  1. Hi Emmzzi, As far as I know she hasn’t submitted a grievance before, she was going to submit one today as she received a letter inviting her to a meeting which is to discuss making her redundant (I thought the process had been completed), however I advised her to hold fire until I came onto the forum as I’m not sure whether it would be a good idea for her to do so before they have completed the redundancy process, She said she has emails which can prove she is being discriminated against.

Hi, My friend was being bullied by a manager who kept saying that anonymous people were complaining about her, she is asian and the minority where she works, she raised concerns in her meeting that she felt it had something to do with her race and gets treated differently to the rest of her colleagues due to off the cuff comments previously made and was told by her manager that as a minority she has to prove herself more as a minority in life and thats unfortunately the way it is. Following on from this they’re were more anonymous complaints all revolving around her attitude when speaking to the anonymous individual(s), she then had a meeting with hr initiated by her managwe and expressed her concerns, no outcome was given as the hr person said it was informal and a week later she has been told that she is being made redundant, my question is there were no specific incidents mentioned and my friend is still confused exactly how this came about but suspects it’s her manager who has taken a disliking to her, is this lawful?
  3. Hi, Thanks for the reply. It was in lieu, I guess I called it failed probabation as I was told that I could be dismissed due to being on probabation. It was strange as the feedback was really positive but the conpany said they don’t have enough money coming and and can’t justify keeping my role going, yet they hired a new employee two days prior (in a different role)
  4. Hi All, I wanted to find out if an employee can be dismissed on the spot during probabation because the company is not doing well financially even of their performance is good.
  5. Hi Guys, I have a default placed on my account but did not receive a default notice for. I am currently paying back the outstanding amount to British gas, however the problem is that I didn't receive a default notice from British Gas and I have been told two different reasons for the account defaulting. One was for late payment in 2014 and the other was for leaving an outstanding balance on my account when moving last year. I asked British Gas to send me the original default notice that was sent to me however they said that a letter was sent out in August 2014 indicating that a default may be placed on the account and cannot send this too me, but when I look on my Experian Report the default was registered in June 2014 which would be before any letter was received. Please could you help me out Thanks in Advance
  6. Hi All, I had a default from advanced payment solutions and I was told that the default notice was sent via email which I didn't receive so I am guessing it went into my junk box. I have tried to have it removed but was told that it was legally put onto my credit file. My questions are: 1. Is there anyway that I can get this default removed? 2. If I pay of the debt which is around £30 will this improve my credit file and will that prolong the date that it will drop off of my account as it is due to drop off in two years. Thanks in Advance for your help
  7. I have one debt to which is with shop direct, this is 4 years old. I have written for a SAR and the result ended in them saying they would not enforce it, however it would stay on my file for 6 years. Another debt is with 02 which I have been paying off in instalments which will be six years old next month and another was originally with shop direct also sold to lowell which I have not been paying.
  8. Thank you for your message, I have another outstanding debt that I am already repaying to a debt collection agency which is coming up to being 6 years old. Because I stated to repay does that mean the 6 years started again?
  9. Hi, I really need some advice. I am ashamed to say that I have 3 defaults on my credit profile due to taking out credit when I was younger that I could not pay back for 2 0f the debts are over 6 years old and 1 5 years. I am now in a position where I can start paying back some money. I would like to know whether once I have paid back all of the money will I be able to get the defaults removed from profile or will the default stay on my account 6 years after I have paid the outstanding balance. I did try to appeal one of the outstanding amounts previously as I have a balance off 25 pounds which Littlewoods added over 100 pounds of charges too but they would not take the charges off. Also any advice on how to improve my credit rating would be much appreciated. Thank you in advance

