  1. I was a sole trader and no longer provide training. I will draft a letter on the lines you have suggested and consider the matter closed until/unless they provide something that merits a response. greatburdon

  5. Just received a call from MBNA. Was ready to blast them for ringing when they have had the harassment letter re my CCA request but she quickly went on to try and explain that they could 'help' with a consolidation loan using First Union (I think). As I have an issue with my Abbey card (MBNA) I was interested to hear her initial approach. I stopped her and explained that I would not discuss financial matters over the phone and could she put in writing the matters she wished to discuss. She agreed, so will see what ,if anything, arrives. Has anyone else had a similar experience? greatburdon
  6. Wrote to Abbey as above. Still not received Agreement and have complained. This arrived in the post today: http://i597.photobucket.com/albums/tt51/greatburdon/abbey.jpg I know this is a standard letter churned out to suit them despite all the letters I have sent which are conveniently being ignored. The 'threats' are all in bold type in the letter and if I do not comply "POTENTIAL COMMENCEMENT OF LEGAL PROCEEDINGS" and we may recommend that our solicitors blah blah... I am considering how to respond to this threat, any advise would be welcome. greatburdon
  7. Thanks for your replies. In the testimonials on the first discovery website it appears that when involved they have achieved payment within 7 or 14 days according to their satisfied customers. Perhaps I had better pay now as its near to 14 days since initial contact8) I will write asking for their complaints procedure and a copy of 'the signed agreement' also send complaints to Trading Standards and OFT as invited by them. greatburdon

  9. The DCA are an outfit called First Debt Recovery Ltd (based in Wakefield) and the alleged debt is for training I gave which the client was satisfied with. There was no signed agreement as stated and I am bemused where this claim has come from. greatburdon

  11. I recieved out of the blue a request for payment from a DCA. Although I know the 'alleged creditor' I provided my services 3 years ago and have no further obligation to them. I sent the letter in the debt collectors templates No. 18 The Consumer Forums Their response is : http://i597.photobucket.com/albums/tt51/greatburdon/brijeshrayreply.jpg As far as I am aware there is no signed agreement and there certainly is no liability. Do I ask for a copy of the agreement they have? (Is this a CCA request?) or just send a general bogoff letter? greatburdon

  14. Sorry Mr Ton and thanks. Where she states Section 8d 'Unless you have a legal right to do so, you must not hold back a payment or refuse to pay anything you owe us because of a dispute'...I think I am right in saying I am with-holding because I do have a legal right, plus drawing my attention to the contract I signed??? Thats the very reason for my CCA request! Where is it? GB

  16. I have s77'd Abbey credit card for an executable credit agreement (24th April) to which I have had no response. I have sent harassment letter, reminders all recorded and finally a complaints letter to their complaints Dept. I received a letter from a Gail Powell acknowledging my complaint and stating I would get a response (this letter) she signed as 'Dept. Manager Customer Advocate office' ... She seems to have been promoted to Vice President in the 1 day gap between letters.   18. Thanks Foxy I will send that letter once I establish my 'claim'. I am still unsure what I can claim for, the charges seem to be categorised as follows: 1.Total cleared transaction charges 2.Total unpaid standing order charges 3.Total unauthorised overdraft fees 4.Total unpaid direct debit charges + charges and interest items Are all of the above reclaimable in full and do I add interest somehow. Sorry to appear dumb, I am totally confused, I think I have read too much and nothing is sinking in. Are there examples I could follow? greatburdon
  19. I have received the SAR bundle from Abbey. Can someone point me in the right direction to find out which bank charges are re-claimable as I see charges for unpaid standing orders, unauthorised overdraft and interest. Many thanks greatburdon

I have already SAR'd them to get the full data I requested not just the two years they felt were appropriate. Can I ask if they will be adding more charges in the meantime or will a dispute letter put charges on hold? greatburdon
  21. Have just received 2 years bank statements from Abbey (i requested a list of all default charges, unauthorised overdrafts etc since july 2001, so didnt get what I asked for!). This account is overdrawn by £134.64 and now I can see how it is made up: balance 2/8/08 26.79 11/09 paid bill 29.05 - 2.26 28/10 overdraft charge 25.00 -27.26 28/10 " " 25.00 -52.26 27/11 interest & chges 0.15 -52.41 27/11 overdraft chges 25.00 -77.41 27/12 " " 25.00 -102.41 27/12 int. & chges 1.16 -103.57 27/02 " " 1.76 -105.33 27/02 " " 2.24 -107.57 27/02 overdraft charge 25.00 -132.57 27/03 int. & chges 2.07 -134.64 I have only become aware of how I became 'overdrawn' by looking at this breakdown. I should have checked my statements but can only offer excuses why i didnt! What I am trying to achieve is the balance to be cleared and as they have closed the a/c that would be resolution for me. I made the Subject Access Request request to see if I could reclaim bank charges as these would probably wipe out the overdrawn balance, but now seeing how this -£134.64 has been built up i am wondering if just a letter stating a £2 overdrawn account escalating to £134.64 is unwarranted etc... The payment of the bill on 11/09 obviously created the problem, although it was my belief that this was a "credit" only account and could not go overdrawn. greatburdon
