Thanks for your replies. Well, I've tested it to see if the video quality was up to scratch as noted above, decided it wasnt so have now sent it back. Havent gone on holiday or anything with it :)I accept that it has to be returned at my cost and thats no problem.

Hi. Under distance selling regulations there is a part about the customer being able to examine the goods as they would in a shop.I bought a video camera over the internet, opened it, tested it around the house for its capabilities, decided it wasnt suitable and emailed to send it back.The T&C on the website say"You can cancel your order and return it to us within 14 days of the purchase date if it is in its original condition, completely unused, and suitable for resale."If I bought it in a shop I would have tested it as I have at home yet the above appears to tell me I shouldnt have even opened it to examine and test it. So, its in its original condition (apart from the battery is charged), suitabel for resale but its not completely unused. Surely they cannot say that under DSRs?So, what i'm asking is under DSRs what does examine mean and is that an unfair term on their website if they enforce it?Thanks for any help.

First you said you downloaded it and deleted it because you didnt like it. Then you changed the story to you downloaded it then bought it. You're sticking to the second story now but either way it's irrelevant. While you were downloading you were also uploading and that's what they're interested in. Whether you own the works or not is of no consequence to them. You didnt own the works so should not have been uploading it. Either way they have an admission from you.

I'd suggest reading whats been posted many times on this thread about what to do after a 2nd letter. TBH i'm fed up of repeating the same thing to people who wont do a bit of work themselves and read the thread.

So why admit on the phone to those chasing you, and on here that you downloaded it then deleted it only to change the story later? Dont think you have a leg to stand on to be honest.

Dont worry, dont get upset. They've yet to take court action. Send your letter of denial (you can find details on what to put in this on this thread), stating your position and leave it at that. It's likely they'll reply saying it is an invalid reply but that's rubbish. As long as you apply the template to your circumstances then they have no comeback. As I say, send one response and leave it at that.

Follow what it says in the SIH, adding that if they cannot provide evidence they should desist from contacting you again and any further correspondence not offering this evidence will be ignored. One letter to them stating your position will suffice, do not get into letter tennis and do not give them any more info than you need to.
