  1. Yes, the £10 route. It appeared that everything was going to be there for me to collect today, until I turned up and there was only a letter waiting!
  2. I have an old Lloyds TSB Trustcard, which is giving me some grief.... I have been trying to get copies of statements etc since 2006, and thought that I was finally collecting everything today, however I went to the bank and there was only a short letter saying they didn't have any information. There's some history.... I opened the Trustcard account in November 1998 just before I went travelling, I was 18 at the time and working part time. The account was closed in July 2003 when I lost my job and then sold to Activ Kapital in September 2005. I am still paying the remaining outstanding balance now, with about £1,400 left to pay. In November 2006 I wrote to Lloyds and asked for copies of my statements etc, but never received them. They were constantly looking in to the matter, but were proving difficult to find??? I unfortunately lost my copies when I moved house at a low point in 2005. I recently applied for a new SAR and received a letter a couple of weeks ago saying everything was now ready for me to collect and I could collect a PARCEL from my local branch, I turned up this afternoon and there was a short letter saying they couldn't find anything. "...We have been unable to find any other information regarding your credit card due to retention periods. Unfortunately, we have not yet been able to locate a copy of your signed agreement. We can assure you that before we opened your credit card account we would have required sight of a signed agreement. if you take this matter further, the bank is confident in their ability to be able to prove this. If you require information regarding your debt after September 2005, you will need to contact Activ Kapital as we are not the Data Controllers of data held by this company." I know there were quite a lot of charges on the account in the last few months of it being active, but I'm not sure what it was like before that, I can't remember if I had PPI or not, but now it seems I can't find out. I am still repaying this account, I have been since it was closed in 2003, along with a considerable amount of other debt. However I am now feeling stronger mentally and my ambition is to get out of debt 100%. Anything I can get back that I should't have paid is going to help massively... so any help on where to go next with LLoyds is going to be a massive help... I know it's an old debt, but it's still current as I'm still paying it....

Hum... my floor is now covered in folders and it seems that whilst I sent a 14 day LBA to recover over £450 in charges on my Egg card in May 2008 I never received payment and I didn't start a claim in court, I was very skint at the time, and couldn't afford the fee's. I will double check tomorrow that I haven't received the money somewhere else, maybe deducted from the outstanding balance, although I'm fairly sure it hasn't been, and if no money will start on this again! Can I just start again with a 14 day LBA through? Or do I have to go through the whole rigmarole? Massive thanks for your help guys!
  4. Hi, thanks, I think the spreedsheet is fine, only question would be that I've calculated the monthly interest to annual interest right? and used the right one, merchandise not cash interest rate? Busy constructing my LBA now
  5. Ok, it looking through my statements, it seems I had the PPI for just over a year, and then my account was passed to a DMA and they stopped it, instead of using the PPI to repay my card? I was unemployed, which they knew about at the time....! Anyway, this means that I paid out about £70 is PPI, which assuming I have done the conversion from 1.167% per month to 14.94% year, (I used Merchandise Interest) right works out at just under £180, its not a lot... however it would just about clear what I currently owe them, giving me one less debt to worry about! Should I send them a letter before action along with the SOC? See what they come back with?
  6. I would be very surprised if anyone else would give me a card, my credit file is in tatters, and I still have £10K+ outstanding debt which is on repayment plans. I don't remember ever asking for PPI and used the fact that they had been fined as my main reason for miss-selling. Not great I know... And doesn't excuse them not letting me remove my PPI in 2005. I have the majority of my statements, but not a full set.
  7. I used the questionnaire when I sent my request in, but don't know what a SOC is? I have all my statements as I did a SAR a few years ago, for charges... will sit and plug through the spreadsheet now. Thanks for that!
  8. I think I have already reclaimed my charges on this account, but I will double check. Which spreadsheet is the right one for working out how much PPI they owe me? And many thanks for moving my thread....
  9. I have a Capital One Card, applied for in October 2004. I have written to them asking to have the PPI repaid and received a response from them. The claim that I applied via post, although I thought I had done so Online, however 2004 was the height of my financial crisis, so I might be mistaken here. Anyway they claim I purchased PPI during a phone conversation in December 2004 when I confirmed that I was employed etc. They go on to say the sell PPI on a non-advised basis, they do not provide advice. They have found no evidence of miss selling and that this is there final response. Several years ago, when I was receiving help from the CCCS I phoned them and asked them to remove the PPI as I didn't need it, I was unemployed, however I was pressured in to keeping it, that would have been late 2005 I think. I still have this card, the only CC I do have, and need it for my work, I use it for expenses and then repay it in full when I'm paid my expenses. I'm guessing to proceed further I need to do a SAR and specifically request any phone recordings? Are there any likely repercussions of me doing the SAR?
  10. I have written to Egg and asked them to refund my PPI. I opened my Egg account around about 2003 and it was passed to a Debt Management Company in 2005, although the account remained active beyond this point. I'm still paying it off now. I have now received a response from Egg saying... ...our records indicate that there have been no CRP Premiums (their term for PPI) charged to your account within the last six years. It is the policy of Egg not to refund any charges that were applied more than six years prior to the date of your complaint. Therefore, in line with this fact your complaint has been rejected. Unless you are able to provide any additional information or evidence, which would affect the decision, your complaint will remain closed... I know its harder to reclaim PPI beyond six years, but not impossible. I want to claim to write of my current debt, any left over will be a nice bonus. Has anyone had any joy claiming old PPI from Egg?

