  1. Really enjoyed this thread so far! Oh how I wish they would stop ringing or I was able to answer the phone calls and make them suffer...alas i usually get quite upset so I tend to avoid the calls because I know I don't have enough knowledge to back me up. Does anybody know of a thread that might have useful information and witty ways for those who might just want to brave taking them on?

Oh okay, I haven't seen it Slick, all I have picked up on is that signed copy is important and most have not received it only a copy of an agreement such as here...so actually if they do have it they can play that card when they want. Right well I will send off charges list and prelim letter, but can you advise me of which figures goes first? i.e.You have taken £XXXX would that be the initial charges total for x period, then the interest on that ie 29.9% and then the total of both?

  5. Well i received a letter from Barclays... They have conveniently drummed up the missing letter they mentioned in previous correspondance on which I questioned them on as not receiving, and also mention that I was informed that I could opt out in such and such letters...which actually is true now I look at those letters saying that I am over drawn. However, what they also say in these letters is that I WILL BE Charged fees if over the agreed overdraft amount! So, they are telling me that even though I put the account back under the limit, and their charges took me over again, even though I asked them to hold off on charging due to my financial difficulties, the misappropriation of my benefits they have totally ignored and still continue to add charges knowing that even if I had opted out I would still be charged! I feel screwed! They also state that this is their final response and will not enter into further correspondence on this matter..cheeky buggers and have palmed me off with FOS. Which I will get around to doing when I have a peaceful moment! But what use is this if they are funded by the financial sector anyway? Doubly screwed! I have attached copies minus personal details of the letters, regardless of them stating that they will not enter any more correspondence on this matter. Should I just file with FOS or write back to them based on what I wrote above? Lastly, when I started this thread I was under the impression that I was claiming back charges which had been misappropriated and threatened them with court, that seems to have gone out the window. These charges are outrageous, can I not claim them back because they are unfair like with BC? Or do I have to claim them back because of hardship? I feel really stuck in a loop at the moment and all advice would be appreciated.
  6. Hi slick I have logged all the charges and I was going to send off the prelim letter, but needed to change the rate to what was on the statements as you say is at APR 29.9% on the excel sheet. Now as this is over 10 years the rate has changed. E.g. in Sept 2001 the APR rate was 21.3%, in Feb 2002 the APR was 20.8%, it then goes up and up to finally last month was 27.9%. Whilst looking how to calculate I came across a thread with Fenris who is experiencing almost exactly the same which is good, in one way but still confused still on how to work out the interest to put at the top especially as a compound interest calulator has entered the equation! So, two questions if you don't mind answering. 1. With the differences would I do an average, or do I have to physically work out each one? Or is this where the compound interest calculator comes in? 2. How do you enter the figures on the prelim letter? I calculate that in respect to Account:you have taken £XXXXX (which figure goes here) plus £XXX (which figure goes here) which you have charged me in interest for the sums which you have taken. Total £XXXXX (which figure goes here) Would like to get this off today so advice would be appreciated, as I have received correspondance from BC in regards to my letter, re harassment and no true copy of agreement, bog standard by the look of it...re section 78

