  1. sorry Martin I realise you recommend a letter befor action - where can I find a template for this on the site? Also what are the ramifications if they dont come thru with the info - is the debt itself affected?
  2. Thanks again for your advice Martin. Do you think its an idea to let Natwest know that their response is unacceptable and that I am now making complaints/taking them to court? GIB

So I sent the letter explaining that they had not conformed with my SAR and they just sent me aleter thanking me for my complaint and that they would now investigate and it will take eight weeks to reply. I didnt make a complaint I merely pointed out in great detail what they had failed to supply me with. Classic time wasting tactics obviously! What do you think I should do next? Best as always GIB
  4. Hi, We have had correpsondence but this is the first time Ive received any data. I wanted all my statements to check bank charges and also I need the statements from 08/09 to prepare a tax return. I no longer run the account with the bank ut they are pursuing me for money owed on overdraft and charge card. GIB
  5. As detailed in other threads in the debt forum I made an SAR back in April and for one reason and another which i wont bore you with I only received the data from the bank on Friday last. I have been with the bank since 1997 and requested all of the data including all copy statements and used a template from the forum. I was astounded to see just a handful of statements from various years but not numbering more than 5 pages. I also got copies of letters I sent them - I am really angry and fed up and realise they are just doing this to put me off but could you please advise me of my next move options? I initially sent them stiff letters (again from the forum) when they started messing arond with not wanting to send to my address as they couldnt verify it or that my sig was not the same as the one they had on record so I've already threatened them withe reporting them to the relevant authorities. Please help a frustrated and angry man!! Best GIB
  6. I am not suggesting doing anything illegal btw - but if the lease is not signed then surely the T's and C's are not enforceable?

  8. I have rented my flat out with an agent for the last few years. The current tenant has been in the flat for a year and very good he is too! Time for renewal and I am doing this on a periodic tenancy with no management from the agent. Their T's and C's say that I must pay the full finders fee again for this year and I am very happy to take on the providing of the priodic tenanvy mysefl and dont see why I should have to pay this to them as well as the mysterious £115+VAT landlords fee. I have not yet signed the lease as it just came to my attention that I am being fleeced (allegedly) my tenant is very happy to go about this anyway I choose. Can I refuse to pay and tell them that I no longer want their service? Thanks very much in advance GIB
  9. Thanks Silver Fox - I know this is an ever changing issue but I was advised in here to give an SAR to the bank even though this is for my bank account and charge card. Is there no point in examining the statements (if I ever get them!) Thanks GIB
  10. I went to pick up the docs from the bank as per the arrangement with Natwest. When I got there they had ben sent back to head office. I got the teller to give me a comp slip stationg that they didnt have the data from SAR and I wrote to them a month ago saying that they had wasted my time and that I insisted they now send info to my house. NOT A REPLY AT ALL!! Meanwhile I have Capquest ignoring everything i send them telling them that i have made an offer of payment and been ignored. I also say that I am not prepared to do an I&E with them so they send me an I&E form. Now I get a letter from 'HH LEGAL Solicitors' who are obviously a dept of Capquest telling me that Scotcall will be doing a doorstep visit. Not sure what I need to do to get heard here!! I'm going to send these guys the usual refusal of doorstep visit but any advice on how to get this lot of people off my back?

  12. I am behind by a month on my mortgage - just one of those things where the momey for the mortgage had to be used for an emergency. I explained this to the bank and said id repay x per month on the basis that I couldnt really afford it but was keen to get back on track. They said they couldnt do aythign without and Income and Expenditure report. I dont want to supply this info to the bank. Am I obliged to do so? Ta GIB
  13. So.... Following IainHL's advice I referred Capquest politely back to the bank and I have received two letters today, One from them that says.... "Thanks for your correspondence and respond as follows... In order for us to progress further with your account all future payments and correspondence must be forwarded to us as we are dealing with this account" Huh? Also a letter from HL Legal solicitors..... Basic threatenign letter that unless a satisfactory proposal for settlement is received proceedings may be issued against you etc etc. Ignore them both? Thank you Caggers!

  15. AS per this email string - I owe Natwest Bank for an overdraft and a charge card and I don't dispute this. I made an offer of payment in September last year and as ignored. RSM TEnon came on board and requested my tp provide an I&E which I refused to do referring them back to their client. I have a SAR in progress with the bank. This morning I received a first letter from Capquest.... "....We have been appointed by Natwest to contact you directly in relation to the above outstanding balance. Our client has instructed us to consider litigation by 11 JUly if no satisfactory response is received. This firm, together with our solicitors will endeavour to help and assist you in anyt way possible to clear your indebtedness without the need for legal action This issue will not go away and if not addressed immediately we will utilise the legal system to the utmost We are presently undertaking various checks and validations to expedite legal proceedings. These checks will be focused on property ownership through the land registry office and validation of employment details. If no satisfactory response is received by 25 June your account with all relevant details established will be forwarded to our solicitors for immediate action....." Should I refer them back to the bank and the offer of payment already made? Help!!
  16. How's this for a letter back to Twitwest? "Dear Sir/Madam Thank you for your letter dated xxxx the contents of which have been noted. I must confess to being surprised by your response. You have previously had no problem in sending sensitive information to my home address as detailed above so I fail to understand why this is any different? I would also remind you of the Information Commissioners Office guidelines on providing signature. With regard to proving identity I would be happy to go to my local Natwest branch to collect the documents and produce my passport as evidence of identity. I assume that this will be sufficient? As for the information I require I was quite clear in point nine of my original letter that I require all statements for the entire duration of the credit agreement and I would respectrully ask you to adhere to this without omission again with reference to the Information Commissioners Office guidelines on providing this information to your customers. I look forward to your response Yours faithfully,....."
  17. Thank you so much Panther. Are you able to share the content of that letter or the ICO guidelines? Also as they cancelled my account a while back is there relevance in me going into the bank to collect statements? Do you think I should head off the missing info by making reference to reporting them to ICO if they try the same thing? Best GIB
  18. Is this just stalling on their part? I really need to get statements from April to April 08/09 for tax purposes but obviously want them all. Should I write back with sig proof? I no longer bank with them so see no point on going into branch to get a member of staff to verify my sig. I'm freaking out a bit here so your help much appreciated. GIB
  19. I did print my name as I'm now entrenched in CAG ways Having said that and as my bank they have loads of examples of my sig. As the debt in question is overdraft and charge card based would they be able to use my sig for anything dodgy? Cheers GIB
