  1. This is where I made a little mistake As I mentioned got into loads of debt etc.... I had three accounts handled by Lowells, two that I knew about and did infact make payment plans and have now cleared them both off, this Barclay's one had always been denied by myself - requesting proof for over 6 or 7 years. About 2 years ago I agreed a payment plan to clear the other two off, one was fine but after a month I realised that I had confused the supposed Barclaycard debt with the other agreed one, I called Lowells, told them my mistake changed the payment to the correct debt and at that point again asked for proof, I have the letter sent to Lowells discussing the error at that time, and also to show that the payments then went to new account which is now settled. I know it was a stupid mistake but they have been trying to catch me out for years.... other then that one payment. Right... I do have a credit report from 2009 which mentions a Barclaycard with a credit limit of £1,000, the only other mention on that report is a Barclays Select account which had a default balance of nearly £15,000 (Bad Boy!) this has been cleared and I have paperwork to prove, The two Lowells are also on there, both cleared with paperwork to prove. I have just gone back over every statement on all my bank accounts going back to 2004, the only payment I have to Barclaycard was in June 2004 for £914.00 which ties in with the £1,000 limit card which shows on the 2009 credit report as paid and closed. I have a new credit report which has none of the above, the Barclaycard £21,000 debt has never been on the reports, I have no record of it going back to 2004 in my accounts .... The application form shows no account details on it... I have said this to Lowells for nearly 7 years...

Hi Linda, I don't think they have any arguments at the moment, from what I understand it is more to do with paperwork and also there advice when signing up, therefore anybody calling with the complaints that both you and I have mentioned, then its a full refund.... To give you a timescale... I made the call and said pretty much the same as you, our mortgage ended 6 years ago with them... They replied about a week later and not only included our last mortgage but also the one previous to that! - I think when you receive this and it mentions and confirms all your mortgage / account numbers then your on to a winner. They then have 8 weeks to reply with an offer, its best to look back over all your payments made - this will give you an idea of the refund, don't forget to add interest at 8% a year! Good luck!

Hi Again, As mentioned in the last post, I had a letter from Hamptons (lowells) last week advising me that they were unable to provide the information requested in a timely fashion therefore they would except an offer of £20 per month until paid (without prejudice) which would have taken 90 years to pay back. They also offered a 60% discount if it could be paid quicker, or they would consider lower installments, two days later I had the enclosed scan ) the doc is that bad, not my scanner . They have sent me a Barclaycard Application from 1994, I have had Barclaycard's in the past but I have records of them being closed albeit with settlement offers. Really not sure what to do again, this has been going on for years & years..... HELP Thanks all, this will never go away... opps.. The letter says please find enclosed a copy of Agreement as requested. Contact us if you have any further queries. £21,872.80 -we accept payments via debit and credit cards. Yours faithfully ?

Hi Linda, Yes, we phoned the Halifax PPI helpline number on there site, we had MPI (mortgage protection) - our mortgage with halifax ended 6 years ago, they advised us of our old roll number but they also added our previous house without us even asking... That was 12 years ago Be careful as immediately they started probing why we thought it was missold, we had a look on this website to remind us why it was missold, I would guess you would be like us as we: 1) Didn't realise we could obtain a quote elsewhere therefore felt we had to take there PPI / MPI to obtain our mortgage, obliviously if we had been able to look elsewhere it would have been cheaper. 2) We thought that we where covered elsewhere with an old employer, I thought that the company was no longer around for me to check There are a few different reason's why they could have mis-sold this to you, make sure you know what your going to say To be honest, don't worry they asked a couple of questions and did the rest, we did pay monthly.   6. I just can't believe it!!! I really can't..... Having had 6 calls a day... 5 text messages... 4 letters.... 3 tv adverts.... 2... anyway! Decided to ring up Halifax to have a moan about the Mppi we paid for around 10 years, saying that I feel we should have got a better deal... really just trying my luck! They had a special helpline, I moan for about 5 minutes, they sent me a letter included another home loan and send they would contact us in less then 12 weeks... Yeah right! Got a letter today offering nearly £16,000 in full and final settlement!!!!!!! YES PLEASE x If you don't believe the ad's or the text's then take my word for it... just one call
  7. The thing I find worrying about this whole matter is that I really don't know what there on about, I still stick with my first post... I can't find any reference to a credit card that was outstanding £20k, the ones I had where settled, they have never offered or given any information about the debt and even tried to trick me into paying something on the account, how many people would have just given up after 7 years and decided to pay £50 a month. A real scary thought! Get yourself ready for DB it's a real corker!! I thought this PPi stuff was a bit of a joke, can you believe that we have £16k coming back, JUST ONE CALL! they did the rest!

