Well I got my SAR info back from the Think Money Group, and it does indeed state on the customer notes for think banking the following: > account switch for LLOYDS - details passed to N Harrison > OB to cli re Acct Switch - Left VM on Mobile and Sent SMS. Diary in place for MM. > Administration - Diary-Account Amendment > Ob re account switch recieved tried mobile number on the account and left VM. and sent sms. > called > Dormant Account SMS sent. > account switch for LLOYDS - details passed to N Harrison > Ob to advise account switch rec for lloyds - left vm and sent sms - diary set for mm - AUTHORISED > Dormant Account SMS sent. > Dormant Account SMS sent. > Dormant Account SMS sent. > Administration - Diary-Account Amendment > Ob re diary on the account re account switch authorised tried mobile number on the account for client. left Vm and sent sms. > Administration - Diary-Account Amendment > diary- re account switch recieved and retention client tried mobile number, advised that gavin no longer works there and the mobile is a company mobile phone removed the number and sent unable to contact letter. > Administration - Diary-Account Amendment > removed diary due to contacted already. > RTS - letter dated 25 Sept 2011 returned, address same on account, no correspondence marker set on account. No sms sent as no mobile number. Therefore they did indeed receive the account switch info at the end of August, however they decided not to perform the account switch, and to just try and call me over and over again to try and retain me as a customer. This is the reason why payments were not made to my creditors....
  2. Thanks for that. Did HFC by law have to send a letter before action? Or can they just go ahead an submit a claim to the court?
  3. What is the different of pre issue and post issue? Sorry I am not very good with these sort of things? I missed a few payments back in 2010, HFC apparently sent a default notice which I never received, they have now emailed me a copy of it, and they then issued me with a CCJ, in which I received no paperwork from either. I was just wondering if HFC should of sent me a letter after the default notice to state that they were going to issue a CCJ?
  4. What would this document be called please so that I can request a copy of it as I never received such a thing? I never received a default notice from them, but when I requested a copy of it they emailed it to me. However it doesn't mention that they are going to take me to court. Thanks for your help
  5. Hey guys, just a quickie: Before the court send me the notification of judgement, are HFC not supposed to notify me that a CCJ is going to be served upon me in order to allow me a certain time frame to resolve the account?

I requested compensation from them for firstly issuing me with a default by their error which was on my file for 2 years, and secondly for very poor customer service, however they are not willing to give me anything. There is also 2 late payment marks on my credit file from them for august 2010 and September 2010 in which the account should of been closed in August 2010 as this is when I spoke with a team leader via email and he confirmed that the account was now closed and any outstanding balance removed. I have asked Virgin to remove them however they haven't done so as they state it is a true reflection of my account...

Can anyone provide advice as to how I can challenge this judgment, as I don't see how I should be made to pay an amount of money made up by my ex, when I cant even see a statement of the credit card as the bank will not even allow me to see it as the credit card is not mine. I don't even have a clue what she has been using the credit card for.... Also can someone give me advice as to how I go about complaining about the court service, for them not providing me with a date/time of the hearing so that I could provide evidence to at least make travel arrangement from Dubai to be present? And help is much appreciated.
  10. Thanks for all your help! I am currently awaiting a response from the court manager in regards to the judgement because I never received a date/time for the hearing from the court. They sent it to the address in which the claimant provided them with in the UK. Even though I put on my allocation questionnaire that I am in Dubai and for them to email me the date.time of the hearing. Just a quick one how do you go about challenging a judgement please?
  11. My name wasn't removed from the mortgage 3 years ago.... It was only 6 months ago.... The reason I want to claim this back is becuase she has taken me to a small claims court after being separated for 3 years claiming that because I was an additional card holder on her credit card I should pay half of the remaining balance, and she won the judgement! I couldn't believe it! I live in Dubai so I wasn't able to go to court to defend myself in court. Therefore I want to be able to claim back money that I put in the house that she has kept.... If you guys reckon there is no chance I wont bother, but I cant afford to give her £1800 for HER credit card, so I would like to get my deposit back from the house.
  12. Thank you so much for your advice. I have checked the land registry title and my name is not on it, only hers. So do you think I should pay to speak with a solicitor in regards to it then to see if I have any chance of submitting a claim? Thanks again for your help.
  13. My name is no longer on the mortgage as I had it removed a few months ago as I wanted to cut all ties with her. I no longer pay anything for the house, and i havnt lived there for nearly three years. I just want the deposit that i paid for the house back seen as though the house is all hers now and in her name. Is this possible? Can I claim for my deposit back even though I have already taken my name off the mortgage?

