  5. six months later they have sent cca not signed just name printed on there statements etc but the cca shows that the ppi box was not ticked, and the statments show they were charging ppi, thats when all the problems started as they wouldn't refund it does the claiment have to prove the full amount is owed?? cheers

  7. nope never just the aos, they have never put it to the default stage,as they stated they would hold proccedings, i have asked them 3 times if i need to enter a defence and they have always avoided the subject. cheers
  8. sorry missed that bit by an agreement between capital one and the defendant on or around 15/07/2010 capital one agreed to issue the defendant with a credit card. the defendant failed to make the minimum payments due and the agreement was terminated. the agreement was as signed to the claimant, the claiment therefore claims 716.37

Hi folks hope you are able to help stupidly i took out a pdl with wonga in 2011 for £607 plus interest =£787 was due to be paid on 19th jan 2012, various things happened eg loosing job etc, my own fault i failed to contact them. Now this week end what drops through the door CCJ claim form for £1560.53 claiment portfolio recovery associates docs address hl solicitors i know i will have to pay it back but my question is on the claim form they state they got assigned the debt on 18/09/2013 the claiment seeks interest pursuant to 69 of the county courts act 1984 at the rate of 8% per annum from the date of issue continuing at the daily rate of 0.31 what would the interest total on it and would the court cancel the interst??? thanks in advance im stupid i know
  11. hi thanks for the quick reply last we heard he had his own shop but that was 10 years ago the bank wont tell us if they have contacted him as they say its not our bussiness and they will chase who ever pays them i must add the morgage and the house was in scotland, me and the wife now live in england and her ex still lives in scotland can we still claim off of him as the whole debt has not been settled

Hi folks im after a bit of help back in 2001 i met my new wife and she had already left her ex husband which they had a joint morgage together, when they split he was taking over the payments and the house in 2002 we found out that he had not been paying the morgage and the house had been taken back by the bank total of £12000 short fall, so i in my wisdom decided to pay the short fall via instalments as her father stood garantor on the morgage( he is disabled) i have to date paid a total of £7500 of of the short fall and her ex husband has not paid a penny, i have now refused to pay any more untill they chase her ex for the rest of the balance (which they have never done) they now state unless we continue with they payment they will chase my wife and her farther for the balance owed.... if i continue paing the full amount off can i personally claim half of what i have paid off of her ex and can they still claim off of the garantor for they balance as they have not contaced him for 10 years also my wife is unemployed so can they chase her or not cheers for your help in advance
