  1. I've filed a defence online. I asked for time to gather all the correspondence re. the claim. Will this work?
  2. Thanks for this advice. Do I send back the acknowledgment or the defence or both? Will this automatically delay the ccj for 14 days? The acknowledgment seems to suggest it would give a further 28 days??!?!?!?!?
  3. Hi it is sadly a genuine debt - though compounded significantly by charges and fees. Yes it is on my CRA file. 02 have closed the mobile phone account that the debt is from and Moorcroft have picked it up. Nelsons (I assume) have submitted to the court and bumped in their fee too. I just want to know the best and most secure way of delaying payment until the 31st July so I can AND avoid a CCJ. It would seem that acknowledging the debt and then later admitting it is the best way? Open to suggestions! Thanks
  4. At what point does a claim become a CCJ? One of the replies suggests that I will have 28 days to pay the amount AFTER the CCJ becomes active in order to have the CCJ removed. I might not understand this fully but does thalt mean it will become a CCJ in 14 days (so 7th July) and then I'd have another 28 days to pay it and have the judgment removed?
  5. Hi, I am in receipt of a County Court Claim for £343.33 issued on 18th June this year. I want to know if I agree the amount and ask for time to pay will I definitely get a CCJ registered against me? I want to pay it off but can;t afford to do it until I am paid in July which will be outside the 14 day "grace" period the court gives me. Any advice? Thanks Mel

  7. The more posts on the subject of cancelling CPA I read the more nervous I get. It sounds like people have had a real fight. Is reporting my card stolen or cancelling the card a more certain way of ensuring the payment isn't taken?

  10. bit harsh! I'm on the site because I need some advice not rebuking!! I am by no means justifying what they are doing, I got myself in to a mess and I'm trying to get out of it and in the past CAG has been remarkably useful and informative. I really appreciate your help in previous messages and I understand the opprobrium you attach (rightly) towards those who seek to profit off other's misfortunes, but I'm not the enemy!!
  11. True to form the NatWest are saying they can't cancel the CPA! With regard to Wonga and a repayment plan/interest, what's my position there? Thanks Mel
  12. I owe just over £880 which is due to be taken out on the 29th March. Is it too late for me to cancel this with my bank? (Natwest) I've spoken to my payroll and it's too late for me to change salary payment for this month. Are Wonga obliged to accept a payment plan and will they continue to charge interest through the period of the plan? Many thanks, Mel
  13. Moorcroft have entered a judgment against me for an old O2 debt. I don't dispute the debt. But I never received a claim pack from anyone, certainly not the court. I have a month to pay the debt and get the ccj removed or I can dispute the case on an N244. What are my chances of having it set aside and what is the best way forwards? Mel
  14. It's an O2 debt. It is on my CRA and is now a ccj. I don't dispute the debt just the fact that I didn't receive the claim pack and therefore had no chance to defend this before a judgment was entered.
  15. Hi spoke to court it is a genuine claim. We never received the claim pack so I guess we have to dispute the claim and apply for a set aside. A judgment has been entered but they are giving a month's grace. The court were not particularly helpful, asserting that the claim pack was sent and not returned. Effectively calling us liars. Does anyone know about the set aside process and if it's worth us doing it or should we just pay and get the judgment removed.

  18. Is the fact that they've given me a warrant number for the court reference proof that they may be serious? I really don't recall receiving any correspondence from the court.
  19. Hi All, Does anyone know what the position is re: a creditor taking out money of a redundancy package? I've had an attachment of earnings on my salary for a few years which now stands at about 9K. I'm getting a redundancy package worth about 19k in Jan. Can they take it all out in one payment? Cheers

I am very releived to have had the judge suspend the order and she was also very supportive in her assessment of the circumstances leading up to the arrears. I am a little worried by the attitude of the solicitor in asking for an appeal although the judge herself was adamant that no circuit judge would reverse her decision. I think it's a malicious act on behalf of mas. In your experience, if they did appeal would this hearing also fall before the eviction date? Sorry to burden you with another question. How do I make a contribution to the site and how do I get a box of chocolates to you ?! Mel