Last week I sent the questionnaire to GE Capital to reclaim PPI on a River Island card which I got in October 2000, Yesterday I received a response from Santander (I didn't know they own GE Capital) basically saying that since the account is so old its not covered by the FSA Fine and ICOB regulations. Basically they say the ownes was on me at the time to be happy with the sale etc, that I had a 30 day no-quibble guarantee regarding the PPI and that it was always listed on statements etc. That they had no requirement to record the sale back in October 2000. Therefore they say there was no miss selling of insurance. They have been kind enough to supply me with a copy of the original form I filled in at the time, in the store. On this form, there is a recommendation to take out account cover, which is drummed up to be something you would need to have. I'm sure the letter from Santander is fairly standard, so what's the next line of attack? Many thanks

  13. Hi Ims, this is more than good news, I will SAR them ASAP, but will be next week now when I can afford the £10. However, I have a Capital One account, which I am currently still using, although I have had considerable charges on this other the years, so I guess I can claim this back as well? What's the next stage as I have a full set of statements for this account. I have sent Capital One a letter requesting my PPI back today!
  14. Hi BB, I haven't on this yet. I have sent them the questionnaire recorded today, for three loan accounts going back to 2002, so fingers crossed will receive a few nice cheques from them.
  15. They are a mix of over limit fees and late fees. Are these still reclaimable? If I managed to get these back it would be enough to clear this debt and leave enough to have a little celebratory drink!
  16. It was a credit card account. I never received a goodbye letter from MBNA, but I did get the hello from Link, I have been paying them since, at about £5 a month. I know the cheque is old now, but I have been told that you can still try and cash them, but it might not work. I appreciate that £300 outstanding isn't very much, but even so at £5 a month its going to take a few years to get rid off...
  17. I used to have a Virgin Credit Card, who were owned by MBNA. I remember the day I got it, a lady encouraged me to have it one day as I was shopping for CD's in the Virgin store in Aberdeen, took my details on the clipboard, this would be back in 2001/2002, but I can't find the date. I ran in to money problems a couple years later and in August 2004 the account was sold to Link Financial, who give them their dues haven't hassled me to much, so long as I continue to make regular payments. I'm now left with about £300 to pay. Having found this forum in the past year I am slowly taking back control of my finances, not quite my life yet through, I still have a long way to go... Some £13k. I have been reading about other peoples dealings with MBNA and one thing stands out, I have never received a letter from them saying the account has been sold on, where does this leave me now? Also, in 2007 I set about trying to claim back bank charges, requesting about £350 worth, I eventually received a letter and an offer of £104 which I've just found the cheque (un-cashed) for. I had sent a letter suggesting this wasn't sufficient and I wanted a full refund, which was I think put on hold and then turned down. Do I try and cash the cheque now, or is there a chance I could get them to reopen the case and repay more?
  18. Lloyds did this to me in 2005, they combined two loans and a overdraft with a consolidation loan, I got a letter telling me they had done it and to sign and return. To be honest, I can't now say for sure if I did sign and return, however I noticed today that the new loan included PPI at almost £2000, despite the fact they knew I was in major financial problems at the time and struggling with debt and work.

I'm slowly working through my accounts, and today have got to a Trustcard I opened in 1998, despite several requests back in 2006/07 for statements they never came, so today I am sending them a final letter, before I make a formal complaint. I am still paying off this credit card, although the debt is now handled by a third party. With luck I payed PPI on the card, I know I had a hellish amount of charges, but I have never been able to claim for them due to lack of statements.
  20. Hi guys, I'm new here, stumbled across the forum via google! I have a long history and a whole mountain of debt, but chipping away slowly... I currently owe just over £13k, but that is down from £20k a few years ago. I'm going to ask for a whole heap of advice in the next few days, as I'm currently quiet lost in how to best manage all my debt, but right now I need some specific help with Santander. I have/had two accounts with Abbey/Santander, one was a basic account I used to manage payments to debt agency's etc and the other was a regular debit account for day to day living. Both are now in arrears and blocks in place. Within the last 3 months. I am self-employed, however have been struggling to find work since mid summer, and haven't had work since November. I have now managed to register for Job-Seekers, which should start coming through in the next couple of weeks. I have had to move out of my flat and in with relatives due to struggling financially. As work stopped coming in, so did the money, which resulted in one or two missed payments and associated charges from Santander. By mid September/October, I was unable to pay any money in to either account, or it would have gone straight on paying charges. At no time has any payment that I have made directly, brought either account in to arrears, however missed payments have resulted in charges, which have taken both accounts overdrawn. And so it spirals. I have written to Santander, but my letter has been ignored under a flood of demanding letters from them. My debit account has now gone in to default, and I suspect the basic account is about to. So today I have sat down with pen and paper to try and work out where it has gone wrong. Debit account: Currently -£221.91 going from the last letter. Charges on this account in the passed 12 months = £300 (£250 since June) Basic account: -£239.24 going by last letter received. Charges on this account in the passed 12 months = £355 (£330 since July) In the passed I have tried to reclaim charges from Abbey, but I was put on hold during the hearings and then turned down. I understand in some circumstances I can make a claim under hardship, but don't know what, or how far back? Obviously here the charges are more than the debt's owed, I have no money coming in until JS comes through, and even then that will just cover rent and essential bills while I look for work, etc. Any advice on how to proceed greatly appreciated, I need to respond to Santander today, but don't know the best way.
