  1. You can only get a CCJ if they take you to court, you lose the court case, and then you defy the court and don't pay. CCJs are used to punish people who defy court orders. As Alliance don't do court you can't get a CCJ.

  4. We have about 130 cases at this scam site. Yes, that's what it is. It's been exposed as a scam site in the national press and on national television. Of those 130 cases, in only six have MET tried court. One was thrown out at a preliminary stage by a judge, in two cases MET discontinued when the Cagger defended, two are ongoing, and in only one case did MET actually win when the motorist stupidly didn't defend so MET won by default. So don't pay them a penny. Mind you, you haven't helped yourself by outing the driver when there was absolutely no need to.
  5. Very briefly as I'm at work. Yours is the ninth Alliance Parking case we have. Despite all their bluster, in none of the other eight have the parking company had the guts to do court.
  6. As you talk about a "regular" spot, I'm guessing this car park is near to you. Go back, ask to speak to the manager, and request they get the charge cancelled. There surely must be a good chance given you're a BB holder and all the other BB spots were taken up with people abusing the spaces.

It was really this daft Privacy Notice we were after, but no worries, I'm 99% sure it doesn't count as a NTD otherwise in his letter Simple Simon wouldn't have offered the discount of paying £60 instead of £100. Apologies for jumping the gun earlier. It's a pity your friend paid. It's neither here nor there if Excel would back down or not. They are not some statutory authority. They're just a cowboy private company. The only way she could have been forced to pay is if a judge had ruled against her in a court hearing, which is highly unlikely given she could have proved to have been elsewhere. I see her "offence" was in May 2023 so logically Excel and their signs were there by then.
  8. Thanks for filling in the court claim sticky. Please do the PCN one too as dx asked. Are you sure she didn't receive a Letter of Claim? If so we can add that point to the standard defence.
  9. On the version on external sites you left the PCN number showing. Can you please upload a new version here with the PCN no. redacted but showing all the dates and times so we can work out if they have respected the Protection of Freedoms Act timescales. Plus fill in the sticky as dx asked.
  10. On the one hand it could be that the gym have been great and it's UKCPM who have "forgotten" to cancel the invoice. Or on the other that the gym have fobbed your husband off. This time make sure to get an e-mail address for the gym when there, and confirm the conversation by e-mail. It's important to have a paper trail.

  13. On their website and on Companies House it is: Floor 3, 207 Regent Street, London, W1B 3HH, but jk2054 reckons it is simply a letter box. I've looked & looked but can't find anything else.
  14. The point is that Schedule 4 of the Protection of Freedoms Act sets out two different timeframes in which the invoice has to get to you. 1. If a Notice to Driver was left on the windscreen. The timeframe is 29-56 days after the incident. 2. If a NTD was not left. Then within 14 days. I think I jumped the gun and presumed (1), but in fact it was (2) in your case, as the bit of paper was not a NTD but instead just some rubbish telling you they were going to use images of the vehicle for "parking control" (AKA to rip you off). None of this changes that their case is rubbish. If you can upload an image of what your neighbour got that would clarify matters.

Do you know if these parking restrictions are recent? if so there is stuff in the industry Codes of Practice about the change having to be made apparent with special signs, none of which Excel will have put up.
  16. I agree with everyone about the ten million reasons why this wouldn't stand up in court. Just one thing though. I think I made a mistake in post 11. Does this daft Privacy Notice supposedly left on the vehicle count as a NTD? I don't think it does. It's not a demand for payment. I think it's just some rubbish saying that the attendant has taken photos of the vehicle.

  18. I agree with the others. I've been on this site eight years and have seen plenty of people naively appeal to Excel/VCS - not in one case did Simple Simon accept the appeal. Unfortunately most of those who did appeal also outed themselves as the driver and made winning more difficult. Interesting that their invoice is for parking in a restricted area, rather than parking outside of a bay. Also interesting that we had absolutely nothing on this car park - and now there are two cases within a few days of each other.   19. Yes, the snotty letter should not respect any of Simple Simon's systems. Invest in a 2nd class stamp tomorrow and get a free Certificate of Posting from the post office. However, watch out that Simon throws claim forms around like confetti. The snotty letter might convince Excel that you are more trouble than you're worth or they may chance it anyway.
  20. I didn't know what Shiply was until finding this thread. I've had a good read through reviews and indeed signed up myself today to ask for quotes for a mock delivery. It seems like one of those things that go right most of the time. To be fair to them, the majority of reviews are positive. But when it goes wrong it goes very wrong. All the one-star reviews tell the same story. Driver steals the goods. Shiply have no customer service and do nothing whatsoever.
