  1. I've been racking my brains trying to understand both how they worked out the agreement and the commission payments. On the right hand side of the commissions sheet, what is the 'Retention' figure of £720 and the 'Sold Car SIV'? I also can't understand what the 'Finance charges' consist of on the main invoice. No wonder we were fleeced blind. I can't understand it now, understood it even less back then :/
  2. I was looking into the whole thing of 'secret commissions' with regards to Yes Car Credit. In this case who would be the broker??
  3. It's making me nervous just looking at the costs of bringing a court claim. Don't know where we are going to find it from and can't afford to lose it...gulp!
  4. So do I stand a good chance of winning this? I've heard of a few others where they have settled out of court, but it makes me nervous to think that we might have to go to court to defend this! It's in my husbands name so it will be down to him if it gets that far.
  5. No not yet. How should I word the letter before action and should I send it to Godwin Street? I've seen enough evidence from other posters to know that they do deal with Yes Car Credit even if the lady yesterday told me they don't. It would be great if you could post up a rough particulars of claim. Thank you.
  6. Oh yes, I was only going to go for the PPI/warranties and the interest. It works out about £5500 at the moment. What should I use as my particulars of claim? I've seen so many different things when I've been searching, but none of the threads that I've read have any particular conclusion them!
  7. Is that because of the commissions and the deposit off the insurance? Can I still use that as a basis for claim if the agreement was paid in full and never in arrears? What about the fact that they made us take the insurances, do I not have to base the claim on that, or can I use all of it? When I was looking at which part of the CCA I needed to claim under I wasn't sure which to use, misrepresentation (I think) or unfair relationship?

  12. Thank you. I'm actually surprised they sent the commissions sheet. They took the deposit from the insurance too. Do they make you sign a confidentiality clause if you win, I haven't seen many people posting that they've won against them in court? I won a case a couple of years ago against a computer company and when I settled out of court I had to sign one.
  13. I definitely didn't have a statement of means. This was my husbands car so is in his name. It only has where he worked, nothing else. They told us we had to have it or no car, so I don't suppose they really cared about that.
  14. Thanks squaddie. I'll be around for most of the evening, just out for a while between 7.45 and 9.15 but I'll keep checking this thread when I am around. I have the full SAR with many pages on my computer (I'm on the iPad right now) but posted the stuff that looked more important. It all came on cd.
  15. Info is attached on page 1 of this thread and includes the agreement and commissions sheet. There are no broker details or underwriting sheets from what I remember. What is a statement of means and price? I just googled the directions for the PO box address to Godwin Street and they are only a mile apart. Probably a way of keeping the YCC stuff separate and someone from Godwin Street picks it up!
  16. Sorry I already have my SAR info. It was my claim that I sent off. It was sent on February 4th so they've had 10 weeks now to reply. Should I send something to both those addresses now or just Godwin Street as others have? How long should I give them? I thought 14 days would be more than enough?
  17. She said they don't have any telephone details at all, only the address. I've googled provident and I know others have sent SAR requests to Godwin Street and got things back.
  18. It also makes it harder when claiming through the court as you can't use a PO box address can you?
  19. Right. Spoke to a very bemused sounding lady who told me the address to write to was the PO box one. When I asked her was she based at Godwin Street she said yes. I told her I also had that address to send my information to so she went to speak to a team leader. When she came back she said that if I was to write to the address at Godwin Street they would only write back telling me the correct address, which was the PO box. Angie
  20. This address was also on the letterhead of the SAR information when I received it.
  21. It was sent to PO Box 1135, Bradford BD1 9PY and included a return address. This was where I sent the SAR request to and that also didn't show as signed for but I received that in just over the required 40 days.
