  1. Hi Guys I have been in correspondence with the FOS these people lost my original docs, thankfully I have an electronic SAR file. I explained to the FOS that I was sold mechanical breakdown and shortfall warranty by welcome car finance at the time of taking out the insurances I explained that I didnt want them, but was told that if I took them out I would be looked upon favourably and would get the credit? The FOS said that I had signed an agreement for the insurances and the fact that the pressured selling didnt seem to matter?, I went on to explain that I didnt have a signed "needs and wants" form the FOS said this doesnt matter I had signed the agreement? The FOS went on to say you have used the mechanical breakdown cover, I explained to the FOS that yes I had, but this still doesnt get away from the fact that at the creation of the credit I asked not to have it and it was forced upon me. I have asked for the return of the insurance monies as I beleive this falls into the realms of a mis sold PPI scenario, and to return the vehicle to Welcome I have tried recently to terminate the agreement paying well over half by a couple of thousand for the goods, i was told then by welcome I owed the insurance money of £648.49 this is madnes I have already paid well past the termination price for the goods? I have a credit termination figure for the goods and this is written into the agreement all nice and legal but where is the insurance credit termination rights? Im being asked to pay the insurances figure because this was paid up front ok, but where are my rights when it comes to terminating the insurances these are not shown in the agreement other than for the goods, but they still are trying to chase me for the insurance money how can that be legal with no termination rights? I actually spoke with Welcome last week and was told that a default notice had been placed on the account, is this right when im in dispute about the account with Welcome? I was told by Welcome I could not voluntarily hand back the vehicle, I now must pay the full asking price of £8000 Some help guys and what I should say now to the FOS as I have escalated it past the initial case handler and I have to respond quickly Thank you so much for all your kind help Guys and Gals Nick

Hi Guys I purchase an antique, it was advertised as a original, i purchased the item in january and I had my collection valued yesterday to be told that one item which I purchase from a dealer was a fake is it possible to get my money back this far down the line from the sale? Hi Guys Thanks for your help in advance I ordered a suite from DFS we were going to pay cash, sadly we had a household problem where we needed the cash we put aside for our new suite We have ben told that we cant have our deposit back as the suite was intransit and made i ronic really as it was only 8 days after the initial order, we didnt really want to lose the suite so we went down the credit route but couldnt get credit. So is it possible to get my deposit back? Kind Regards Nick

Hi Guys I have a welcome car finance agreement Iam being chased for £728.29 At no time was I aware of the agreement I have being a double agreement, I only have a termination agreement for the goods, it does say however that the insurances do not form part of the agreement, so how can they demand payment with no separate agreement or termination figure for the insurances? I was under pressure at the time of purchase to buy the insurances with the vehicle as this would Im told be looked on favourably. In my SAR there is no Needs or Wants Form for the insurances or separate agreement for the insurancs so how valid is their claim for payment. I have not paid Welcome finance now since October 2010 for their vehcle, I asked welcome to obtain a court order for the return of their goods as I have paid well over the termination figure. I still do not have a default notice is that because they don’t have a credit agreement for the insurances? Instead they keep sending me threatening letters, debt collectors etc etc, I am a little immune to such crap as I am a bankrupt from Sept 2006. Should I hand back the vehicle and pay the £728.29, or get them to obtain a court order, or should I tell them that I am a Bankrupt? Very Kind Regards Nick

Hi We sent in the yellow slip and the V5 stayed with the dealer until the vehicle was sold in september, the fine was only issued after the car had been taxed for resale. funnily enough the DVLA had issued me with a new V5 because i had a cherished plate on the car and it is the documentation for the original plate that has got lost in the system. i sent a recorded delivery letter telling the DVLA that i had posted the yellow slip and so fullfilled my legal obligations but they seem adament that i was responsible for the car at the time. the second letter from the debt collection has stated i owned the car on 1/6/10 although DVLA where processing the paperwork for the original plate at ths time?????

