  1. Thanks Boo, I made a note to ring that Consumer Direct number on Monday. I've sent of the phone harassment/offer letter to 1st Credit today. Sorry too for calling you Bill in the previous post. You've been a fantastic help both her and in my other posts.
  2. Thanks Bazooka Bill, I suppose I've been waiting for Santander to reply to me. In not doing so and passing the debt on I can only assume they've washed their hands of it.
  3. Hi, I have a couple 3 debts with Santander, a bank overdraft, a credit card, and 3 outstanding payments on a loan. I'm currently unemployed and rely solely on JSA for income. After what seems like a long old fight I managed to get Santander to agree a monthly offer of £1 for both the overdraft and credit card debts. Within 3/4 months of this arrangement both of these debts were passed on to outside agencies. The overdraft to Westcot (for which I have another thread) and now, my CC debt to 1st Credit. A few months back, I was receiving numerous phone calls to the communal phone where I live from Santander per day, essentially because these debts were all handled by different departments and were all independently phoning me to chase them up. I sent the telephone harassment letter and received a letter from their complaints team that I quote: That was at the end of March and all calls did cease until August when I started getting calls relating to the overdue loan account. I wrote a letter of complaint to Santander asking why when I'd had a letter from them telling me my phone number had been removed had it not actually been done. They wrote a reply that rather than answer this question, just went on to explain why they felt the need to start calling me again. I wrote back to them at the end of September asking again why my number hadn't been removed, I've had no further contact from them regarding that follow up letter and now know that they appear to have ignored it and just sold my debts on. Anyway, my question relates to 1st Credit. Since taking over the debt for my CC last week, I have been getting daily phone calls from them on the same number that I'd asked Santander to remove. I'm about to write to them to make the same offer as I'd previously arranged with Santander and I'm also going to attach the harassment paragraphs to that same letter. Do have have grounds to complain about Santander about this, not only did they never remove my phone number as they said they'd had, but they've passed it onto 1st Credit. I'm really angry about this because it's causing distress once again to the people I share the house with and embarrassment to me.
  4. Well, I wrote to Westcot with the offer of £1. Today they wrote back asking me to complete a financial statement, something I'd already sent to Santander on more than one occasion. So I'm about to write back saying exactly that and that I'm not about to submit anther one for their benefit and to re affirm my £1 offer. I'll keep updating as I move along.
  5. I suppose, I've had a similar issue with Barclaycard. However they wrote to me to inform me they were assigning the debt to Link Financial, they also said that Link Financial would honour the £1 a month payments which to their credit they have. And Link Financial then wrote to me to confirm these arrangements and gave me details to setup a standing order. Santander have been completely unreasonable at every stage of communication.
  6. No, the first I knew of it was when I received a demand for payment from Westcot. It's headed "Notice Of Debt Collection".
  7. Yes it is, and what they sent me was the original signed application form. I was angry because I'd spent the best part of 4 or 5 months getting Santander to agree in writing to my £1 a month offer. this then ran for just 2 to 3 months before they passed the debt on, without any notice that they were going to do that.
  8. So should I write to them making the £1 offer? After all, it's what Santander accepted prior to passing it on in the first place.
  9. Hi Guys, I received a reply from Westcot which basically consisted of just my signed application for opening this bank account and a standard "pay us now" letter. As it stands, I received a reply from Santander on the 22nd September to my above complaint which I wasn't satisfied with at all, I wrote back to them with a follow up letter. That was on 29th September and I've yet to hear from them to this day. In the reply from the 22nd they did mention that my bank account had already been passed (no other documentation has told me this) to a third party agency but no mention was made of Westcot at all. What they did say in the letter was that my account was passed to this "outside agency" on the 19th August. The original demand for payment from Westcot was dated the 14th August. Either way, I'm not sure what my next course of action should be, Do I write to Westcot and tell them I'm still waiting for a reply from Santander? Do I write to Santander and again tell them that I have had no "official" notification that they've passed my debt to Westcot? I'm a bit puzzled at to what to do.