  8. Well best of luck Dotty! If I had known all this some time ago I wouldn't have accepted the figure of on another account after they added "additons" package without my consent...totalled to over £450 think I got £117. Still have letter and rough figures of working out but that's another story! Damn Banks I actually am beginning to hate them...they never let up with their harassment and when they don't want to talk they write and say "we will not enter into any further correspondence"
  9. I should say so that's that card paid off and they owe me money! Right to the next lol In all seriousness, am I in reality looking at the charges being returned i.e what was actually taken and only if they don't I fill a claim and then I would go for the top figure?
  10. Going through statements and before 2001 I was not charged once for late payment or exceeding the credit balance. Now I know I missed payments even says on statements no payment made yet no charge and certainly no over limit charge singled out but the miniumum payment went up as a result and the interest charge changed too. Did they calculate it different back then, like increase the interest charge to cover? If so I guess I can't claim anything back beyond middle of 2001 if it's not on the statements. Another thing...thanks for the better sheet less complicated, however, the apr rate should it be 29.90%? Makes me feel like I will be claiming thousands and I have only put in two dates so far and we are up to £300 Huh? Would love to hope
  11. Thank You Slick for your speedy response. Firstly, the year is 2005/6. Yes I did manage to get a refund on occassions those were the days I had some balls and kicked up a stink, however I turned into a pussy over the years especially as it's become a lot harder to do as they are absolutely adamant. FAP are yes I remember that. They got me on that one. They called me and said I had a free month. I miss understood it how it work I thought it would end after that month and if I wanted it to continue, I had to contacted them, but they had it the other way around...It was a time when I didnt check my statements that often, opened and filled then one day I noticed this FAP and thought what is this for? I rang them and asked for the money back as I didn't sign to have this. They claimed I had accepted over the phone and it was my responsibilty to cancel it after that free period. It got cancelled there and then but no recourse on the money that was wasted each month...I now except nothing over the phone! As for Card protection, actually it has come in handy...my business card got stolen and they dealt with it immediately. I think I even lost a whole load of cards and they dealt with that too but your right it may well be just as quick to do it myself
  12. Just thought I would mention I have read the link Slick in your signiture you suggested but I really don't understand it...plus being that it's a Natwest statement it's layed out differently. Can anyone help me find an example of what I should claim for, I have looked through the forum to no avail as yet no one has come back with an idea which ones from the list would be candidates.
  13. Slick or anyone else who maybe able to help. I think my brain has turned into mush Arrrgh...I have finished filing and getting the accounts into year order back to 1995. I have been looking over all my bc and mc statements right back to determine what I should be claiming back. Here's examples that I have found, can someone tell me which ones I can claim back on: Late payment charge Cash Interest charge Cash Balance (no percentage lump sum taken) Interest Charge Standard Balance (no percentage lump sum taken) Interest Charge Default Sum Balance (these top four all on the last one!) Interest on Your Cash Balance Interest 2.075% Interest on Your Standard balance 1.667% Over credit limit Charge Interest Charged Cash/Cheque Handling Fee Handling Charge Over Credit Limit Refund Exceeded Limit B card Fap (?) every month Card Membership renewal Oh last thing, I could not find a year and a half of statements on one bc and a few on mc for a particular year which happens to be the year I started my business. I think my ex husband has nabbed this for what ever reason (info I guess) I presume I will need to gain that year from BC do I send off a certain amount of money and they give last 6 years or do you specify what years you want? Right I am trying to keep awake but failing... Oh by the way I had card protection up until few months ago of which payment used to come off BC course they have not renewed it. Is that another thing I should concern myself with? Cheers peeps
  14. has anyone had experience with opting out of reserve when in it with Barclays bank? have dispute about mis-appropriation of benefits going on with Barclays and trying to reclaim my charges (which are going up every week) They now tell me months later I should have opted out in order not to incur any more charges...well I am still fighting it but if I opt out whilst in reserve does anyone know whether I will be charged another fee?

  17. Help me please!!! I have been away for the last week, my boyfriend took me away before I had a nervous breakdown. During this week Resolvecall called again (my son didn't answer the door) and today they actually came again and left a letter. They do visit more than once! I am so sick of being harrassed by these people for only a couple of hundred pounds! I just lost the plot I am afraid, I stormed outside and gave him the prepared letter and he kept shouting to me is this you...and I said I had nothing to say to him. He sat in his car intimidating me for over 10 mins, he's gone now but I am getting to the point of wanting to just run away! I can't even go in my front garden to mow the lawn! I am trying to work just to put food on the table and I can't because of the pressure is clouding my brain...let alone looking through the statements to see what penalty charges that have accrued. What can I do? They ignore my letters...I have asked for the agreement but what use is it?
  18. I have almost everyone from when I got my cards! So I guess now I look through them all look for penalty charges and start adding up using the same form as for Bank charges. Is that correct and send them to BC requesting they give them back. Is there a standard letter format?

  20. Right, think I got you both. So what you saying they are not going to refund the charges? Even though they could clearly see that it was a council cheque that went in to my account every few weeks, failing that if I didn't put a cheque but put cash instead from cashing the cheques (i have all the receipts) in order too get it in the bank early to avoid their charges its not taken into consideration any more? I wonder what the point in putting in a claim in the first place if it was an empty exercise... And I have changed my bank, I have new accounts since feb. My council cheques go in there now.
  21. No to be honest, haven't got around to that, just had a glance the other day when I was filing some new ones received. How far back do I go? From when I couldn't pay the monthly repayment few months back or further back to when I was I started getting the benefit? which was 2008.
  22. Not from HO directly (London) which is where I sent the letter off to. The responses came from BB Consumer Finance Manchester and Retail Customer Relations Leicester.

