.
  15. Thanks alot zooman for your help. One final thing I am fully expecting a knock on my door on Monday from the baliffs. If i do not wish to answer door purely because i dont want people to force there was past me and me not able to proove it. As stupid as this sounds can i speak open the upstairs window and just say to them you are not gaining entry into the premisses, give them a copy of the letter im sending today and say to them can you please leave. If they do not leave and persist in knocking until i open front door. Can i call the police as really theys hould not be on my property

  17. Ok thanks alot i acutally want to pay the debt of as soon as possible so if I say ill pay a MINIMUM of £100 a month then i can pay £300 one month rather than be tied down and have left myself £200 incase of any emergencies would that be ok?

  19. If i do not answer the door and keep the door locked at all times can i just do that til the end of the month when i have the £300 then pay that, and then pay it again the following month? If yes if am in and they know i am in as he said they would. If the knock and see me etc but i dont answer the door is there anything they can do? Or would i be able to phone the police due to them harrassing me? because they wont get off my private property?
  20. Well i contacted the actually baliff company to find out a breakdown of there charges he asid to me, for calling round at your house we charge £39.50. Thenf or removal of goods we charge an additional fee depending on how much was collected. I then asked him if he could go over the next steps for me as im confused. He said will you have any money for me to pay today, i said no i can only pay £300 at the end of the month. He said fine what will happen is someone will knock at your door with a removal van and a removal team. He said if you dont allow the company any access to the premises then we will call back another time once again knowing when you are in, and we will do the same proceddure again if you do not allow us entry then basically it gets sent to the magistrates court which means you will be trialled to go to prison. I said ok then thanks. He said thanks and put the phone down. Is there any advice anyone can offer because quite frankly i dont want anyone showing up in the house and taknig stuff and i dont want my girlfriend who lives with me getting a fright if anyone aggressively knocks!. I just want to pay £300 a month til the debt is gone which is what i can afford.
