  1. So, 40 calendar days from the 20/05/2013 as the letters have been signed for? I'd be very interested to hear from anyone at CAG to check the legality of checking my background and/or finances before issuing a writ, especially without any permission or consent to do so from myself.
  2. 2 letters were sent on 17/05/2013 -Tracking numbers are KF019362465GB & KF019362457GB. Both signed for by Tim. I suggest you look into that with urgency as I've said, failure for you to comply WILL result in court action. I do note that the £10.00 Postal Order for the SAR hasn't been cashed as of yet. You've looked into my finances without my permission? I'm sure that is wrong Cliff, especially without my permission. What gives you the right to look into my background and anyway, with very little information you have on me? Anyway, you wouldn't win any case as NO libellous comments have been made by me or any member of my family. I have had the posts checked and if there was anything libellous on this thread, then I'm pretty sure the admins would be extremely quick to let me know. Same applies to MSE forums as well Cliff. With regards to Facebook, I think you'll find and agree that no libellous comments were made by me. Maybe my friends, but I'm not responsible for anything they post via social media. Anyway, enough chat with you Cliff, you're beginning to bore me and annoy me, just get the refund sorted and then we can put an end to this sorry story.
  3. Apologies ims21 I am indeed infuriated with him & his company. I'm also infuriated that he's making me out to be a liar. I am going to check now if payment was cashed and if it was then indeed I will have NO hesitation in seeing this go to court.
  4. I have proof with a tracking number that a SAR was sent to your companies address! It was sent recorded delivery so as it's been signed for I'm accepting that as being received. I also was told by 2 of your customer service agents that a refund would be issued. So you seem to be living on cloud 9 Mr Stanford, not me. As for libelling your company, I'd love to know where you get that from. I am stating FACTS and what I have been told by people that work for your company. I was told that a refund was authorised on 15th May & would take 14 days to arrive to my in Laws house. I suggest you get your advisors to actually tell the truth and not fob people off with conflicting stories. As you have said in other posts/threads, there clearly needs to be some training issues resolved at your company. I suggest you find that SAR that has been signed for, otherwise it's off to the ICO with a complaint Mr Stanford. I suggest it's you living in a dream world. Oh & I'm still waiting on your fictitious lawyer serving me with a writ. The fact of the matter is that you got caught [EDIT] elderly & vulnerable people out of £990 and you don't like it Cliff! Find the SAR as it was sent and stop making me out to be a liar and making libellous comments on forums. That must be your favourite word Cliff!!!! See you come across as being nice as pie & willing to help on other posts/threads, but in fact it's the exact opposite with you Cliff.
  5. -Update- Well that's 2 dates that have expired with Ifonics telling me that a full refund has been sent out via cheque. I think it's time to pursue this with the MoJ & I'm going to contact my local MP & MSP. My in Laws are making themselves very poorly with worry and are also into a sizeable chunk of their overdraft. I cannot allow these people to get away with this and I cannot allow them to contribute to the stress, worry & panic that my in Laws are going through, after the disappointment of twice being promised a refund via cheque and twice being let down.

  8. Just to double check, I can leave the SAR unsigned as long as it has my father in laws name, address, d/o/b & reference number to identify or distinguish him? Shame Cliff isn't about, I'd love to know the name of his data controller. I tried calling, but they closed at 3:15pm
  9. SAR constructed, printed off & ready to be sent by recorded delivery. Also, sending a letter of authorisation allowing me to deal with matters. With regards to the OP that's been edited, this hasn't been done by me. In terms of Cliff wanting to send me a service of writ for defamation, then he's free to do what he wants to me. As long as he & his company leave my in laws alone, then I'm a happy chappy.
  10. Well I'm pretty sure that a Subject Access Request will cover recordings of calls. I'm fairly sure that you're obliged to give me a copy of the recording and not a transcript. If Ifonics have got copies of the reocrdings then I am are entitled under the Data Protection Act to be provided with them and this covers recorded information in any format (including written, computer or even recorded). Are you calls recorded on drives or DVD's Cliff?

  12. Oh dear Cliff, a bit touchy are we? I haven't defamed your company or yourself, regardless of what you think. I can call on a number of people that were party to this and will happily back me up in any court of law. I merely pointed out that your company had apparently taken money wrongly from my vulnerable in laws. Also, you won't be dealing with them directly, you'll be dealing with me. As of tomorrow I will be given authority to deal with this on their behalf. Finally, it shouldn't of been charged as it's against the guidelines as set by your beloved Ministry of Justice.
  13. Just as a thank you I have made a small donation to the site. I would of donated more, but it's all I can afford at the moment. I forgot to include my username though as I didn't see that option until I clicked submit when paying.   14. Already sent an email to Watchdog as well as making other people aware of this situation. @Cliff: I turst this will be a full refund? As really it shouldn't of been taken in the first place. Also going forward Cliff, I would like to ask that you make sure that people are of sound mind before pursuing with any claim. Your company needs to change it practices. I was also very serious in sending an invoice, as mentioned in my email yesterday, this is for my time, use of phone, laptop and electricity etc.. Finally, Cliff I will be submitting a full complaint to the ICO as pointed out earlier. All this could of been avoided had you of dealt with me in a proper manner in the first place.   15. It was £990 as it's £99.00 per agreement which totalled 10 agreements. They were pursuing people that my father in law had previously had no business with what so ever. People like M&S & Tesco at no point has my father in law had any credit cards or loans from either of these companies.
  16. Yep, which makes me think that Cerys-Angharad Ltd. trading as Ifonic Claims have committed Advance Fee Fraud. As regards to the T's & C's, I'll re-scan them and upload them again.

