  1. Good afternoon all, I was employed as a contractor with a small company. They advanced me my fee in advance of work carried out and then cancelled the contract and asked me to pay back the advance. I had already used the money for urgent matters but undertook to repay them asap. They gave me a piece of paper with a date to pay back by which I agreed to as at the time I felt this would be enough time. Unfortunately things did not improve for me and despite my communicated intention to pay the debt back they have not accepted my situation and are going to take action

Hi all, I had a visit from a Marstons agent third week in April who left a note telling me I owed £459.11 on my council tax...I replied on my return home to tell them that I was in arrears by one month and their figure was wrong and that the balance would be payed at the end of April...which it was...today on 12th May I received a reply.... Thankyou Mariner51..sorry for delay in replying...been a bit manic trying to sort this out....i have more information now..No section 21 has been issued as yet and they are now in an SPT..a while ago the rent payment date was changed on our request to 9th December (with the extra week paid at the time) . The LL wants her to sign a new lease today and agree to pay the rent buffer and January's rent on 9th...this is not feasible although I can pay the months rent on 9th December...Currently the LL agent say he will not accept a rolling tenancy.   5. Good morning all, My ex and my three school age children are coming to the end of their rental lease on December 1 and want to stay in the property. I provide maintenance and she is on benefits including housing benefits although according to her these have been cut some months ago.(she has been on housing benefit for the last 18 months)...She made an arrangement with the landlords agents to pay a three month 'buffer' when she moved into the property 18 months ago...Unfortunately my income dried up three months ago and the buffer has been used over the those three months and the landlord

I contacted the EA and pointed out they may have made a teensy error in accounting quoting the material you provided and funnily enough he came back, apologised and said they must have made a mistake! The bill has now magically reduced by 50% With regard to the change of address... they didn't know my new address as I had had cut contact with the club some months before I moved and before any action was taken so I'm not sure how I stand on setting aside but I'm certainly up for the challenge! Hi all, There is a portion of land at the rear of my property that belongs to the local council…it is a 'dead' piece of land as it is accessed wither from my garden or from a conservation parkland area at the rear…there is no public access onto this land. I have accrued a fairly large sum on service charges on my leasehold flat...however a sum of this is for retention for home improvements which I and another lessee are disputing....I wont bore you with the details of the complete lack of service that the management agents charge for but my situation is this... Despite my pleas that I cannot pay currently they have passed this to a DCA who have now givn me 7 days to pay or they will go to my mortgage lender asking them to pay within the terms of my lease.   16. went for a repossession hearing this morning - property is under offer and due to exchange within the month so I was quite relaxed in that the mortgage company solicitor suggested they go for a 56 day order. I spoke to the 11 year old solicitor sent to represent the solicitor and we agreed to agree on this. On going into court the judge was brilliant.... "I dont understand why you are bringing this action when the house is due to exchange in the next few weeks? Why would you want to saddle these people with a possession order that will make it difficult to get another mortgage...this

Thanks very much for this....I have a couple more questions that my ex-partner who I co-own the property with needs answering... she's driving me nuts....I can't remember ever being this stressed!!! Would neg equity include the price of an extension of lease on top of the sale price? Obviously you would think 'no' but maybe it is a consideration as no mortgage lender would take it on without the lease extension. How does a repossession affect lending and our credit rating in the future? Would any other possessions etc be taken in lieu of money owed either now or in the fut

We have had a reposession order suspended on our flat that we rent out for four months now while sale of the property goes through - we have had to extend the lease in order to sell the property...landlords gave us estimate and on that basis we agreed price with buyer...we have just found out that the actual amount they want is far higher and this puts us into negative equity alongside all the other expenses of the sale...   20. So we went to court and got 75 days to sell the property. Unfortunately our tenant left the place in a disgusting state and was impossible to show until second week inNovember. The suspended order is due to be actioned on 18/12 and we had resigned ourselves to losing the flat but onFriday we hadanoffer , a very good and credible offer. I am goingtocontact the bank tmrrw to ask them to stay the order. Should I contact the court too? How long would it take for the bank to actually repossess? Thanks very much for your thoughts
  21. Our business is 7 days late on our rent to our corporate landlord. We have explained this is purely down to a dignificantly large payment from one of our customers but we received a mail today saying that unless we pay by tmrrw they will ‘instruct bailiffs’ I thought bailiffs could only be sent by a court? Are they talking about DCA’s - In which case what do we do on the basis that we could really do without them turning up on our door causing hassle! Thanks for any advice you may have GIB