  12. Here it is: Basically I wrote that in response to receiving one of those "Our records show we have had no communication" letters they sent me a couple of weeks later. I received another one of those too, a couple of days after they wrote to acknowledge receiving my complaint. I've not received anything further from them until this letter from Westcot showed up yesterday morning.
  13. I've got an ongoing complaint with them about telephone harassment, basically they were ringing six or seven times a day, and I was getting the odd "we'll send someone round" card on top. I sent a complaint about it and got a written reply to say that my numbers had been removed from the system and that they would accept my £1 payment offer (I'd written to them about 4 times asking them prior to complaining) on both my credit card and current account overdraft. My loan was being payed by PPI. Anyway, when those PPI payments ended I was still £1500 from clearing my loan and the phone calls started again. I can post up my second letter of complaint if it's of interest. So yes, to cut a long story short, Santander's customer service is nothing short of atrocious.
  14. Thanks both of you, I'll send off the prove it letter to Westcot and see what happens. I'm so annoyed at how Santander can so easily and quickly go back on their agreement.
  15. I didn't have PPI on my credit card, I've probably had late payment charges and all sorts since I got into trouble late last year. I did have PPI on my loan account which I successfully claimed on but that only lasted a year and left me with two months outstanding. My current account, which is what this Westcot letter relates to has no insurance, up until I got Santander to freeze charges and interest and accept my £1 token payments I was incurring interest on that account. This letter has come out of the blue however, so while I can write to Santander and start claiming, I don't know what to do about Westcot taking over the account.
  16. Hi I've had an agreement in place with Santander since early this year to pay my £1 into a £1500 overdraft. Currently I'm unemployed and actively seeking work. This morning I received a letter from Westcot asking for immediate payment or to contact them. I've done a quick search through the forums regarding NOA letters and apart from my regular monthly bank statement, I've had absolutely no other correspondence whatsoever. I also have an arrangement to pay £1 a month off of my Santander credit card so I can only assume that this will be next to be handed over. Should I cease paying the £1 to Santander and send a 'prove it' letter to Westcot or should I ignore this letter and carry on and wait for 'further recovery action' I'm not sure of what to do next.   17. I would agree, but it keeps them off my back for the time being although I wonder how long it'll actually be before Link decide to get heavy handed. Thanks ims, I'll treat them as two separate claims then.

Hi guys, I received a letter today from a company called IDR Finance to inform me that my Barclaycard debt of £1300 has been sold to them and passed to Link Financial, also included was a notice of assignment from Barclaycard informing me that my account with them was now closed. Up until now, I've been making agreed £1 token payments because I'm currently unemployed and both Barclaycard & Link have agreed to honour this payment for the next 6 months. I've thought about reclaiming all charges made to my account that were applied late last year when I was trying to make minimum payments and was often days late. But I also paid for PPI insurance on my card from 2007 to October last year when I tried to make a claim. This was refused outright because I had moved from one job to another early in 2010 and had a 3 week "break" between finishing one job and starting the next and therefore didn't meet their qualifying criteria for continuous employment for 6 months. I've downloaded the SAR template to send to Barclaycard, my question initially is can I claim for everything in one fell swoop? Or should I treat the PPI claim separately from the claim for refund of charges? As always, will be grateful for any advice you can offer. Fred
  19. Hi WW, I am in roughly the same situation as you as regards token payments. I've had £1 offers accepted by both Barclaycard & Santander Credit Cards, my Santander CA overdraft is proving to be a bit more problematic but I'm on the case. Vic did tell me in my Santander thread, that although they can't demand to see this information, by sending some heavily redacted info, they might well jump on board. It worked for me.
  20. Calders, with Mercers, are indeed all part of Barclaycard, they probably all boil from the same kettle at tea brake. What happened after you cancelled your card details previously, did you ever get that agreement to pay £5 in writing?

Guys I just want to say thanks again for your help with this problem, I received a letter this morning from BC confirming that they will call off the dogs, freeze the interest and charges and now accept my offer. They even sent me a standing order form to help me out (though I did double check it wasn't a direct debit mandate in disguise). I'm going to set that up and leave it a month before I start the process of claiming back my PPI.