Taken from my original post: I am also in the process of acquiring the bank statement which shows the actual payment being taken from my in laws bank account and I will attach that either later on today or tomorrow.

  20. Cliff, are you going to follow me from Facebook to various other forums to try and put a spin on the actual fact that you have spoofed money from an elderly & vulnerable person? I am more than happy to post scans of all the documentation that this so called professional claims management company has sent. I will scan them using my Android mobile & upload/attach them here. I will be careful to blank out sensitive information. I have nothing to hide unlike Cliff. I would also respectfully ask the admin of this board to remove my name [EDIT] from the above post by Cliff. Also Cliff, the fact that you claim I have made defamatory comments about you & your company are completely untrue. The emails I have posted and the comments I have made on social media are just echoing comments made by other people that have had the pleasure of dealing with your sham of a company. Also, given your background & criminal record, it doesn't surprise me that you thrive off preying on the elderly & vulnerable. Now you're trying to come across as nice as pie to other members of this forum and other forums. If you want to come across as nice as pie then simply honour the request to have the money refunded without delay. Also, change your companies practice by not charging an Advance Fee. I have tried to reason with you both via email & social media and you have ignored my attempts to settle this as quickly & amicably as possible. Trying to follow me from forum to forum to spout, what I deem are lies and make me out to be a bad guy, is just not cricket. I have contacted Action Fraud and I am more than happy to let them deal with this. However, to save you hassle Cliff, I contacted you, as stated above, to try and settle this without the need for police getting involved and without the need for a service of writ being sent to my in laws address, thus putting them under more strain & worry that they have already been put through by the dealings with your company. Finally Cliff, I'd love to know exactly how I have threatened you? Not once during our chats via email or Facebook have I made a direct threat to you. Your comment above is just untrue.
  21. Hi dx100uk thanks for your reply. As far as I'm aware my mother in law has already gone down this route, as she had called her local branch (RBS) and their Fraud team are looking into it. Unfortunately though, the lady who has been dealing with my mother in law is away on annual leave so this is dragging it's heals a little bit and still causing some upset & distress to both my in laws. Other than what I personally have already done, is there anything else that really needs to be done. Is this a case of Advance Fee Fraud (open to opinion)? How likely is it that the in laws will get their cash back? I note from their T's&C's: (1) Anyone, after signing up for our service, may cancel that service at any time. (2) If a customer cancels within 14 days of signing the agreement, he will receive a full refund, regardless of whatever work we have carried out. (3) If a customer cancels after the 14 days, we are entitled to charge for work carried out. (4) We are required to make any refund as soon as practicable and in any case within 30 days. Our average is around 14 days. (5) We are regulated by the Ministry of Justice under registration number CRM24389; we are regularly inspected and the MoJ is aware of and has approved our terms of business.
  22. Hi, I really need some advice on how to deal with this bunch of clowns, Ifonic Claims Ltd in Swansea. On Wednesday 10th April 2013 my father in law received and unsolicited telephone call from Ifonic Claims. A few days later a set of documents arrived, dated 11th April 2013. Once I had looked at these forms I then realised that my 86 year old father in law had been a victim of what I deem to be Advance Fee Fraud. My father in law has never had a credit card or loan with Tesco or Marks & Spencer. Neither has he an active mortgage with RBS (Royal Bank of Scotland) or anyone other financial institution. Finally, the shock of seeing a £990 debit from his account (taken by Debit Card) when he has neither agreed or has any need to use their services is beyond belief. The documents contain the following: Welcome letter & T's&C's x2 - Letter of Engagement - Allowing Ifonics to deal with this claim, which is unsigned Client Information - Containing very basic details about my father in law (address, telephone number etc) x11 - Letter of Authority - Giving authority for Ifonics to act & reclaim PPI on my father in laws behalf, also unsigned x11 - PPI Questionnaire No documentation has been signed and returned, fortunately I got wind of this before it went further. Nor has my father in law signed anything previously. However, I assume that he has given them his Debit Card number for the £990 transaction to be taken and whilst I didn't listen to the actual conversation, one can only assume that he was duped into giving it. Furthermore, my mother in law has tried without fail to deal with this as my father in law is 86 years old, deaf & suffers from dementia. Every time she tries to contact them to deal with this, she is rebuffed. Also, the staff have been very cheeky with her, which has caused her distress which she doesn't need at her age. I have tried to contact the company directly and have been stonewalled, especially as I have no authority from my in laws to deal with this. I've been threatened by a company director with a defamation writ. I have in the meantime contacted and filed a report with Action Fraud & also submitted a complaint with the Claims Management Regulator, which governs this set of parasites. Furthermore looking into the Ministry of Justices own guidelines for companies like these and it seems Ifonic Claims have broken their guidelines that companies should not charge an advance fee for services. Ifonic Claims is also trading name of Cerys-Angharad Limited both based in Swansea. Thanks in advance. (Apologies if this is posted in the incorrect forum. As Ifonics mainly deal with PPI, I thought it best to start a thread here)

  24. Aye, that's why I thought I'd ask and not only that the amount of interest that's been added to the outstanding amount is shocking. I'm not surprised really, but that does seem way to high and a bit illegal imo. Cheers for the help so far renegadeimp, what I'll do is wait for the CCA's to come back and then post them here when I have them for further advice. At least for now the calls have stopped (so far). Every letter, email & response I have received has been scanned, kept, uploaded to dropbox/skydrive/photobucket so I'm keeping a full paper trail.