Hi Guys, I have been having alot of problems at work it started when an collegue became very agressive with me at work and pushed me, I put in a grievance and it caused me alot of problems, I was off for months and when there hearing came around it was in my favour, she then done a counter claim and it was not in her favour it was suggested that mediation take place to which she refused so the company said there was nothing that they could do and offered me a compromised agreement to leave, which I refused. Since this time I have had nothing but trouble upon my return to work my collegue threatened to hand in her resignation (this is a small company) which made it very hard for me, certain individuals stopped talking to me including senior management. I no longer get invites to work events such as the christmas parties, i even get blamed for errors that have not been done by myself. I have overbearing supervision which never happened before and negative reviews in which the company paint me in a negative light. When I do voice my opinion I get told that I am wrong and there is always a reason for everything, i.e a breakdown in communication even inregards to not being invited to the xmas party I was told that the database must have missed me . My manager has also raised concerns as to how the company have been treated me and I have a feeling that they are going to offer me a compromised agreement, when they offered this before it was just over £1000 which I don't feel is enough for the way they have treated me. I am wondering if there are any other options for me maybe there are grounds for a tribunal claim, if so how would I go about it would I have to write some sort of letter to my employers and communicate this with them? Also should I hand in my resignation. Thank you in advance
  11. Hi everyone, I have been having alot of problems at work for around a year and a half and in March I was verbally abused by my work collegue whom also pushed me. I put a grievance in following which was upheld, yet I have still been kept off of work for a month so far until the situation is sorted, for my own safety yet the other individual is still at work. I have been treated differently and even the manager has been treating me badly she doesnt even talk to me anymore as she is very good friends with the other individual and it is a small company. I have told my manager previously about other situations and she just laughs about it. I even put in a complaint previously about the way that I am treated at work which was simply ignored. I was off of work for months due to this, although the other party involved put in a counter grievance and it was held that part of hers was also upheld (in that I had been hostile towards her) which is true although this is because of the treatment that I had received. I had since asked for the minutes and was told that I could not get them due to confidentiality. It was suggested that mediation should be taken in order to give the company feedback to which I agreed and the other party didnt. As this was not agreed to I said that I was not willing to go back to the workplace until mediation was sort as my workplace should be made safe. Although they said mediation was no longer an option as the other party was not willing. One of the board members suggested that I should just go back and see how it goes and that in his opinion we should both with draw our grievances. As this was not a option I have now been offered a compromise agreement. I did ask the individual who proposed this offer if there was any other option and she said no. I replied saying that I am not willing to take the offer and would just like to return to work in which she said that due to the tension it is not appropriate for me to return as there is tension and it is difficult to find a way forward. Thus in order to move forward I should give a indication of what I feel to be a fair monetry settlement. After stating that this would constitute to unfair dismissal as I was not will to agree to this they let me back to work. No mediation took place I have basically gone back into the same situation. I have now been back for around 5 months and it is very hostile within the workplace to the point where certain members of staff no longer talk to me including the owner of the company. Since being back I have even had a member of the management team supervising me every day I am at work which I feel to be very overbearing I have even made a complaint about it but she said she is just seeing how the company works I also said about staff being very hostile towards me to which she said it is to be expected, I also had a supervision meeting in which the manager whom has been watching me every week told my supervisor to tell me that I am very withdrawn and sullen. My supervisor made it clear to me that she does not agree although the manager said if she didnt tell me this then the manager would have to. I do not feel as though I am I make an effort to talk to everyone even more so as I do not want there to be any cause for complaints, this is just to name some of what is going on but also I have not been invited to the Christmas party I would like to know if there is any action that I could take against the company.

Hi Guys, I have been having trouble with littlewoods for quite some time I have sent numerous letter requesting my CCA and keep getting blank ones back, the whole reason I wanted my details was because I had late charges that I wanted to request were refunded although as I did not get the information that I requested I could not do so. To cut a long story short I sent them this letter: Re: my request under the Consumer Credit Act 1974 Thank you for your recent letter sent to me, the contents of which are noted. I appreciate your quick response to my original letter. However, the reply received by me does not fulfil your requirements under the Consumer Credit Act 1974. The Act demands that I be supplied with a true copy of any properly executed credit agreement that exists in relation to the above account. I may ask for this on demand providing that a fee of £1.00 is paid. This fee was sent with my original letter. My request remains outstanding. The items you sent in your reply, does not constitute a true copy of any credit agreement that may or may not have been signed by me on the opening of this account. It neither confirms that I am liable for any alleged debt to you, nor gives me any chance to evaluate whether any original agreement was ‘properly executed’. I still require you to send me a true copy of the original credit agreement that you allege exists. As you will know, under the Consumer Credit Act 1974, a judge is not permitted to make any enforcement order unless the creditor can provide a true signed copy of the original credit agreement. This means that unless you can produce such an agreement, this alleged debt is not enforceable in law. You had until _______ to provide me with the true copy I requested. You are now in default of my request. Any account I hold with you is now in legal dispute. Whilst the account remains in dispute, you are not permitted to ask for any payment, nor am I obliged to offer any payment to you. Furthermore, whilst the dispute remains, you are not entitled to charge any intereston the account, nor make any further charges to the account. Additionally, you are not entitled to register any information on this account with any credit reference agency. To register information with a credit reference agency, you must have written consent from the customer to collate and share such information. This consent is given in the form of a signed credit agreement, so until you produce such an agreement, you may not do this. The requirement for consent to share data is a clear requirement of the Data Protection Act 1998. any such attempts to share my data without my consent will be met with a complaint to the Information Commissioners Office To sum up, I will not be making any further payments to you until you provide me with the document I have requested. Whilst you remain in default of my request, you are not permitted to take any action against this account. This includes adding further charges and passing any information to the credit reference agencies. If you intend to send a reconstituted copy of the CCA you must declare the reason why it has been reconstituted and if the original exists and in what form (microfiche) etc. Should you not have any signed credit agreement in relation to this alleged debt, please confirm this in writing to me. I look forward to your reply. To which I received no reply I also checked my credit file today and the default is still marked on my file! Please help Thanks in advance xxx
