Thank you for your replies they are appreciated and have confirmed what I suspected but I need to make contact with the court, can I do this by telephone as I already said I work away all week and would be very inconvenient to get there? As am a bit worried about the short time frame i.e they are expecting full payment by Tuesday 21st Many Thanks in advance Crasin

Just to explain i bought a car on the 2/2/12 and sold it on the 8/2/12 the new log book turned up on approx the 20/2/12 and i filled it in and returned the same day i then received a letter from dvla stating that someone else had applied to be the new owner etcetc on the 1/3/12 and then received a letter from another dvla office on the 29/3/12 saying that i owe them money for failing to notify so i contacted dvla by phone and explained where i was told to put into writing to explain to both dvla offices which i did but did not receive a reply from either office so assumed all had been sorted but received letter yesterday saying i owed £305 but cannot say when arrived as work away from home and did not receive a court summons, if i had i would have attended and pleaded not guilty just to clarify a little what i'm worried about is i have to pay by the 21st of this month and there is no information on the letter explaining how to dispute or appeal and nothing is open on a saturday and i return to work on monday Please advise asap! Hi all be a reader for some time but have recently had what appears to be a problem with the usual failing to notify saga but it has been to court and i have lost without me receiving any notification of it going to court?? This all happened in February this year where I bought a vehicle then sold it a few days later without having the v5 as I was still waiting for it but as soon as I received it I sent it away to DVLA as I sold it to a motor trader but only approx 2weeks later I had received a failure to notify them yet it had only been sold 2-3 weeks prior so I wrote and called both DVLA in Swansea and Poole in Dorset but still got no reply I work as a long distance lorry driver and just returned home last night to a letter dated the 7th august saying I have to pay £305 by the 21st of august, I do not know what to do any help would be much appreciated!! yours hoping crasin
  6. Hi all could really do with some advice as this problem of mine is getting on mine and my wifes wick... I had a capital one card couple of years ago and in my stupidity i ran up about £150 and never paid it.... my bad and and now regretting it but recently we had a "notice of issue of warrant of execution" from northampton(ccbc)? demanding approx £77 in fees etc so we paid this because of the threats to collect goods to sell at public auction etc! and thought nothing of it....Now we just received another one for the same amount and still showing a total of about £430! My questions are 1.should i pay this £77 (maybe to give us breathing space to fight this) 2. I accept i owe them money but if i pay above then i have paid more than i originally borrowed but they keep sending warrants! should i fight them? 3.if i fight them i really could do with some advice from start to finninsh as tried reading whats already posted but there is alot! of posts etc to get through! many thanks in advance to anyone taking the time and effort to read this! craig
  7. update went back to work and 1pm and got a phone call an hour later saying he's at the door! so she refused to open the door and i turned up approx 5min later and he told my wife he would wait but was nowhere to be seen....and posted a letter not in an envelope stating he will return without notice.....so i phoned him and asked what he hoped to achieve by visiting and his respose was "at least £697 odd p" so i replied by saying he had no chance and that i was going to contact council direct.....then he hung up....so called him back and he canceled my next 8-10 calls then finally answered and started waffling on about something to do with council wont do anything and that i would be wasting my time.............so said that i was going to complain to the council and the court where his licence was issued about the charges and conduct.....he hung up again......lol so called him again and explained no point visiting again as there's nothing here he can take and to not bother me again then i hung up..lol crasin

  9. tried calling today but would not accept anything less than £700 which is impossible at that sort of short notice and as far as i can remember only owe about £900 and there total so far is £1945.56 Also about the car i bought it about 3-4 months ago and still not had it so would assume he has not sent away and i work on a building site and could be moved to another site at any time so do need car for travelling to work really although do not need this instance many thanks crasin

Sorry should have said its for unpaid council tax and is with phoenix, Slight missunderstanding with car i do technicaly own the car but previous owner has not yet sent off v5 to register to me so in theory not mine wink wink and could i not argue that i need my laptop for work(even though i no longer owe it) Also family member has just wrote a letter stating that everything execpt clothing,bedding,childrens toys and washing up bowl(added for up ya bum satisfaction benefit) was owned by them and rented to us and that anything removed wothout there permission would be theft and would be dealt with by the police! many thanks crasin
  11. Sorry forgot to add there is nothing in our house which we own we rent from a family member, we rent it FULLY furnished so they would gain nothing and already know this
  12. Hi all just spent most of my evening reading this and many other post contained within this thread but really need some quick answers or advice if possible? Have had some (very little) dealings with, well it makes little difference which company and have stupidly allowed and bailiff into my house and signed a walking possesion order for my car (which is not regestered to me or my wife) and a cheap laptop(which has sinse been sold to buy food!) but had a letter today stating that they are going to attend 2morra "with a locksmith and police to gain entry to my property" although i understand that the police won't attend i will be at work (2min away) and my wife will more than likely be at home with young children. My real question is can they force there way in and what rights do we have to stop them? As i am concerened for my familys safety if I am not there at the time? i have stated on the phone if they attempt to get into my house they will have to get past our big german shepherd and that i will bring my 13ton forklift from work and crush there vehicle(said in haste but is very tempting) Please advsie asap where do i stand? many thanks crasin
