If the account is still open, you cannot refuse a goodwill payment into the account. Its a bit like doing your shopping at Matalan with your credit card. You go back and ask for a refund and they refund you not by cash but only back onto credit card. You don't have much choice, although you can always ask.

Yea, will phone, I am just taking a risk on the prelim letter because I have heard rumours of the banks payin up after second claim immediately to end the dispute yea.

I am not on about adding it to this claim. I am on about starting another claim against them while this one is still on. And yes, another 2 weeks will harm me because I plan to leave the country.

Nattie, my bank has made £120 worth more of charges since I issued my claim. Tommorow they are being issued with the judgment by default notice for my original claim. What do I do? Do I have to wait for this case to be finished before claiming the other £120 or can I send them a preliminary letter right now? Thanks Nattie

Glenn, the difference would be two weeks with a 14 day approach. Some people may not have the time and want to resolve it quicker. Now what I am saying is that I have been told by my solicitor that with a bank charges case, the claimant would not be struck out for insufficient notice being 14 days.

So if you don't have proof of postage for your letters, you have no chance?

Janet, with respect, all I was offering was informed advice based on two people close to me that had success without any initial letters. Having seeked legal advice myself from my solicitor, he said that in the case of bank charges, the court would not strike out a case for only offering 14 days notice. This is because the courts are very aware of the banks tactics. This is why I went down the 14 day route.

Isn't the CAG about people coming together to offer their advice? I am giving advice based on my experience and I make that quite clear. Is this not allowed? If not, I won't offer it.

rbrears is right. The protocol is never followed precisely. 14 days is plenty of time to notify your bank of your intentions. The judge would understand that to a poor person, 14 days is loads of time to offer a major company that has unlawfully applied charges. I also have an aunt and a friend of mine who took their bank's straight to court without a letter and both won unconditonally. That is the reason I was going to bring it up in the first place. Me? To be on the safe side, I have given my bank 14 days. 28 days? OK.. if you want to wait that long.. If you don't have the time, just slip a 14 day LBA and get on with it.
