  1. Just to let you know it is finally over they have withdrew there fees can't imagine why lol Thankyou for your help and everybody else who gave great advice and support throughout this x

That is originally what i thought, but the bailiff she spoke to said that because son in law signed a payment plan now called a contract they are allowed to charge more and recover there fee's apparently it is a late default payment. I'm not sure whether this makes any difference or not. I just think personally they are trying it on. I asked my son in law to contact council tax and confirm the debt is settled and he has just been told the account is actually in credit and they owe him, but he will have to deal with the bailiffs over there charges.
  3. They have said they are late payment fees from what i can gather as they never paid them but paid the council direct. They ask him to sign a payment plan and then levied on my daughters car with the help of this site i managed to get the car removed from the levy, but they have never been inside the property to have levied on anything.
  4. Hi I really need abit of help again with this problem, my son in law paid council tax off directly to the council now the bailiffs have reared there ugly heads again. They are saying he owes the bailiffs company £75 in enforcement fees and if he doesn't pay they will come with a locksmith and enter the property. Thanks to all your help I now know this is a load of but can bailiffs just add and collect on there own fees, any help would be gladly received as they are meant to be coming today
  5. Brilliant thankyou for your help. Should i inform SW that i am going to do these forms or will the courts inform them i have done this. In Q10 should i mention that i have filed for a variation order and then state about the extortionate fees sherforce are trying to charge me on top. Will the courts inform sherforce if i get a stay of execution or will i need to, I just don't really want to have to speak to him again. Thanks again for your help
  6. I was aware of it last yr and i really should have done something about it, but as i owed a council tax debt that took priority and all my spare money i did nothing about the water debt. Very stupid in hindsight i know I finally finished paying my council tax debt last month and i have tried to offer southern water a payment plan however they say that there is nothing they can do now, and i have to try and negotiate with sherforce. I wont allow them entry under any circumstances i just feel that there won't be a end to all this money they are adding.

Hi i have a ccj with southern water for 1200, this has been passed to sherforce who have been out once but not gained entry, and sent a letter stating they are coming to remove goods for these 2 things they have charged £2000 with a threat of at least another £720+vat when they attend again is there anything i can do to stop these people from doing this. Any help would be greatfully received
  8. Hi everyone I am hoping someone can give me some advice please. I have a ccj with southern water for £1200 from last year I know I should have got this sorted before it escalated to this however as I was already paying a council tax debt that took priority and I honestly wanted to clear that which as of last week i finally have done. I struggled to pay my council tax bill at the rate they requested and with the added water bill payment on top it was impossible to keep up so i missed a few payments and I stupidily put this debt on the back burner . However yesterday a HCEO called to say he was here to collect the debt which is now with charges added £2267 I did tell him that theres no way i have that kind of money and he said i would have to get it as he will be back to collect in full or remove my goods although i never let him in. I wondered if there is any way i could get southern water to take the debt back from him although they have said the debt is now with an outside agency and to deal with them. I am unable to pay the original £1200 bill in full never mind the added charges on top, I honestly don't know what to do next so any advice would be very gratefully received.

Hi the levy was supposedly done on the 10th may 2011 the car was clamped on the 8th may 2012 although there was definately no notice of seizure left last year when the levy was meant to have been done otherwise we would have disputed it then. He made a payment of £240 the 1st time the bailiff came out, then paid 5 monthly payments of £120 although from what i can gather he then stopped paying the bailiffs as he assumed he had paid it off as the council tax bill was £481, unfortunately it turns out most of the payments went to bailiff charges not to the council so the debt wasn't cleared and now this happened. There is still £216 owed to the council however he's going to pay that direct to them at the end of the month. The bailiff that clamped the car wrote down the reg number so i know from that they do have the reg number now.
  10. Ok i will remove that part of it, I was just hazarding a guess as this was levied upon as they will not release a copy of the levy without payment for it, and as they hadn't been in the property i assumed they had done it on the car. Is the rest of the letter ok with this bit removed?
  11. Hi I have just finished another email for R & R and wondered if someone would give it a once over and let me know if its ok please. I have found some good pointers on the councils codes of practice which i will be discussing with them this afternoon, but if you could let me know if this is ok for R & R i would really appreciate it. Also could i ask where is the refund most likely to come from the bailiffs or the council Thanks for all your help x Dear Sir Thankyou for your recent email. I have now had a chance to go through your company policies. however I cannot seem to find a policy with regards to placing a levy on another persons, Not the debtors property. I would appreciate it if you could therefore send me details as to where I can find your regulations/policies on this. I have also noted that receipts should be given when any money is received (All monies received either direct to the bailiff or by other means, will be officially receipted) please take note this has not been the case. I would like to point out at this time that you are not allowed to levy or remove goods that Do Not belong to the debtor in accordance with the council's own code of practice. I am willing to send you a copy of this if you are not familiar with it. I have also attatched a copy of the V5 for the car that the charges have been placed upon as you will see it is not my car and never has been my car. I haven't seen any policy from you that you are legally allowed to place a levy on goods that belong to another person. So therefore it appears the fee's I have been charged are unfounded and would therefore request a refund of all the charges on my account except the 1st and 2nd visit fee's totalling £42.50.   12. Well they definately don't practice their own codes thats for sure, I am sure I will be able to find alot of their codes that have been broken during this and ask if they would like to explain why. I have a funny feeling there might be a charge for their answers though lol

I get the feeling at the minute they think if they keep ignoring us we will go away, and maybe that is how they get away with treating some ppl like this, I know lots of ppl have probably sadly given in, and if i'm honest when i said i would put a stop to this to my daughter I wasn't a 100% sure what to do, but this site is amazing the advice and support is unbelievable it takes the dread out of the situation so i say onwards and upwards tomorrow they have had a week to reply and have done nothing. So I think its about time they gave out some answers

  15. Ok Thankyou, They do seem to be digging their heels in with the request of the levy, i'm starting to think they might be having trouble making one up. I will get back onto the council tomorrow, so far apart from them saying they have passed this on to the recovery team they haven't said anything else so this might give them a push in the right direction. Just a thought but shouldn't R & R's company policies be free of charge surely ppl have the right to see the policies of companies they are dealing with.

