  3. Allo again Buck, iam going to have to give my credit file some attention too. You state that you got an email from equifax, what service are you using ? and is it a service i can access online to check my credit file. Hope you can help. P.S My case against BM is ongoing. gone to court
  4. thats a yes to all three, please note on your statements there will be references to assess fees and capital fees.. you only claim for assess, the cap fees and merely duplicate of the assess fees hope this helps
  5. Huh ! typical !!!! heard from court today. it would seem that the BM have managed to submit their AQ after all. 24 hrs late.it seems the court allowed it after BM whinged their post was still recovering from xmas
  6. iam dealin with Bristol and west myself.see my thread. Be warned tho mate, they will stall for time. address your SAR to Ms Bawdon. And be careful she WILL write back to if you send a postal order stating that it is not accepatable (although the information office confirms that it should not be a problem) So might be worth sending £10 cheque instead to prevent them frustrating the procedure.   8. Allo Dolly yes i did ring the girl told me that she would get back to me first thing tomorrow but from what she could gather from the case manager, their AQ dosent appear to have been submitted. il wait til tomorrow before gettin carried away...lol
  9. Folks i have today received data including statements from the illustrious Ms Bawdon of Bristol and Wests Data Team. Must admit the lady had worked quick to provide the material. However as my morgage account with them went back to 2004. She has only included material from 1999 onwards. She has however stated in her attached letter the following 'There is also a delay with the issuing of producing duplicate annual morgage statements from before 1999, This is due to a change in banking systems and information being archived. Again this informaion will be sent as soon as received'. Now from the information i have to hand at the moment ie....1999 til close of account 2003, there is a couple of grand in charges. The bulk are pre 1999.( Not touchin erc at this stage). Can i still submit a claim for the period 1999 til 2003(the data i have to hand at the mo) or should i wait for the pre 1999 stuff (have to admit tho i know it will exceed £5000 poss fast track) what do you folks think.Zoot if your out there id appreciate your take on this situation

  11. uk iam not sure of the actual implications regarding fasttrack..forgive my ignorance. Have you been given your court date yet ? if so i may very well pop down on the day to cheer you on. After all there would be much for me to learn on the day. These buggers are now drawing a line in the sand methinks !

  15. Blimey they havent even offered me half of my claim, maybe i sould establish phone contact with their legal rep. Mind you some weeks ago i did recieve a telephone call from someone alleging to be their legal rep telling me to back off as the 'bm would not budge on any issues' i actually mentioned this earlier in my thread

  17. have sent letter to bristol and west threatening to take legal action if they dont disclose Data as requested. you would think they had learned from alanfromderbys case wouldnt you?
  18. when i was at court today Dolly, the case manager confirmed that BM had not submited their AQ. Theyve got til the 3rd to do so.

Must admit im surprised the Midshires have suggested a switch of courts to Liverpool (my home court) hope these buggers arnt plannin on turning up on the day and defending..lol. Anyway what happens next ? does the judge set a court date ?

Allo UK, what did you put in section G of your AQ (general information) i merely asked for small claims track and pointed out lack of ability to justify costs. requested standard disclosure and enclosed a copy of this. What do you think xxx - Claimant and Birmingham Midshires - Defendant Draft Order for Directions The Claimant shall within 14 days of service of this order send to the Defendant and to the Court: a) A schedule setting out each charge repayment of which is sought, showing the date, amount, and reason given (if any) for that charge being made; b) Copies of any statement or other document relied upon as showing that each and every charge has been made; c) A statement of evidence of all matters relied upon as tending to show that the charges are irrecoverable as penalties or otherwise; d) Copies of decided cases and other legal materials to be relied upon. If the Claimant fails to comply with this order, the claim will be struck out without further order. 2. The Defendant shall within 14 days thereafter file and serve a response to the Claimant's schedule, stating in respect of each item claimed; a) Pursuant to what contractual provision such charge was made, producing a copy of the contractual document relied upon; b) Whether such charge is accepted to be a penalty, and if not why not; c) If such charge is alleged to be a pre-estimate of the Defendant's loss incurred by the Claimant's actions (whether or not such action is treated as a breach of contract between the parties), all facts and matters intended to be relied upon as showing that such was a proper estimate of such loss, and all evidence to be adduced at trial as to what the true cost of dealing with the matter was; d) If such charge is not alleged to be a pre-estimate of the Defendant's loss incurred by the Claimant's actions then facts and matters intended to be relied upon showing the basis upon which the charge was calculated and all evidence to be adduced at trial as to show that the charge was fair and reasonable. e) Any witness statements. f) Copies of decided cases and other legal materials to be relied upon. If the Defendant fails to comply with this order, the Defence will be struck out without further order. apparantly its designed to put the heat up em.!!

  24. folks ive got to get my AQ bsck to Liverpool Court by the 3/01/2007.Being a cop i had to work all over xmas so havent really had time to look at it closley. IM concerned about two parts of it. 1. i take it you enter nothing in the expert witness section 2. what if anything do you put in the other information space. Also do you send any of your letters/correspondence with the AQ
