  1. is it normal for a judge to award an immediate possession order when the defendant does not turn up to the hearing? i thought the judge told me at the hearing it would be 7 days? any thoughts on this appreciated.
  2. Thanks for that, yes i will apply for Baliffs this week. If he had grounds he would have appeared in court, he claims he was ill..... he would have to prove this surely with a doctors note or something.He is persistant and i can't see him giving up too easily but the judge was happy that the Section 21 was served correctly and in plenty of time elapsed before going to court. so hopefully it should be over soon. thanks
  3. Hi Thanks for your reply. The Possession order says "ForthWith upon service of this order upon him" so am i right in saying that this is an immediate Possesion Order? it does not say 14 days and at the court hearing i did ask for Immediate possession order due to the outstanding arrears (12+ months)

Hi All, I have been going through the courts to gain possession of a room in a house from a non paying tennant, i had my court hearing yesterday and the defendant did not show up (he tried to adjourn hearing but his application was refused as he did not file a defence) anyway the judge gave me possession order and have received an "order for Possession Forthwith upon service of this order upon the defendant" does this mean i can start immediately to apply to the court for a baliff ? if so how long does this procedure take? Will the defendant be able to appeal and do you think he has any chance of success? any help appreciated.

  7. Hey DJXFM, I received the RED Letter from SIP car parks also dated 18 march, its now increased to £132 also payable in 14 days, have a guess what i'm gonna do... tuck it away in the back of the draws with the previous ones and no doubt the future ones.
  8. Hi, Thats the exact same Letter i was issued with a month ago from SIP, i have not responded and have no intention of doing so after all the good advice i receive from you guys on here, i'm expecting a 2nd letter soon, i will keep you informed.

  10. Don't even consider replying to them thieving ****ards, they have nothing to hold you to, they are opportunists [problematic] who need to be eliminated by any means, dont contact them and never reply to them, they will go away.
  11. I've heard that writing an envelope without a stamp with "cheque enclosed" can coist them £1.90 a time? is this worth it?
  12. dont worry i will recommend that any of my friends/associates who are caught up in a similar fraudulent [problem] just never for 1 moment consider paying their crazy penaltys, they could never justify their fees of £120 for staying an extra 15 mins in an empty car park that charges £1 per hour, how dissproportiante is that, thay could never consider going to court , cos they they know they don't have a thread to stand on, lets hit back at these fraudulent companies, how can we hit them where it hurts? any ideas?
  13. Thanks Guys, seems the best way is just to ignore them totally and never respond to their unlawful requests for £117 - they are totally fraudulent companies that should never be allowed to trade and exsist. Cheers Jack

I'm a bit confused by some of the advice on this site, Bernie the Bolts Template letters say never ignore a letter if they contact you and to write them a few letters finally ending with Desist letter. But some of you just say to totally ignore the letters from the PCP and any Baliff/DCA letters that arrive- surely they will continue to hound me with letters for the money. Thanks

  16. more details on the letter are: " we understand that you were the registered keeper or hirer of the vehicle at the time the contravention occurred" "This reminder is being served as The PCN has not been paid. You are responsible for complying with this reminder to owner" Any ides how to respond please?

Hi Received a Notice To Owner (NTO) letter from SIP Car Parks Ltd, Manchester for non payment of £117 from Early Jan 09, ( i ignored the PCN they placed on my car at the time, i parked in car park for 15 mins before it would have been free) They have obtained my details from DVLA and say payment due within 28 days otherwise they will refer me to a debt collection agency which will incur further admin charges of £15 per letter sent. What should my reply be to them or shall i ignore? Any advice please.
  18. Hi thanks for your help, I will not contact them and see what happens, but they have to prove i was the driver and also the penalty is totally disproportionate for 15 mins parking. I'm sure that many people would just be scared and just pay up thinking they had committed a serious offense. I will let you know if anything happens. thanks again.
  19. Hi, Do you mean you need to see a photo of the ticket? i have quoted above all the info on it, its basically a printed till type ticket, on 1 side only. If its only a PO Box is it a proper company? Thanks
  20. Hi, The ticket is a long slip (like till receipt) The Company is called SIP (Stop Illegal Parking) PO BOX 495 Manchester M14 )FE. It states the reason: No ticket displayed. It has my correct Reg No and make, model and a PCN number. Date and time correct. It reads: If paid within 7 days charge of £70, If within 24 hours £50 7 days £70, upto 28 days £90 and after 28 days £ 117. It has an 0845 phone number but says for payment only, no conversation in relation to penalty( no other phone number provided) Failure to pay parking charge within 7 days will result in details being obtained from DVLA and payment will be £90. After 28 days £117 and details forwarded to our Debt recovery agency for Collection. This will incur further admin and legal fees that you will be liable to pay. Also mpayment can be made by post to above PO box address. Appeals: if you wish to challenge, write to above PO Box address. So that is all the details on the slip, could you please advise what i should do next? ignore or conatct them? Any help wiil be appreciated greatly. Jack
  21. Hi, I’m new to this forum and hello to you all. Monday evening I parked in a car park beside a restaurant about 7.45pm, (didsbury, Manchester) I never realised it was a pay and display car park (even though there was some signs I noticed afterwards) now after 8pm parking is free but when I returned after eating in the bar at 9 pm I had a parking ticket from a private firm demanding £50 if paid within 24 hours then £90 within a week and £ 120 after 28 days. Also the parking meter was not very easy to spot in the corner. It seems like for 15 mins before the parking would have been free then this fine is far to high (it costs £1 for an hour) also the car park was virtually empty. Do you think I should pay this fine or just ignore it ? it is a private firm, I don’t have their name to hand. Any advice appreciated. Thanks