Hi it seems like the DVLA are adamant that they are going to take this to court, am I still right to challenge this as I have had the debt recovery agency sending two letters and informing us that they are going to clamp the car, and the car trader has informed the DVLA that they were at the time the legal owners of the vehicle, but DVLA are insiting they are pursuing the claim? we also have a receipt for the car when it was traded in which shows we were not the legal owners Laughably the debt recovery people have stated that they are going to clamp the vehicle??? which belongs now to someone else, and seize it?? and is 200 miles away from my address Should we let this run its course?

Hi Post Thanks for looking over my agreement, how and what do I say to claim back the Insurance, how should I word it and to whom? cant thank you enough I really really want to get rid of this Welcome lot, take it I have to hand the car Back? sorry if it sounds a dumb question but just thought I would ask anyway just incase.   12. Hi The only insurances I have are shortfall and mechanical going back to your previous request about HP and credit I have just noticed in the signature boxesone states HP and one states Credit, but at the top of the agreement in bold it states that this agreement is a credit agreement?? Nick

  14. Hi I now have the SAR in my possesion from Welcome, is there something specific thats of interest to you? I have looked over the docs and the statement of price Welcome have sent, we personally have never seen this before now it has appeared with their docs? We have had under the same agreement 3 cars, the 3rd being the one we have at the moment, the first car never had a statement of price or the second but the final one does?? dont know if the above helps, but would be most greatful for your usual very kind assistance with these people.   15. i did not notify the DVLA that the dealer posted the yellow slip the letter states the V5C/3 was sent but appears to of not been recieved it does not say who sent it. also the plate change has nothing to do with it i recieved the paperwork for the original reg straight away it is only the paperwork stating that the car is with a motor trader that is missing

  17. thanks for that my issue is the yellow slip was posted and the V5 was kept by the car dealership so they kept the V5 until sold 5mths later this is how the fine was issued. the car was on a forcourt until sold so was not taxed so DVLA must of known where the vehicle was all that time as they needed to use a trade plate when test driving? the garage sent a letter to DVLA stating they had the car and i sent the receipt showing when the car was sold but they are not interested
  18. thanks for your response i know the paperwork was sent to DVLA and they have lost it, i wont pay a fine for a car that was not mine at the time. i hope they realise this and i too wont have to go to court over it. i have bought and sold 36 cars in 21yrs and never had this before
  19. ok thanks so if i notify DVLA that i sent the paperwork to them what will happen to the fine?? Do i need to write to them again telling them i posted the paperwork or shall i just ignore the letter as they state this fine needs to be paid by 11/12 otherwise a debt collection agency or county court appearence will follow. the yellow slip took a bit longer to get there because we had a cherished plate on it and DVLA had to issue the correct documents to us with the original registration on. whenever we have swopped plates before the documentation has always been returned to the dealers not us??
  20. i signed the yellow piece and sent it to the dealer for him to sign. when i approached the dealer about the yellow slip he stated he sends them all off twice a week. He wrote a letter to DVLA saying he was the legal owner and had sent the relevant paperwork off and we sent a copy of the sales agreement too, but DVLA won't accept that i was not the owner at the time of taxing, the fine was not processed until the car was sold and the dealer taxed the car for the new owner.

Hi Guys Sold our car to an independant dealer, in may of this year, dealer sold and taxed the car in September, we then had aletter from DVLA saying we are still responsible for the vehicle? and have sent us a fine for £80 even though we have sent the DVLA a copy of the sale receipt showing clearly the date of sale? Im totally confused, how can I be responsible for a vehicle thats not mine

  23. Hi thats an interesting question, I would like to keep the car if what I have paid so far is sufficient, but I dont want to pay anymore money for this car to welcome if it means re starting payments again.

Hi Guys I have just received a letter today from Welcome which basically says exactly the same as the last one, other than at the very bottom they have requested that I contact their collections department to arrange for the car to be collected, and to carry on paying the payments to them. they have also stated this is their final letter Obviously I dont want to get into debt, should I hand the car back? what should I do as you know I have formally written to them cancelling my agreement.
