  1. I am currently challenging a claim against my brother in laws estate. As far as we are concerned, the debt would've been statute barred before his death. We've had a screen print of a call that was supposedly made by my late brother in law in 2007 but all it requests is that no more mail be sent to the address. There is no mention of the debt.
  2. I know that a payment constitutes as an acknowledgement of a debt but what else specifically constitutes as an acknowledgement of debt? Does the acknowledgement have to come from the debtor or can it come from somebody else? Does the acknowledgement have to be in writing or can it be verbal? Thanks in advance Blackchilliman
  3. It's Phillips & Cohen. His widow has now received another letter today from them regarding another account! We did pay the debts of the estate at the time but I don't think we placed a notice Whilst I think the debts are statute barred, is there a six month limit, after the granting of probate, for claims against an estate, or is this negated by the fact we didn't place a notice? Thanks for your reply.
  4. Thanks DX but i'm not sure what you mean? No, they may not be solicitors but surely, they have solicitors that can issue proceeding or take further action etc? Would they be aware of the money within the estate- (they do know my friend is dead) Regards BCM
  5. Hi, My friend died a couple of years ago and I am one of the administrators of the estate. The debts we knew about were repaid from some life insurance and the balance went to his widow. His widow has now received a phone call, chasing a debt of which we have no knowledge. How would you suggest we proceed or should we ignore it? Should we contact them and ask them for full details of the alleged debt? If so, would you suggest we write or call? Is the debt still enforceable if they dont have a copy of the CCA?- The DRA is Phillips & Cohen. We believe the debt would more than likely be statute barred, however, we don't know whether a CCJ has ever been made. Am i right in saying that if a CCJ has been made, the debt could still be enforceable, even after the six years? Any advice, gratefully received.
  6. Hi, this is complicated! I work at a call centre that provides call centre services to the local NHS. Unfortunately, the contract has been terminated by the NHS PCT and our employment contracts are due to be transferred to the NHS PCT. Once we have been transferred, the PCT will decide whether we are needed. If not, we will be made redundant. The twist is that company that I currently work for has just won a contract to provide the same, call centre services to a different area in the country. Now, the company will have to employ people in the new area to fulfil the contract. Due to the call centre technology, it would be perfectly possible for the company to fulfil the new contract from the existing location. Therefore could myself and my colleagues refuse to be transferred to the NHS and provide call handling services to the new area, from the current location. Phew! Thanks in anticipation!
  7. Hi, I am the co executor of my brother in laws will and somebody has made a claim against the estate. The claimant used a solicitor to trace my (as the executor) details and the solicitor sent me a letter. For this, the solicitor charged the claimant £150 which he is in turn claiming from the estate. There is no dispute in relation to the claim, however, is the estate liable for the solicitors cost as the claim, had it gone to court would've been dealt with under the terms of a "small claim" and therefore the claimant wouldn't have been able to claim legal fees. I'd be grateful for some advice- Just trying to save my sister some money
  8. Hi- In both 2005 and 2006 I received a penalty notice for non payment of car tax. Both times, I paid the fine and it was marked as an out of court settlement. I am now applying to join the police and need to declare all previous convictions. Would this be deemed a conviction?
  9. Me too!- I've also had a dormant card for about 9 months but still wanted to keep it!