  15. Hi guys, Just a quick question. I bought a house with my ex partner a few years ago, and a few months ago I had my name removed from the mortgage as we split up. I did not receive a penny of the money that I had put into the house back from my ex. I am wondering if I can request for my share of the deposit on the house back now, even though my name has already been removed from the mortgage? Could I take this to a small claims court, if my ex refuses? What would the chances of me winning be? Any advice/help appreciated.

  17. I called Nationwide already and they have confirmed that my name is no longer on the mortgage. It was all done through her solicitors I signed a form and returned it and my name was removed. I would of kept to my part of the deal if she had agreed to it when I proposed it to her over a year ago, however she ignored my proposal, and a year later decided she wanted to go ahead with it. I have had to rent properties with my wife because of this. The credit card is hers therefore I feel that it is her responsibility. I have given her the house, and not asked for 1 penny of the money I have put into it. I am in a bit of a dilemma now, i have been trying to call the courts, and email them countless times over the last few weeks to find out when the hearing is and what I need to do with me being in Dubai. They never answer the phone and I am always on hold for 30-45 mins costing me a fortune from Dubai. They don't reply to email either. I found a email address of a customer service manager within the courts on the internet on Friday, so I emailed her and she said she had passed my email on the the Judges Section and they would get back to me with help. Nobody got back to me, so I email the same lady again yesterday to state that nobody had got back to me. Finally a lady emailed me stating that apparently the court hearing was yesterday at 10am, and that I now owe the claimant £1800 plus 245 court fees! I am so angry, the courts never provided me with the hearing date or time, on the allocation questionnaire which I sent back to them it stated that I now live in Dubai and for any correspondence to be sent to my email address. I emailed back stating how angry i was that i was unable to be present or give my evidence, and the women said if i am not happy i have to submit a n244 form and 80 pounds.... I asked where the letter was sent to and they stated to the address which is on file, which is the address in which the claimant provided the court with! I find this absurd, can anyone help with this? Please....

  19. Hello again, I received the SAR back from Virgin Media, but it doesn't show any transaction history, it just shows notes that employees have put on the account. Is this correct? I asked for: please supply me with copies of all the data in which you hold on me in relation to any matter and in any form and for any period of time. Please note that I require disclosure of any personal data which you hold on me for the entire period of my dealings with you. The Subject Access is not limited to my transaction history and it is not limited merely to 6 years of historical information. Additionally, where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my banking business with you. If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response.

  21. Thank you so much. Yes the court papers were sent to my mothers address as I now live in Dubai in which she notified me. Therefore I emailed the court to advise them that I live in Dubai, in which I got a response stating that I need to download the allocation questionnaire of the courts website and fill it in, and email it back to the court. I did this, and then my mother received another letter with the court hearing date etc which is in 9 days time. Basically when we lived together she had a credit card with Halifax in her name. She added me as an additional card holder so that I could also use the credit card. The credit card from what I can remember was used to purchase furniture for the house, and a holiday. This was in 2008. I did in the past agree to pay off half of the credit card, and she does indeed have emails of me stating this to her, however there was no formal agreement in writing with a signature etc. We bought a house together and when we split up I requested repeatedly that my name be taken off the mortgage and that she could have the house and I wanted no money from her, as I wanted all ties with her, and she kept trying to contact me and using the house as a way of contact. She kept disagreeing to take my name off the mortgage even though she was living there and I was renting somewhere else. In 2010 she was again requesting that I pay off half of the credit card owned by her. My solicitor sent her a letter stating that I would pay £1200 for the credit card as a gesture of goodwill if she agreed to remove my name from the mortgage. I received no response to this letter. In 2011 she contacted me via email and finally agreed to remove my name from the mortgage. My name has now been removed from the mortgage. However she is again requesting that I pay off half of the credit card which is owned by her. I have no clue as to exactly what has been bought on the credit card as I am unable to see any of the statement as it is not my credit card. My question is legally, in court am I liable to pay off half of a credit card that is not in my name? even though she has emails from me from years ago stating that I will pay half of it? Any help/advice is much appreciated.
  22. Hello there, I am sure that this forum is not the right place for my question. But because you guys have already helped me a lot, I thought I would post in the off chance. Is there any sites like this that offer legal advice/help in regards to small claims court hearings? An ex partner of mine is taking me to a small claims court this month in regards to a credit card that is in her name and I was an additional card holder, and she is stating that I owe half of the balance. Is there anywhere that I can go for help on this matter? Thanks guys.
  23. Thanks guys. Both Virgin media, and carphone warehouse have admitted that they have defaulted me by mistake! The have now removed the defaults, but are not willing to give any compensation at all.... I am in the process of getting an SAR once this is done I shall be taking them to court.
