  1. Hi, Currently having an issue with Birmingham Midshire (Halifax/RBOS). House was repossessed (mortgaged for £100,000), was then sold at auction with a shortfall of £49,000 (house was valued at £110,000). While the house was up for sale we were offered £85,000 (which would have meant a shortfall of £15,000 but was told that if we accepted the offer we would have had to pay the shortfall within 3 years). CAB got involved but went quiet, but have since received a letter from 'Henderson Booth & Snell' chasing the shortfall with an income and expenditure form. We have also learned that the Estate Agent that Birmingham Midshire had appointed to sell our house were telling possible clients that the house was coming up for Repossession and to wait for the auction. What do we do? My wife and son are currently (for the last 5 weeks - with ongoing issues from last October 2011) in Alder Hey. And do not wish to put any pressure on my wife at this time. To cut a long story short, our son was born with Cerebral Palsy (Quadriplegia). Had issues with the then current employer (had to spend 4 weeks in hospital and all the time was being asked when I was going to return to work). Went self employed was not earning enough to cover the mortgage. In the meantime the house was deemed unsuitable for what our sons needs (access/modifications). Council had given us a property that could be adapted etc. Could not afford both rent and a mortgage. So after trying to sell the house ourselves BM repossessed the property and put the house on the market. Regards, Mark