UPDATE: RE: My letter requesting true copies of the credit agreements sent 2nd June 2010 to Mercier. 3rd June received another letter from Mercier. 10th June 2010 received one letter containing two letters for both accounts from Barclaycard dated 8 June 2010, plus photocopied agreements, no name on it nor my signiture, plus noticed the envelopes never have a post mark on them??? "Dear ... Reference: SECTION 78 of the Consumer Credit Act 1974 I write further to your letter requesting a copy of your executed agreement for the above account. The Information we must provide to you under the terms of Section 78 is prescribed by the Consumer Credit Act 1974 and by the Consumer Credit (Cancellation Notices and Copies of Documents) Regulations 1983. Under Section 78, we must supply you with a copy of your execused agreement and a statement of account which is practicable to refer. * The current credit limit on your account is £### * The current balance on your account today is £### * The next minimum payment of £### is due on ##/##/## Please note, a copy of your current Barclaycard Credit Agreement will be sent under a separate Cover. With reference to Civil Procedure Rules (the "CPR"). We have provided you with sufficient information to allow you to understand our position. The CPR does not conder an automatic entitlement to documents before proceedings start. CPR 31.16 provides that a party may apply to the court for pre-action disclosure in certain limited circumstances, which do not appy here. Letter (as stated in last letter) Barclaycard Terms and condtions but for one card only, the other arrived this morning dated the same day??? Lastly received another letter on 12th from resolvecall dated 10th June 2010 acting on behalf of Merciers this letter suggests that once again a representative will make a personal visit to collect payment. Monday 15th June 10am...a suited man (no jacket) rings my doorbell then when he doesn't get a response uses the knocker and continues to knock my door for 5 mins, I don't open because I am not dressed as I had a destressing night but looks out of window and sees when he can't get a response from door sits in his BMW noting something down and continuing to look back at my house. He eventually leaves... I have prepared letters as suggested in case of his return. So, what do I do next? They are now making visits and the letter suggests actually they don't have to do anything else...I had a look at my statements and the interest is horrendous! Should I start logging this interest as I have done for my personal bank account as the money I had by DD also came from my benefits for the most part? appreciate the help...Leilani

UPDATE: Response letters received after sending complaint to Barclays HO sent 25th May 2010 1st Letter received 3rd June 2010 please note this is the first ever correspondence I have had from Barclays. "Dear ... We are sorry you have had to contact us about the level of service you have received from Barclays. Thank you for taking the time and trouble to do so. We are looking into your concerns and will let you have an answer or udate as quickly as possible, but no later than 24th June 2010. In the mean time if you wish to discuss this matter further please call us.... I enclosed a leaflet explainhin how Barclays works to resolve complaints. I hopeyou find this useful. Yours sincerely" 2nd Letter recieved 10th June 2010 "Dear... I am writing further to our letter dated 1 June 2010 in relation to your financial difficulty claim. Please accept my apologies for the delay in contacting you. Our previous letter advised you that your complaint regarding bank charged had not been upheld and as such no refund was being made. I can confirm that based on the information we/you have supplied, I wish to suggest the following measures to aid you: Your account shows that you have incurred fees, related to your reserve facility usage. It may be suitable to remove this feature to stop you incurring the GBP22.00 fee. Please visit your local branch or speak with our specialist team (Customer Review Team) on 0845 3000442. We also advise you to contact this department to arrange a repayment plan to help you reduce your overdraft balance. Finally you may wish to speak with an independent debt counsellling organisation whose details can be found below. ..... Please note that I have no further suggestions for you with regard to your claim. If you are unhappy with this, then I would refer you back to our previous letter which details what options you have available to you. Yours Sincerely." I have higlighted in red that they state they have sent me a letter previously???...they have never sent me a response to 3 of my letters which lead me to sending the fourth to the HO. Now what do I do they have totally ignored everything including the fact they have taken from my benefits!
