  1. Hi Kitkat35 (or anyone who can help), I filed my online claim (£3200 + 8% interest) yesterday and was wondering about how the courts would receive my schedule of charges? Which court address should I post this to? (I sent an updated and complete set of charges to Nationwide by recorded delivery today). many thanks KenSpe
  2. Many thanks MTM, I adjusted my schedule of charges accordingly, which will be winging its way to Nationwide HQ by recorded delivery this afternoon. Further question; I am sure that the smart folks on here have thought about this, but I was wondering about the effect of the charges. I had £219 worth of unlawful charges taken from my account on the 25/12/2006, which may mean that the direct deibt for my mortgage isn't met. I have put monies into my bank to try to stop this happening, but if it fails, I will be in deep trouble. Would it be reasonable to claim from the Nationwide any penalties that I incur from my mortgage lender? If I check back over the last 6 years of my Nationwide account I am certain I will find a number similar events and knock on effects of their unlawful acts! Comments welcomed!
  3. Once agan, thanks for all the encouragement and the amazing stories. I Completed the MCOL this morning, £3424 + 8% interest...just sit and wait now. Does the court notify you when the papers are served upon the Nationwide? Do the Nationwide inform you that they are paying up? I am sending a second schedule of charges to the nationwide and would like to know, is it critical that each charge levied is identified as to when it was applied to the account (i.e. on the statement) or when it was actually extracted from the account? Hi, Looking for a bit of encouragement and help...I sent my initial letter...got the oh so standard reply...sent LBA directly to the Nationwide Solicitor at HQ listed in the contacts on this site..letter completely ignored and no refundof unlawful penalties. I am filing my online action via HMCS tomorrow (for £3300 plus 8% interest and court costs) but wnated some advice as to who to name...should it be the Nationwide Solicitor or just the building society itself.   5. Issued my preliminary letter (addressed to my local branch) on Monday 27th November requesting a refund of £2981...received very nice letter from the Member Accounting Service this morning. The letter outlines that we accepted their terms when signing the application form etc, they are unable to refund the charges and regrettably (thier words) they suggest that we might like to make alternative banking arrangements and finally suggest that I communicate with the Financial Ombudsman Service. I am so grateful for this advice that I am going to stop my claim! Only joking, do they really think that such communication will stop folks claiming? LBA going in to Nationwide HQ on Monday, with new adjusted amount £3210 (they have just stung us for another £219 in charges). Incidentally, the thing that really got me into this action was the fact that thay have hammered us with these unlawful charges whilst persistently over a period of more than 5 years refusing us an overdraft. In other words they provide the platform to create the charges by refusing to help when things are tight. Getting nervous now as we move towards court action, any words of advice & encouragement gratefully received.