Hi citizenB, I'm having quite a nice time so far this YEAR!! two bits of news for you ) I spoke a little to soon, had a letter this morning from Hamptons, quite a nice letter infact, they still claim that I owe £21,872.80 however they are currently unable to find the information I require however they are still trying to obtain it, they will however offer me a 60% discount bringing the total and final settlement to £8,749.00 or offer a £20 a month installment plan until the full balance is paid - so that would be 1093 payments over 91 years. Also had a call yesterday about our MPPI payments to halifax for the mortgage we had before DB, seems like we have a small refund of £15,878.63 coming next week. Will post the DB problem soon as they offered £50.00 how nice. Speak soon

  12. Hey Just thought I would drop in advice that no news at the moment. No doubt they will it till the 24th December.... BAH HUMBUG!! I have another couple of delightful issues to post one from DB Mortgages... as we were one of the few that consolidated due to company failure, were ripped by a broker ( paid £12,000 ) by DB only to be bent over on rates and a mortgage that goes 5 years beyond retirement.... PLEASE SIR.... I DON'T WANT ANYMORE! Anyway chat soon and to all a debt free Xmas! Unlikely here! Dave

  14. Thanks again people Further to your letter received today 24/11/2011, I see you are trying to confuse matters with regards to your claim. You note that you are claiming now £21,872.80 for your Original Client – Lowell’s Portfolio Ltd which is different to the claim form I have received, I see that you must be adding interest for the amount claimed to have jumped by £150 in a week or so, Just to state I have never had or have taking out an agreement with Lowell’s! You state there is no legal obligation to send out information or documents that have been requested under CPR 31.14 within a certain time limit and that you cannot or will not state how long it may take, this is exactly the response’s I have had from every different part of the lowell’s group for some 6 years. I would hope you could understand the stress that you and your company has put on us over this time period, you want a family with children to care for including a child with special needs receiving disability allowance to pay you nearly £22,000, for something we believe to be paid. I have two documents for Barclays one is a select account which did default, but was paid in 2007 and the other a Barclaycard that shows a zero balance, the last payment to this was in 2004. I am not sure if I should be contacting you with regards this matter anyway as you are not listed on the claim form, I had to post my defense on the 22nd as you were aware, which has been done, also I think you will find that with regards to time limits you are incorrect as they are clearly laid down in guidance and CCA 1974. To answer your letter this is not satisfactory, however it is what I have come to expect with 6 years of harassment from your group of companies Regards This OK to go

Could they say that they had informed me that the documents would take a while, saying that they trusted this would be satisfactory.... or should I write back saying that this is not satisfactory and that they are legally required to produce the documents requested Thanks
  16. Hi Team, Sent my defence yesterday by email and by recorded delivery. Have had a letter from Hampton's today, yesterday was the final day for defence. Letter goes like this.... Lowell Portfolio I ltd V Me Claim Number - Ref - Original Client - Lowell Portfolio I Ltd ?? - how are they the original client Original Ref: Balance - £21,872.80 - it has gone up nearly £150.00 Dear Mr xxx We write in reference to your recent correspondence, the contents of which have been noted. We can confirm that we have requested documents from the original client which will be forwarded to you upon receipt. Please note that the is no legal obligation that states we must send this information within a certain period and we advise that, as we do not hold copies of these documents within our offices, we cannot state a time period in which these will be received. We trust this is satisfactory and if you have any further queries in the mean time then please don't hesitate to contact us on 0113 308 60xx is this right ? Thanks
  17. Dear Andy, Thanks for your help so far with lowells, does it matter that I don't even know what debt they are talking about ? They have never sent any documentation or agreement therefore I don't even think i have a debt for this amount with barclaycard? I did have a barclays select account which was owed £15k in 2005 and I settled it, also i did have a barclaycard back in 2004 which I also believe to be settled, this also didn't have a high limit so could not have been for £16k however cant find any paperwork at all and a call to barclays didn't help either. If I am saying that i believe it to be statue barred is that acknowledging the debt.... You know best sir! I am completing online tonight and sending recorded tomorrow , deadline is 23rd, still heard now't from Lowells! I never had an agreement with them either?, sorry, what do you mean ' without all the details ' ? am I being stupid, I don't include that do I ? I'm good at advertising and design but not law or letters Thanks again Dave

To be honest citizen I did get into all sorts of trouble back in 2007 when my businesses went bang, I did get blagged into a dodgy self certified mortgage in 2007 by a broker as we had £200k in the house, so we took out £100k to raise cash to pay things off ( this is the DB thing I mentioned, they did a complete number on us, but by the letter we have recently received by db and FSA we may get something back ), we did however settle nearly all the debts, just one with Lowells was left from back then which we agreed to and oddly enough paid off last month. For the last 6 plus years we have asked them for the proof of the debt, 4 / 6 weeks ago I asked them including confirming on a phone call to a supervisor that I required CPR, that was after reading your site, had nothing through then they added the interest taking it to nearly £22k - are they mad? I give them time to produce the normal docs and they put the phone down on me! It's outrageous! You guys and girls are angels, if you need any free design, advertising or promotion just give me a shout, I will continue to donate as often a possible!

I have now seen the donate button all done, hope to keep helping you helping consumers over the next couple of threads as well... I have a huge possible donation available with regards to DB that hurt us a couple of years ago and have now written to us... will let you know when I have finish this one
