  1. @Bandit127 - Yeah i'll get on to finding out if and when the CCJ was issued and get back to this thread. @BRIGADIER2JCS - I moved from the property in 2004 making it a 8 year old debt but not sure when or if the CCJ was issued however if the CCJ was issued early this year the debt should have been statued barred however with the mishap of them thinking i still lived in the property till early 2011 then i guess they had grounds to get a CCJ falsely. Btw does it have to be Trust or can it be a £2 report from Equifax or Experian?
  2. Also thinking about it i guess its quite possible if the ccj was awarded when they contacted me which was beginning off last year so its quite possible the ccj has been falsely given as i only owed until the end of 2004 making it a 7 year debt.
  3. I guess it had been awarded sometime after i had left my previous property but not 100% sure... Can the CCJ be enforced if the amount was wrong?
  4. Thanks for the replys, i have no idea that i have had a CCJ against me and not a clue how long ago it was issued... It possibly could have been issued when they thought i owed £1800 that fee has since been amended but would the CCJ still enforacble? I guess i will have to check if i have a CCJ on file as my next course of action?
  5. Hi all i have a problem i received a letter back in August 2011 from Northumbrian Water saying i owed £1800 odd pound up until the date 4th Jan 2011. I had moved out of the property on the 21/12/2004 and was advised to contact the council to prove that i had moved to my new address then, did that and got written contact saying i owed £705 on the dot as i presumed the debt is over 6 year old (8 year to my reckoning) i just left them to it. Come today i received a letter from Regal Credit Solutions for the amount of £705 it said this-: We write to advise you that we are INSTRUCTED by our client to demand the immediate settlement of the above debt. We would ask that you forward the outstanding amount in full, quoting your Reference Number. Your Cheque of postal order should be made payable to "R C C Ltd" and sent in the enclosed 'reply paid' envelope. Alternatively payment can be made to us online, via our automated telephone based payment system or by contacting us on the above number. As our Client has already obtained Legal Judgement for this account, if we do not receive repayment proposals from you, we will explore taking further action to 'Execute the Warrant'. This will add further legal costs to the account and have a king term detrimental effect on your creditworthiness. If you are experiencing verifiable hardship you should contact us immediately as we may be able to set yo an affordable arrangement with you depending on your circumstances. We would strongly recommend the you DO NOT IGNORE this letter, but telephone our offices as soon as ****inle between the hours of 8:00am to 8:30pm weekdays and 9:00am until 2:00pm on Saturdays. Yours faithfully, REGAL CREDIT CONSULTANTS LIMITED ---- Now i am not sure where to go with this as the debt is now 8 years old? "As our Client has already obtained Legal Judgement for this account" This bit threw me i guess that Northumbrian Water took it to court previously before the amount was amended but where does that lie me? Can they force a CCJ that has been applied from so far back or for a different amount? I am at a stick atm and not sure what to do any advice would be greatly helpful to me. Thank you.

As in my thread title Northumbrian Water is taking they arrears direct from my JSA which I don't mind as I had fell behind on payments over the Xmas period and they could not come to some sort of arrangement barring this. Anywho what I was wondering is i owe them £150.68 my payments start on the 4th Feb and go to April 13th at £8.19 and then payment start's from the 14th of April to 20th October at £8.34 (guessing that is due to the increase in JSA).... When I added the total of payments comes up to £305.41, does this mean i am paying toward's 2012-2013s bill while paying my arrears off? I have contacted Northumbrian Water but on there system it is only showing as the scheme is set up till April 13th. Also contacted JSA but waiting for a call back from this afternoon (lol) as the lady didn't understand as it was showing that i was paying the arrears off at 2-3 quid a week (Not 100% sure how much she said on the phone) but the deductions were at £8.19 and £8.34. They should make these letters more clearer as i have not got a clue on how it works. Thanks for any help that is provided.
  7. Ok i recieved a letter this morning from Alexander Jame's Debt Recovery Specialists (Which is part of Northumbrian Water). I said -: Thank you for your letter which was recieved in out customer contact centre on 14 September 2011. The documentary evidence has been accepted. Your accounds have been amended accordingly. You will shorty reciev a final bills totalling £705.00. You have stated that when you receive you amended bill you will make the necessary arrangements to pay you water service charge's. (No i didn't) I look forward yo receiving your payment proposal. Ok so what's my next move? I think with my reckoning out that i think that is only the charge's that i was took to court for... They is also another problem i have a difrrent account with northumbrian water since i moved to my new addess which iss fully up to date can they legally just add that account to my new account? Cheer's.
  8. Ok i have sent the latter proving that i lived in that address till Jan 2005, still waiting on a reply. I was reading the statue barred letter and read this line in it ... The last payment of this alleged debt was made over six years ago and no further acknowledgement or payment has been made since that time. Unless you can provide evidence of payment or written contact from us in the relevant period under Section 5 of the Limitation Act, we suggest that you are no longer able to take any court action against us to recover the alleged amount claimed. Wirth me sending that letter does that mean i have acknowledged it?
