  1. i just got the same thing this morning! has been less than 2 weeks! i sent off my 1st letters around the 4th! just send the LBA if its been over 2 weeks since you sent the 1st letter to them!
  2. well I was going to ring them today, but this morning in the post they have sent me a cheque for the total amount! They say this is a gesture of goodwill to end my claim ect. I dont think there are any terms and conditions attached like i cant claim any more ect. from the letter: acceptance by you of this goodwill payment will be strictly on the basis that: 1. you agree not to disclose to any third party the fact of, or any details relating to, this payment: 2 you write to the court withdrawing your claim. Please note that any overdraft charges that properly accrue in the future will be applied to your account in line with our clients published tariff and in accordance with your agreement with our client. __________________________________________________________ So I think I am ok to put the cheque in to my bank! They have also charged me a couple of more times, since i originally made this claim! so for my next, do i have to start at the beginning again? by sending the letter asking for the charges directly to NatWest, then threatening with court action, just like if i was starting a fresh.   4. had a call from Cobbetts to day, they left a message for me to call them back as soon as! and gave me a direct number! is this normal and should i call back? cheers
  5. have just received a letter from NatWest! Formal notice of intention to file a default and to take action to recover debt! Please note that unless, within 28 days of the date of this letter, satisfactory payment or arrangements for payment are made with the Bank, in response to the attached default notice, information about your indebtedness will be given to the following credit reference agencies, Callcredit PLC Equifax Europe LTD Experian LTD All of the bank charges have just been getting higher and higher each month! and my account is in the red by a couple of hundred Im currently in the small claims court stages of recovering a large sum back from NatWest! Can I just reply to this letter explaining the amount owed is in question and is going to court ect and not pay them till they pay me back the charges that they owe me? Or should I start paying the money back. also they have charged my account £30 for sending the letter! Can i start a new claim once my 1st one has been settled to claim these charges back also?   6. have just had a reply from the court! It is ordered that 1 The defendant do file and serve an amended defence to the further particulars attached hereto by 4pm on 20th july 2007. Dated 29 june 2007 i sent them the standard reply about the cpr 18 request, saying that i was not prepared to answer it ect. along with a list of the charges im claiming back not too sure what to do? cheers if you can help

  9. Hello! Am slightly ahead, you will probable be getting the letter about the cpr request next week, well its more like a booklet! hopefully all will turn out good for the both of us in the end
  10. Received a letter to day from cobbetts! Request for further information and clarification! This request is served … … … CPR part 18 … … … Rule 27.2(3) Have until 20th June to reply! I take it I just send them the template letter, from the CPR 18 post on this site and another copy of my list of bank charges, also do I need to send a copy to mcol, or will I now need to send it some where else as it moving to the court? Thanks
  11. Just logged on to mcol and its now been updated! Defence You are unable to take any further action online on this claim. The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly. What’s likely to happen now? Thanks
  12. If you use the search on this site, there is a letter than you can send to them! also you include your list of charges with this + send a copy to MCOL! I think it would be best for you to make your own post, or update your previous post if you do have one!
  13. Tomorrow is the lastday, and then they would of had the full 28 days, from the 9th may when the claim was deemed to be served! Havnt heard anything from them as of yet, and nothing about the CPR 18 request, but like before i guess it could turn up last minute!

  15. I filed a claim with the online money claim. I have only ever received 1 letter from them. saying that the claim was issued on the 4th may 07 and the defendant has until the 23rd may 07 to reply. Haven’t heard any thing from them since the start of the claim. Iv logged in on the site and I don’t think any thing has changed> Says claim issued 4/5/07 - judgment start and warrant is blank. any help would be appreciated Thanks
  16. am slightly confused by filling this n1 form! also iv read on here that people have added a couple of A4 pages about the claim? also many people seem to rush this and end up paying to refill the form in, so i dont want to make the same mistakes! thanks
  17. thanks! just had a reply from my LBA! there not giving me the full refund, so it looks like i will have to take the next step and start court proceedings! i sent the LBA on the 2nd august, is it ok to start now with the next step or should i wait till 14 days have pasted? they say in the letter that any proceedings should go to to: 135 bishopsgate London EC2M 3UR is this the correct address, as they could be trying to delay the claim? Also i have had another bank charge since i started the claim, how do i go about adding this on to the claim or will i have to srart over again? Thanks again
  18. i have decided that im going to try and get the full amount off them! is there a template letter to send saying that i will accept the amount as part payment? also do i need to sign the letter that they sent to me, saying that i accept the amount they offered as a refund, or just leave it blank and send it back with the letter explaning what i plan to do next, if they dont refund the full amount? cheers every 1! hope i win!!!
