Ian/Jones I still am unsure that this IS correct, ie no cancellable rights (mine was internet based and I am pretty sure you should have cancellation rights) pre 2004, but assuming you are correct, ask for the latest T&Cs which incidentally should have been supplied as part of Chip n Pin replacement and is subject to S85. Do you see cancellation clause there? isnt it the same as previously?? mmm if it is then you could deduce that it should have previously been there. Z

  3. Laiste I know exactly what you mean... this is my second time around... long long time ago I was v young and pretty stupid. Not sure what went wrong.. ah I remember... it was a thing called recession... my successful business suddenly hit with cancelled business or chasing money... anyway, my faithful staff stuck with me until the bitter end. For 4 months I paid myself nothing I drew money from CC, loans not paying my own personal stuff but always getting enough money together to pay the wage bill. I remember finally getting my last cheque into the business and telling everyone that it was the end of the road. I even had to bully them to go.. they wanted to work for free just so that the business could struggle through the recession... I wouldnt have it. That was many years ago, I was straddled with huge debts, ccjs, felt low, little self worth, no way to turn, suicidal, etc but the strength of a wonderful partner who administered a good kick in the pants, and the advice of a total stranger - a bankruptcy accountant who gave up his Saturday fishing to listen to my sad story - only to tell me the obvious - they MAY get you in the end - just forget them and do what you do best!! Slowly, painfully I did just that, it was such a relief not losing sleep trying to work out HOW to pay the wage bill. But then, things hugely improved, so much so that I lost sight of the pain of credit debt and the stupidity of it and the fragility of work - I lost a very very well paid job - for over 2 years I was unemployed... nothing, no income, not a thing, then a really crap job - but it gave me dignity and some income CCs supplemented it until finally a really good job again, but income not enough to support CCs. So that is why I am here....battling with the rest of you... looking for ways to reduce my debt and getting back to the simple life... thanks for reading.... but life is good, look outside - all you see is free - blue skies, fresh air... god dammit - blue skies??? looks like I'm going to be whipped into a frazzel by HWMBO (her who must...) to crack on with finishing the borders, power jet the patio, repoint the patio, clean the barbie, sand down the crap from the furniture, varnish etc, replace broken fences, clean out the crap in the guttering, make sure the pond still has koi in it... oh the gazebo needs digging out and relaying with the latest slate bits on the floor from b&q.... when you've done that... roll on Tuesday... back to work for a rest..... Z

  5. She has had me slaving over the chores - just managed to cut the lawns and do a little bit of cutting back the jungle in my borders.... bugger I am knackered.... but this evening she got distracted so I sneaked into my office.. but she will be shouting at me soon... Z

  8. Hels shame... about being shut, if I had read quicker might have got the defence earlier. Not to worry - if the defence is simply about Business Data then it is weak. Enjoy Easter, go get the defence as soon as you can next week. Remember, the 13th is only a 5minute directions hearing so don't panic. Get the defence and scan it as soon as.   9. All Sincere apologies, I am waiting for the big bus to travel home. I know what awaits me: she who must be obeyed has a list of chores (what chores? Never thought you'd ask - a pint of golden stella please...) as long as I am tall..... ..... I am pretty damn sure that I will not see the light of (day) a computer probably until late Tuesday......... and I will suffer severe withdrawal symptoms... so.... have a super Easter, chat/discuss soon....   10. Sorry Hels, completely unintentional absence, trying to help another damsel in distress, calm a flame war on another thread, and reply on another AND just finished all your posts.... I'm not a woman you know.. honest.. just can cope with one thing at a time. Glen has been superb, guided you briliiantly, I'm going to ring his chimes in a mo Jumping into your thread - apologies for all the doubts... yeah I do know what its like... nerveracking. Chill though... get yourself a nice glass of wine! You have one of strong case and except for the defence which Glen guesses at - its business data - I cannot see their defence at all. We know its a directions hearing, 10 minutes, it won't take the judge 5 minutes to determine fast track. You have some good aces - just do exactly what Glen suggests, they really have no defence. BUT - do get that defence from the court NOW - well almost now. Relax. Z
  11. I must admit m55, I wish you all the luck, but I seem to recall reading somewhere about the fact that a court may consider the relevence of the absence of that document. just my opinion though, Z

  13. On a more serious note - I'm trying to help a lady who needs some guidance court wise with a POC she needs to unravel/amend. Not yet my forte and I do not wish to do her an injustice with my inexperience, can any of you guys point me to high quality caggers/mods who could help please Ta very much... Z

I'm warming to the man already... an observation: I know to an outsider some of these flippant comments are irrelevent, but imho it does rather go some way to substituing for the lack of those subtle methods of communication you get when you talk to people face2face. the :D help lighten things up too..... Self help and support each other is really really critical. btw thanks for tipping the old scales... when you guys get your money back perhaps you might like to look at the credit card charges threads which have opened a can of worms for Credit Card companies... a little legal knowledge is very dangerous.   17. Dave In my opinion you have misinterpreted the responses. What is always important is the tone of the post. Certainly I took offence and many others to the way you were posting not what you were challenging. I am sure that you meant no offence, but in this anonymous world with the lack of any form of understanding of each other it is so easy to come across completely with the wrong message - in fact it detracts from your message. You are also wrong in that we agree on each and every point and arrive at a consensus view. We all have slightly differing views on probably all the CCA. What is important is that we share each others views and allow them to stand. We all understand very clearly that all these views as Pam frequently eloquently reminds us - are just that our view. The real point to remember is that there is only one certainty in life! So, to recap, thank you for raising yet another uncertainty, we will await perhaps a definitive view. Z
  18. Helen I am pretty damn sure that the court is required to provide you with the defence as soon as they receive it. 21st/23rd is a long time ago - how do you know they submitted it then? As Glenn says you really need to see that defence like yesterday in order to prepare for the court it will influence your preparation. So call the court - ask for the defence and also clarify what the hearing is for - because that too will enable you to prepare better. Jeez this is cutting it fine... go get it girl Bank Holiday loses you time... right back to Page 4 Z
  19. Hels I am carefully re-reading your thread - I've already got it wrong once. Not enough hours ... paused at page 4. Will continue tonight after work - and its only an IT job - I'm a Business Analyst - I try to make systems work better... Question: I assume Glen has advised you through the POC - it may be in previous posts, but if you have a date, what Order has the Court given in particular for them to submit their defence? Personally I think that they are bluffing... to say they have only 3 years is very very unlikely to be accepted particularly with SOLA stipulating 6 years. back later, Z btw did pezboy die or was he embarrassed? personally I think he gave good advice... I think you were too honest, sometimes its best to steer a neutral course through the quagmire - me - it's wrong I know but I would now lie through my backteeth to get my info. Its sad when you have to stoop to their level....

    AC Nice of you to pop in, you just sit there and I'll pour you a glass - red or white??? We have been having a little debate with Dave on the main CCA thread. He actually wants the reference as to where it says imprisonment. So it would be really really nice if you TS Officer could research that little gem and let us know.... In the meantime, can I tempt you with another glass... Z
