Is this the end of the line for disability benefits?
bluedogx replied to SueP1944's topic in Benefits and HMRC
It's very sad that your relationship with your GP has ended up like this. Is there another practice you could register with? In my area CAB has a benefit specialist who does appeals with clients. He tells them exactly what they need and then they ask their doctors, nurses, social workers etc. Surely there's someone like that in your area? Maybe the local job centre plus would know? We get referrals from them regularly. -
If it's in your daughters name then you could give her money to make repayments perhaps?
-
Good. Visit your nearest advice agency first thing Monday and let us know what happens. Keep fighting x

Don't give up! You can't be evicted without a court order. The back dating of your benefit will pay the rent arrears. You need advice - and fast. CAB, shelter, welfare rights. You also need to keep on at the benefit office. For your wife's sake. If not yours. If you leave voluntarily you might be seen as intentionally homeless by the council homeless dept.

CAB? Did it go to court? Council or private let?
-
Sorry, can you explain a bit more? Your OH got the credit by using someone elses name? Did she sign a credit agreement or just pretend to be someone else on the phone?
-
When you say fraud- did your OH sign as your daughter?

Is this the end of the line for disability benefits?
bluedogx replied to SueP1944's topic in Benefits and HMRC
Just because there is no forward momentum on new treatments does not mean you don't qualify. Lots of people have care and / or mobility needs but have chronic conditions that are managed long term. If you think you have a legitimate claim, then see your doctors and ask them for evidence. Don't go tomorrow if you are not claiming again for a few months though. Evidence has to be recent. -

Visit your GP and explain you are applying for AA. He should be able to support you with written evidence of your condition, how it affects you, and the meds he prescribes for you. I'm not sure of the points system for AA but your CAB should help you with the type of evidence you need. -

As far as I know claims always hinge on evidence. We have a tribunal specialist in our CAB and he wins appeals only with medical evidence. GP, consultants etc. I'm afraid you will never win without this. -

Hi patrickq1 As far as I know govan law centre can only deal with clients in their own area of Glasgow due to funding cuts. Their web site is good though. B -
Debt Doorstep Collectors

It might happen, but there again I wouldn't bet on it. It'll probably be passed to a DCA first who then might pay someone to visit you. Doesn't happen often in my area. You'll get a chance to negotiate with the DCA. -
Please advise......huge Tax Credit Overpayment issue
bluedogx replied to JPea's topic in Benefits and HMRC
I think the confusion centers around the word 'guest'. People can live in the same house and be single claimants if they are not living as a couple. I think tax credits have assumed you were not living as a couple when you said he was your guest. Now you are married, they will now assume you were living as a couple - hence the overpayment. -
HFC Marbles Loan Inhibition Order Help
bluedogx replied to breakanegg's topic in Scotland Banks & Finance
The CAB should be able to help up to a point - if HFC want to enforce the decree, they will have to have it rubber stamped in a court in England. English law applies here as you live in England. Scottish court decrees have no more validity in England than English CCJ's have in Scotland - they just have to figure out how to make them enforceable in different jurisdictions. Go on to the Scottish courts website and look up Time to pay orders - the same as a time to pay direction, but applies after decree is granted. print one off and I think there is also help on how to complete it. You might have to phone the Sheriff clerk to check if you can do this without turning up at court. Try to make a reasonable offer - £xx per month with balance on completion of sale of house or some thing like this. Or, just ask if they will take a monthly payment that you can afford until the house sells. Now they have an inhibition, they know they will get their money back, and some creditors are happy with this. -
Debts in England can they persue me in Scotland.
bluedogx replied to clooboo78's topic in Debt Collection Agencies
"I didn't send the prescription letter on the advice of the CAB as they said it was acknowledging the debt" A properly worded letter will not acknowledge the debt. Have a look on the templates here or Govan law centre web site to get a prescriptions letter. Property - don't worry about this if youre renting but check your tenancy agreement. Never heard of anyone being evicted if rent arrears are not included in s bankruptcy though. Send the prescriptions letter. They should not escalate recovery action unless they can prove the debt is still 'live'. B -
Will HMRC investigate if i wanna cancel WTC?
bluedogx replied to Rookie Bandi's topic in Benefits and HMRC
There's no guarantees. My only suggestion is to be honest. That will always be better in the end. No point worrying until it happens. -
Will HMRC investigate if i wanna cancel WTC?
bluedogx replied to Rookie Bandi's topic in Benefits and HMRC
I don't get tax credit myself, but I think the worst that will happen is that she might have an overpayment. But it all depends on how long you have been living together. If its only a few weeks then any overpayment will be small anyway. -

bluedogx replied to Rookie Bandi's topic in Benefits and HMRC
I do think you are worrying too much. All she needs to do is explain that her circumstances have changed as of the date you moved in, and that she does not think she will qualify any more. They will ask for details of the change - I think you might still have to fill out the yearly reviews - and they will decide if there has been an overpayment. You can then negotiate payment terms. Have you asked CAB for a benefit check? If you have children you will still be entitled to at least child tax credit depending on your income. B -
You need to check the policy document itself for terms, exclusions etc. Also - did he request the insurance when he took out the loan? Was he told he could get insurance elsewhere, possibly cheaper? Did he take the insurance because he was given the impression he would not get the loan without it? Any or all of these would mean the ppi was mis sold and can definitely be reclaimed Looking at the document, were all the statements against the tick boxes explained to your brother? It looks like a standard 'disclaimer' type document the bank would keep to 'show' that all was well with the ppi sale

bluedogx replied to Rookie Bandi's topic in Benefits and HMRC
Not necessarily. When you say on and off, was it long periods of time? Were you working? What is the appointment for? HMRC won't investigate just because you cancel. They would have to have other reasons. B -

HFC Marbles Loan Inhibition Order Help
bluedogx replied to breakanegg's topic in Scotland Banks & Finance
Hi An inhibition is termed a 'nuisance' diligence. It won't stop the sale of the house but the selling agent needs to know as the inhibiting creditor will get their money back before you get any once the house sells. Do they know the house is for sale? They might not take further action if they know, and this will give you time to get more info on the amount owed etc. As far as buyers are concerned, I don't think this is something that they need to know about. Can you afford a payment to keep them at bay? Now they have a decree they could feasibly arrest your wages, but if you explain the situation they might just wait for a sale. -
Hi If the trustee has not already claimed the ppi, then your brother is free to do so. B
