  1. congratulations, looks like halifax are starting to speed up a bit as some people here have been made to wait ages to acknowledge let alone pay up as quick as they have with yourself, i just hope mine is gonna be as quick, i only filled my moneyclaim wednesday early hours of the morning and they acknowledged yesterday - it isnt even deemed as served until tuesday lol so reading your post has given me great confidence that hopefully mine will be a quicker one

I know, its daylight robbery, just hopeing the banks are gonn lower there charges soon like the credit card companys, i know we can claim them back but we have to wait and with 2 kiddies to feed sometimes you need the money quicker lol good luck with all your claims, hopefully they will pay out straight away for our second time, they know we aint bluffing about the court action and as its smaller hopefully we will both get a chq shortley
  3. hiya i faxed mine then followed it up with a copy in the post, and then a phone call the day after - they had both lol, i fax will be ok as you would have an error message if it hadnt sent so know excuses can be made by them. if in doubt send aswell
  4. hiya, i only gave 7 days in my lba not the 14. because my letter said the matter was closed as far as first direct was concerend i went straight to moneyclaim. the 14 days is so u have given resonable time from the courts point of view no case has actually got to a court hearing yet. its up to you, some people like myself havent waited and we were paid in full just as we would have been if we had waited. its your call I personally think that if they have said the matter is closed i would not wait others may disagree with me,
  5. you should get your letter in the morning then ......about time to lol not long to go now:-) i think money claim are a bit behind at updating at the momemnt thou, i withdrew my claim when yesterday and it was still showing as acknowledged. today instead of saying cancelled etc it says defence filled 17/07/06 which is odd as i only logged my claim on the 16th july lol oh well
  6. Firstly CONGRATULATIONS!!! as DG work for first direct they actually use the same systems as FD and HSBC so they can access your accounts. So they would have checked the charges alredy or they would have disputed this so dont worry about not sending it. Secondly, i sent back my confirmation and they rec'd it last thursday, the money was in my account monday evening so as long as you sent yours back today you should have yours sat if your lucky if not mon/tuesday. so you only have about 5 days till payday ;-) You will rec'v a letter stating that the money will be in your account in the next day or so friday/sat aswell.
  7. RESULT just texted my mum and she has texted me her credit card details. so moneyclaim has bee filled Soon i will be able to buy a new kitchen and will take my kiddies to toys r us .....hubby may get a pressie too lol thanks for all your suggestions ;-)
  8. hiya i just logged my secound moneyclaim online and used the following if it helps it is a bit different to yours but did work for me you will just need to move a few words up when you pasted it into moneyclaim but i managed to make mine fit I have Account number *********with the defendant bank dated **** , which is conducted on their standard terms and conditions. I am claiming the return of money taken by the defendant in the way of charges over the last 6 years plus the interest they have levied on those charges. The bank's charges are a disproportionate penalty and therefore unenforceable as there contrary to common law. Further, as a disproportionate penalty there invalid under the Unfair (Contracts) Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999. Para.8 and sch.2 (1)(e). In the event that the charges are not a penalty then they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. Halifax have repeatedly declined to justify these charges. The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from **** to 01/08/2006 of £***** and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of £***

I sent my prelim via email and got an offer of £167, i declined this and then sent my LBA. this was sent on 16th july and i have heard nothing since so moneyclaim has been filled for £3503. will keep everyone posted. this is my secound claim as first direct have already paid out in full today after filling a moneyclaim just over 2 weeks ago im not to familier with how long halifax takes or there process they tend to go throough before paying out after they get the court papers so all words of wisdon will be very appreciated thanks

Money paid into my first direct account yesterday.............donation will be coming shortly the account is closed so they are sending me a chq apparently so it will be about 10 days till i get the funds cleared as halifax take 5 clear w/days and i have to rec've it survey has been completed donation will be coming shortly just filed my next moneyclaim for halifax...............and new lba has been sent by electronic mesage(thougt id try a new approach this time) to first direct. Olny for £130 this time so hopefully they will pay up quikley good luck to everyone and i will carry on posting about my second claim with FD

