  1. According to the legislation: Section 75 will not apply if the lender is also the supplier. When they call me (or I inevitably contact them), what should I tell them if I want them to address their repair, as owners of the asset under CRA? Regarding the formal notice, please could you point me in the direction of how to execute this properly (assuming there is resource available on the forum somewhere)?
  2. Yes, clearly states iPad Air 3 Silver 64GB on the CA. Lender: Sky UK Ltd
  3. Hello, I purchased a 4G/WiFi Apple tablet from Sky Mobile under a credit agreement about 18 months ago. There is no mobile contract associated with the device, just a sim-free device supplied under a credit agreement. A fault has developed with the “lock switch”. Basically won’t work unless you press it REALLY hard. I contacted Sky mobile to discuss repair or replacement. They said, “As it’s outside of the manufacturer’s 12 month warranty, we can fix the fault, but you would be charged for it”. I told them that I disagreed and referenced the Consumer Rights Act 2015, I also referenced a document provided by Citizen’s Advice Bureau that stated they are responsible for sorting it out. The call went no further and the agent did not want to concede. I am waiting for a call back from a “manager”, as I escalated the call. Just looking for advice on what to do, or say next. p.s. the fault is definitely not the result of damage. The device is well-cared for and has never left the house. Thank you in advance!
  4. Please find PDF attached, apologies for the mess in my last post, haha!
  5. Thought I'd provide you with an update since filing my defence. I have received the following letter after letting the courts know this is SB. Do you think they are making a final attempt to get money from me? Knowing it'll be SB by the courts if they proceed? Sorry guys - wouldn't let me post a photobucket link to hi-res image

  8. Hello, Back in 2007 I took out a loan with Welcome Finance. It was to pay off debts for a wedding which never happened. I went through a bit of an emotionally rough time and I don't even think I made my 3rd monthly payment. TODAY I received a claim form from the County Court Business Centre in Northampton. LOWELL PORTFOLIO LTD are chasing me for the money owed and attempting to obtain a CCJ on the debt. The debt is certainly STATUE barred. I've never acknowledged the debt, certainly not in writing, and no payment have been made within the last 6 years. Should they be attempting to obtain a CCJ if they know this? or are they known for trying it anyway? My worry is that I might be missing something, surely the court would throw this straight out otherwise? Thanks for any advice, really appreciated.
