ive just recieved payment and its taken about 3 months including DPA, im not convinced they are speeding up the process -
money in account this morning, its over and my brother is £1799.03 richer

letter from hlifax this morning Dear sir blah blah blah we intend to defend and will win bblah blah blah HOWEVER blah blah blah cost to much to defend, money will be in account 5 days blah blah blah £1784 Thanks for all your help guys, my brother sends his appreciation too. Is it advisable to wait for the money to hit the account before contacting courts

me too, i would love it to go to court and have Mr Halifax explain why it does cost £30 for their computer to realise my account is short. -
i would love to go to court just to have halifax in a box and make them disclose how they come up with their figures

ok, MCOL completed this morning, is anybody else at a similar stage to compare times with. Time to get started on the court bundle just in case

ok guys, im going to submit MCOL tomorrow, a few questions 1) Im assuming im ticking no to the breach of human rights section, but do i tick yes to the right to reclaim interest. 2) I have opened the MCOL account in my name but am claiming for my brother, his name is down as defendant can i tick yes to (I am the claiment at the end ) or will he need his own account. Thanks in advance (its getting exciting isnt it)

ok, going to file moneyclaim app on wednesday, just to clarify, i submit the moneyclaim application, i then recieve a letter sayingt he bank are going to defend. At this point i have to send off the court bundle to all parties concerned. Is that correct.

ive already sent the rejection letter, this is purely the LBA now, should i just leave out the no response but, or say iwasnt happy with the response

ooo, its getting closer, drafting LBA today to go on tuesday morning, becuase they made an offer afternm my prelim should i change the opening line of LBA from "I am dissapointed with no response" to "dissapointed with no satisfactory response" Thanks in advance

have recieved the good old, give us four weeks and we'll have a look letter, LBA ready to go on monday

okay guys, i spoke to my brother and he's hapy just to go for charges for now, so letter in post this morning, next update 14 days from now

ok have worked it out and the charges comes to £1,468, i know that the 8 interest gets added on at the court stage but on all the statements where there is a charge there is also a line which says Interest debited - notified last month. There was no overdraft with this account so should this interest be added no to go with the prelim Thanks

ok, got statements finally and am working through them and inputting them into a spreadsheet to keep tabs, one questions though, on the spreadsheet it asks what the charge is relating to. Going back through the statements it only says charges as notified, is it important to know what the charges were for

Reading through threads and i seem to be the only only one who has had to issue a non-compliance letter, has no-one else experienced this.

im really struggling, 40 days on DPA request has elapsed and no response, just sent off a non compliance letter, wait 7 days now.

thought it best to keep everything written, i.e evidence just in case. But been post office and non-compliance letter gone to Halifax. They now have seven days or straight to court.

my brothers not to confident on the phone so im going to send a non-compliance letter instead.

ok 40 days is up tomorrow and no statements, time to get brother to make a phone call i think.
