  1. sent Lowell group an e-mail this morning saying received their letter however will not be acting on this due to 1) the statement proves nothing as dated 15th Feb 2013 with no mention of Welcome on the paper (payments made did tie up to my bank) 2) no supporting documentation proving that this was as agreed and signed by myself 3) complaint with Welcome outstanding 4) complaint with Financial ombudsman outstanding 5) SAR request outstanding

UPDATE - I received a letter from Lowell with a copy of Statement attached which showed that the £3071 was outstanding and a sentence stating "Welcome state the vehicle was voluntary terminated and you had a liability of £2942.36 balance which you were aware of, plus any interest and charges for non-payment" There was no supporting documents as evidence that I "knew" about this or any reason why this is. I have filed complaints with Welcome directly and Financial ombudsman but no response as yet (both submitted 30th Jan)
  4. Totally understood. They kept calling mobile and house phone, unfortunately my missus picked up the house phone and passed it to me. Told them I would not be paying any money nor discussing any further until my complaint with Welcome is satisfied
  5. I spoke to the DCA (Lowell Group) who advised they too have requested copies of all paperwork. I have also logged a complaint with Financial Ombudsman requesting them to investigate

Was searching through paperwork at the weekend and found vehicle collection paperwork from Welcome Finance and noticed that the account number does not match up with the account number they have specified in relationship to the outstanding arrears. The plot now thickens as the two account numbers provided which has been used to determine the PPI refund were for personal loans dating back to 2003 and 2004 AND NOT for the Car Lease.

  8. Will have to request as have changed banks since this was from 8 years ago when I closed it
  9. Welcome accounts do not show on my credit file MBNA shows on my file however account number shows as xxxx- xxxx and MBNA claim they cant find my account on their system I destroyed documents when I moved 4 years ago

The CMC advised that the offer lined up with their calculations I have requested all written document as you advised The welcome account (s) do not show ony credit file and only other is mbna however have no old documentation and credit file blanks the account number so they are claiming they cant find my account on system
  11. sorry should have added the other account was for a loan couple years before which was paid in full. During calls with Welcome they did confirm this. The offset is only against one account
  12. Also, I forgot to mention that the total offer was made from 2 seperate accounts (loans) I had from Welcome. Would this change anything?
  13. I have filled in the FOS complaint form and will send by recorded delivery tomorrow Where would I stand on Welcome statement that I only have 30 days to accept the offer?
  14. Do I need to request this review in writing to FOS or can it be made by phonecall?
  15. That is correct. The 'debt' was sold to Lowell Group as of 29/08/2012. I told FO this was the case and still had the response that they are able to Welcome response was they have lost money therefore this is set-off to re-claim the money they have lost
  16. I have just spoken to Financial Ombudsman who have advised me that Welcome ARE able to offset the PPI refund against arrears owned on the account Request for SAR was sent yesterday 29th
  17. Back to the offset of PPI, the lady at Welcome now advising that she is not familiar with FSA rulings and tthat is Welcome final offer. Therefore I will need to complain to Financial Ombudsman
  18. Thank you. PPI and GAP remained which is where this £3071 comes from. GAP repayments only worked out at approx £15/month and car was returned 4 years ago so don't understand how they have come to that figure??? How can I word the request to compliance department for full breakdown and Investigation as to what has occurred?

With regards to the outstanding balance - I am now informed that this is for Liability insurance and I have to make a formal complaint to the compliance dept. @ Welcome Finance who can look into why there is an outstanding balance as apparently a letter of Liability was issued????? and they can make a suggestion on how to proceed. Any suggestions on how to word this e-mail?
  20. I phoned to check that they received the written request as above and advised that their is a law that allows them to offset against outstanding arrears on account which is covered in FSA Full handbook under Compensation 4.4?
  21. I am on the phone to Welcome who have advised that their is a law under FSA site / Full Handbok / under COMP 4.4

Dear Sir / Madam Further to my e-mail below please note the following: Please ensure all further communication is made direct to myself as I do not wish to pursue with Claim Company as stated in separate e-mail today Whilst I agree to the Offer of refunded PPI Payments, I do not accept that that this payment be made as offset to any third company as there is no provision in Law for any such arrangement. All Monies to be returned are requested to be paid direct to myself Please provide me with a full breakdown of any such outstanding balance showing WFS Justification of this and detailed structure including payments received from myself. Justification should also include why this notification of outstanding balance has only occurred 4 years on and not at time of completion of Car Lease I look forward to your prompt response

I was advised I can only lodge complaints to head office and not customer service at Welcome so have typed out an e-mail to that effect and sent reuqesting when the debt was assigned, breakdown of payments and justification on outstanding balance and confirmation I have stopped the CMC company. On Welcome offer letter it states I only have 30 days to respond back with signed agreement. What should I do here?
  25. I have formally instructed the CMC firm to cancel my application in writing this morning giving the reason that to safe-guard my credit rating as a priority, I need to seek further advise to resolve the 'outstanding balance' before I continue with any PPI Claim