Hi I sent them one like that 1st and got back a basic breakdown with some very interesting dates and numbers, so I sent them the letter below Dear Sir Following your recent email with regards to a Breakdown of charges on the above account, I would be grateful if you would provide me with the following: A - A copy of the levy B - A copy of the bailiffs certificates C - Proof that the said bailiffs visited the property on the stated dates D - A copy of your company policies for when a bailiff has levied on a vehicle not belonging to the debtor I look forward to hearing from you. Yours Faithfully could I change the requests in the letter in your post to my requests in my letter, but keep the basis the same. Or is the fact i'm now asking for a copy of the levy and company policies the reason they can charge me. Thankyou for your help.

  19. No they have had no paperwork, even the other day when the car was clamped he said he would drop a receipt off for the £240 and he still hasn't. Thankfully they are able to prove the payments made because of his bank statements but that is all they have, oh and now an email regarding the breakdown charges. I have asked the council for a copy of everything to do with the bailiffs charges and any info regarding levies etc we're just waiting to hear back from them. Do you think it would be worthwhile asking the bailiffs to provide a copy of the levy whilst we are waiting for the council, I'm just not sure where to go from here at the min now
  20. the dates they have are dec 2010 1st visit, march 2011 2nd visit, 10th may 2011 levi etc (although the missing payment of £240 was made the last wk in april when the bailiff visited and demanded a payment within 24hrs then another payment £120 was made the following wk which was 6th may after the payment plan was set up) enforcement fee was 8th may 2012 I don't believe they came out in dec or march either as i do believe the vultures they are would have left something requesting money. I think the 1st visit was in april when they had to pay the £240 even though the bailiff company have decided to leave this visit out I am just glad they paid off a bank card so they can prove this money has been paid Would it be worth requesting a copy of the so called levy to see what happens or can they refuse to show them sort of things
  21. well i have just received a breakdown of the charges from the bailiffs and they are 1st visit- £24.50 2nd visit - £18.00 (both of which I do not believe happened on the dates stated) 3rd visit - would have been when the 1st letter regarding the debt was left and which i would believe more likely to be the 1st visit made as prior to this they had not made any form of contact, which i thought they would have done at there supposed 1st visit 4th visit - levy £40 walking possession £12 admin fee £24.50 card fee £3 5th visit - Enforcement fee £188 Well this has left me with even more questions, so any help as to where i am to direct the questions whether the council or the bailiffs would really be appreciated, Ok the 1st visit which would be there 3rd visit a payment was made of £240 no record of this is on there list of payments a payment plan was agreed and the following wk the 1st payment of £120 was made, apparently then 4 days later the levy etc was done, i'm not sure what levy they are talking about as they never entered the property and although the car was seen and mentioned they were told it wasn't his car. The payments made section then shows a payment for £120 the following mth £121.50 the following mth then no payment for Aug or sept although the council received the aug payment from them and he does have bank statements showing both the £120 payments going out, then the £240 payment from this week is at the bottom although on the charges it was only £188 so what the rest of that payment was for i'm totally unsure. I have asked my son in law to get bank statements to cover the whole period they have stated as this will show the original card payment aswell. So i'm wondering why was a levy put on the car even though it wasnt his and he had already paid £360 by then, the simple question as we have bank statements to prove this moneys been paid where has it gone as it isn't shown as received which is alarming, why was he charged £240 the other day and the charge is only shown as £188. Do you think this is something i should get the council to look into or respond directly to the bailiffs and question them further about the levy and charges missing payments? It isn't very often i am lost for words but i really am this is like legal robbery its totally appalling

Is the letter below ok to send to the council if you could read through it and let me know this would be a great help Dear Sir I am contacting you in regards to an outstanding council tax bill i have with you, which is currently being dealt with by Ross & Roberts Bailiffs. A bailiff visited my home address on the 8/5/2012. I was at work at the time and my partner gave him my number and said he should contact me. I then received a phone call from him demanding £456.15 which i did not have and i told him this. He then proceeded to clamp my partners car which is nothing to do with me (I have enclosed a copy of the V5 showing the car does not belong to me) He then refused to remove the clamp and stated he would have the car removed if i did not pay. I explained again that i did not have £456.15 and was unable to pay that amount of money. He then stated that if i wanted the car unclamped i would have to pay £240. I again explained the car was not mine but my partners and he was not allowed to clamp her car, he then stated once again he would have the car removed and i would have to pay the fees to recover the car aswell. Finally due to his constant aggressive manner and the refusal to remove the clamp I paid the £240 over the phone. He then informed me that the £240 was for charges not the debt and he would require a further payment next month. I have now paid hundreds in charges which seem to be extremely excessive, i would therefore like a complete detailed breakdown of my council tax account including the date it was passed to the bailiffs, the start balance, balance still owing and any payments received, along with a detailed breakdown of all the charges the bailiffs have charged me, what they are for including dates, times of visits any levies etc Due to the fact the bailiff was extremely rude and aggressive, clamped a car that he was informed did not belong to me I will no longer pay any money to them and will make payments directly to you. I will also be looking at a full reimbursment for any fees i have been unlawfully charged I look forward to hearing from soon. Yours Faithfully