  9. Ok so i'll send the proff that i moved out of the property jan 3rd 2005 then once the get back to me send a statute barred letter for that part as it's over 6 year's old debt. The court one i'll take your advice and see what happen's, and if they try to re-enforce it i'll as for the info you told me. Thank you very much you have been a great help !
  10. So the court order stand's for nothing basically they can't just send in the balliff's? So will i have to send proof that i moved out of the property first before i claim that the amount outstand minus the one that was took to court for the peroid of 20th march to august 2004?

  12. Been to the council and found out that the actual date i moved out was 3rd of Jan 2005 so its a year less that i thought it was... So it will be even less as the lady said they applyed to court in august 2004 for the 700 bill then they is only a few months to be added.
  13. Ok here goes my long story. I moved to my old address in March 20th 2000.... And moved out of that property to my current porperty on the 23rd December. My current propertys' water bill is fully up to date. Now my old property i stupidly never paid any water rate's while living there (i was a stupid young 18 year old and wanted to waste my money on beer), i i recieved a letter from Northumbrian water saying i owe them £1,868.76 for the period ending 04-JAN-11... Which ofcourse is incorrect. I am not disputing i don't owe the money so i rang them up to explain that i moved out of that property on the 23rd of December then i am told i need to get some prove that i moved out of there on that date, go to the council and get a closing council tax bill. While on the phone she also explained that i had been took to court for a sum of around £700 in 2004... I didn't even know that this had been done. So where do i stand this bill is nearly 6 year's old and the £700 court one is 7 year's old, i don't dispute that i owe the money... What can happen to the bill that has already been took to court, can that be defered straight to the balliff's? Just need some help, also the figure's don't really add up that i would owe over £1000 for 4 year's of living there.. . Anything i can do to find out what i actually owe and from when and till. Thank's.
  14. Same drivel that is being tryed on me fropm Philip's Baliffs they seem to be the new boy's in town and there letter head is very misleading as they are only collecting as any other DCA can. Also as the debt is practically SB your name will have been pulled up from a phising list hoping for you to pay. The advice i was given was just to ignore them and not let them know i am intrested (which i took) i have had some one at my door posting letter 4 and am awaitin for the next monkey to knock so i can politely ask him/her to removed themselves from my property. I am sure more people will give you some advice and if you type in philip's in to the search bar you will find they are trying it on alot latley. Also the advice i received was to report then to TS via Consumer Direct as the word baliff should not be used while trying to claim common debt as a DCA.   15. Already on to letter 4 hand delivered haha....However the letter head did get me worried for a min or 2 till i read the solicitors bit lol... Guess i should send a don't turn up on my doorstep letter but these monkey's have had enough of my time !
  16. Well i went to order my Credit Report online and found out that i can't sue someone else's credit/debit card as it has to be under your name and adress as i dont have my own bank account tryed to use my dad's. Is they any other way i can order my credt report?
  17. Should be free to be able to access your Credit Report but oh well i best check it out and see what is against me, has anyone ever used the 30 day trial before on one of the big three?   18. Thank's only problem with that is it's not instant an dhave to wwait 5 days for your passkey...And i dont want to sign up with the big three as i have read horror storys that they keep your card detail's and it can be a pain to cancel
  19. Yeah thank's i understand what you mean. I have already had a hand delivered letter and personally it does not bother me to tell them to get bend and get off my property just ofc i don't ant that to happen if i have people around my home for them to see it. Just i am not actually sure if i owe this debt as i can't remember it so i don't know if it is worth sending the letter's. I prob's think it maybe worth checking my credit report to see what is against me...Is creditexpert a good one to use as it is currenlty first 30 days for free and then i can cancel before i get charged?   21. If i had a CCJ impossed surely i would have been contacted within these 5 and a half years i have lived at my current address? Edit-: After reading through my 2nd letter i noticed this in a papagraph If you ignore this demand for payment or fail to arrange a suitable repayment plan withn in seven days, Philips reserves the right to instruct our solicitors to recover the amounts outstanding on behalf of our client, or alternatively issue this case to one of our debt recovery agents to attend your premises to execute further recovery procedures. So i guess that it's all scare tactic's?
  22. I moved home about 5 year's ago so dunno if that they would have sent to my old address? Also it's been with another DCA so if it had a CCJ against it they would have claimed agaisnt it?
  23. So i am guessing that's the top letter that HB told me to send? I expect the same tbh lol Yeah i understand now thank's for clearing that up so they is no way they have a CCJ against me as i have never received anything (put's my mind at ease). So all they can do it try and scaremonger me in to paying like any other DCA.