Payment went in my closed account last night, it will take 3 days to transfer in my normal halifax account. your 6 days behind me so in therory you shoud get your money on the 7th (is a sunday so maybe the 6th if your lucky of the 8th if they are dragging it out a bit) no matter what it should be in your account within the week, so it may be a couple of days into your holiday. i reackon you will get your full offer tommorow keep us posted ";-)

  15. hiya I took out a secont mortgage last year - ut was only for 7k to pay off a few debts and get ourselves on out feet again. The rate i got were crazy so we decided that we would pay the loan off and replace it with one with lower repayments. our settlement figure came through and it was 7171.78 - even more than we borrowed a year ago. they had added a legal fee of 120 quid and a load of interest up to 8th august 2006. i gather that i have been paying mainley just interest over the past year and not much has gone to repayment. Can i claim back anything i swear there is an early repayment penalty in that settlement figure somewhere. also this got paid on 12th july so in theroy cann i ask them to refund me the interest they have taken from me up to 8th august as it seems wrong to have to pay it when they had the money the month before. they have also put on the letter that the charge will be released 28 days after cleared suffcient funds. any help would be greatfull thanks:confused:
  16. hiya the full and final settlement was on all the charges that you listed so all the charges you had not listed you can claim for again. ive just been offered my settlement of 1400 ish from f/direct and then noticed that they applied charges after i filled moneyclaim of 204 so as soon as the credit is in my account i will be filling a new claim on these. So go for it you have nothing to lose (apart from your account if they close it)
  17. I got a letter today through saying themoney would be in my account in the next day or so, so from filling moneyclaim to completion has taken about 2 weeks, you should have payday before your holiday if mine is anything to go by !!!!
  18. Hiya - i recd the notice after i rec'd my offer . it came directly from the courts not from DG.
  19. they offered me full amount 2 days later I wroyte that i would accept that as partial settlement and continue my claim just as it would be deemed as resonable in court. You can always write that you decline there offer and will carry on your claim for the full amount - they will offer you full withing 2 days again so same T/A Its up to you but i dont think either way is quicker from the posts ive read
  20. i faxed mine to them and that was fine I just put the following Dear DG Thankyou for your offer of £****, i will accept this as a partial settlement but will carry on with my claim for the full amount. I actually phoned them this morning (first direct) and explained that they had not otified me of these charges and therefore i would like them back. i told the lady that i only had a statement two weeks ago and there were no details of charges on there. She then said that they dont have to put them on there if the account is closed ................this is how ridiculous they are im sure there is some law that states they have to notify me. Anyway she said that she would credit the account £74. not even half but better than nothing. im gonna call DG in a bit to explain that these charges have been added since the claim and could they also be erefunded. if not i will state i will do another moneyclaim. I actually put in my letter to mr kerr that i wanted all future charge not yet applied to be taken off. so if they wont refund he has already had notification of sort that i dont want to pay these so i will ddaft a letter giving him 7 days to pay these back- if he dont i will moneyclaim straight away. im not going through the 28 days again lol
  22. helppppppp i just checked my online banking (my accounts closed so i rarely bother and i have just noticed that an extra £202 in charges were added last week - even thou they reckon there charges stop at £149 even if you go over. my account has been closed for a month and my most recent statement did not show these on there. Do you think i should ring debbie a'abney at DG and say that i want them added on to my settlement or we i have to claim seperatley now...........what a nightmare!!!! I have already agreed that my overdraft be settled with the proceeds. i know i am able to say i dont want this and demand that they pay direct to me but to be honest i want rid of the debt before it goes to a debt recovery agenency cause at the moment it aint affectiing my creadit file.

Hiya sorry if i confused matters Moneyclaim is filling a claim at the court which gives the bank 28 days to either defend in full or settle basically By me saying they settle out of court i meant that they have not as yet let it go past the 28 days when a court date would be set and you would have to go to court yourself and give evidence as such and they would have to defend your claim. No case has got to actually going to court on the day hope this makes sence
