Hi everyone, I am still waiting for my docuements. I am waiting until next Monday when the 2 weeks are up and then if no info arrives then I shall be ringing them again. Viktor Mayo/Lisa Jagger are based in the Data Subject Access Request Team in Halifax HBOS. The account in question was a prefernce account with cheque and overdraft etc. It was passed on to a credit collection agency eventually. I do have a direct number for Mr Mayo if you need it. Dusary - This is Capital Bank which is now part of HBOS, not Capital One (They're next!!) -
Hi, Well I got in touch with the Court today and they confirmed that LLoyds/SCM had not filed an allocation Questionaire and that the case was 'upstairs with the judge' ?! Anyway, presuming that the case has been struck out, do I now contact Lloyds/SCM for payment ? Thanks Katie

Hi everyone, I thought i'd update you where I am at. I sent SAR off as my first message, 40 days were up on 25 April. A week later, I got a letter from HBOS asking me to confirm my identity. No probs, did this and then started the 40 day limit again. This 40 day limit was up on 17 June, so yesterday I called Mr Mayo at HBOS who sent me the original letter and he advised that my documents will still take another 1-2 weeks. The account ran from 1997-05. Do you think it's worth taking it to OFT or sit and wait ? Many thanks Katie -
Hi everyone, Got a General Form of Judgment or Order today as follows :- Upon allocation referral It is ordered that Unless the defendant files an allocation questionaire by 4pm on 22 June 2007, the defence will be struck out If the above happens, what would be my next step ? Many thanks Katie

Hi, The charges are for arrears. The charges range from £7.33 to £25.00 starting from 1991. We wrote to the DHSS at one point in 1992, as on income support at the time and they wrote to Nationwide on my behalf. The DHSS wrote back to say Nationwide had 'fined' us for making late payments and theres nothing they could do to help us. So all these charges are 'fines' and arrears fees. Is this ok ? Thanks

Hi, Would or indeed can I reclaim charges back from a mortgage lender (Nationwide)? If so, would I use the normal SAR template or is there a different one to use for Mortgage charges ? Many thanks

Hi everyone, I sent the non compliance letter as advised and amended it to suit. I then today, received a letter back from YB as below :- I have contacted our dept which dels with all DSAR and have clarified that we do not issue statements for personal loan accounts. It would be most helpful to assist you with your query regarding charges to the above mentioned account if we had a contact telephone number or you can contact myself at the branch. At the present moment we cannot find any record of any charges relating to the account. Now this account was subsequently passed to Jeremy Sutcliffe who act on behalf of YB, so I can;t believe that there were no charges debited previous to that. Although I have got a handful of letters from Jeremy Sutcliffe and at the bottom of each, a £20 'admin' fee was charged, so I can;t believe YB didn't charge me also. What would you advise of my next step ? Many thanks Katie

Hi Everyone, I've posted this already in YB forum but not got any replies and I know how good we are in Lloyds.... ! So I thought i'd see if anyone else knows. I had a personal loan account held with YB over a number of years. I am attempting to reclaim my charges back so I sent off the S.A.R - (Subject Access Request) with the £10 fee. After 56 days, I received a letter as follows :- With regard to your DSAR request........ Unfortunately we are unable to issue statements for your account as this is a personal loan account for which statements are not available....... I'm not sure now. Surely they should be able to supply me with some information ? Has anyone else come across this or is it because its a personal loan account and not a bank account ? I was under the impression you could claim back regardless of what the account was if there were unfair charges debited. Many thanks

Hi Everyone, I have now received the AQ to fill in. I am ok up to Section G ' other information '. I am a bit confused as to what needs to go here. Do I need to fill this in or just atatched the Draft Order that i've seen in a few threads ? Many thanks

Got transfer of court proceedings today with copy of SC&M defence. Attached with it is this :- Northampton County Court Without hearing IT IS ORDERED THAT 1. The filing of an allocation questionaire be dispensed with in this case unless the District Judge at the court of transfer orders otherwise. I've not come across this before, is this normal ? Also, does this mean that if I don't fill in an AQ, I dont have to pay the allocation fee ? Many thanks Katie

Hi Everyone, As would have thought, Lloyds filed a defence at the last minute. I'm now waiting for AQ to come through, so lets see how long this one takes !! I'm thinking of claiming for wasted time etc as per BF's sticky as we all know Lloyds have no intention of going to court. The only thing is, I'm not sure how much to put for photocopying court bundle, etc. Has anyone else filed for this yet, if so what estimated costs did your put ? Many thanks Katie

Hi Everyone, Just starting my claim against Cap1. I got my copies of transactions sent within the 40 days which was a bonus but i've also got copies of screen prints showing manual intervention. What do I need to do with this ? Many thanks Katie

Hi, I sent the SAR to Capital Bank at Capital Bank PLC Capital House City Road Chester CH88 3AN I've had no response and the 40 days time scale is up. Should I continue to send the non compliance letter to this address or could it be they have moved re last message ? Should I send it to that one instead ? Many thanks Katie
