  1. Hoping someone has a suggestion. I sent the tax office a letter using the ESC A19 as they say my other half owes £412.15 from this period. He was working for an agency form May 2008 - September 2008. He then began an new job in February 2009. The reference they give applies to the job he started in 2009, not 2008. However, they are saying the overpayment happened when he was working for the agency "you had the benefit of duplicate personal allowances against your employments with (agency) and (company agency sent him to). You had four separate periods of employment with (agency). For the last 3 periods of work with them they correctly operated the BR tax code; however for he 1st period they operated tax code 543L. We were first made aware of the source when the end of year P14 details were received". That being the case, they were aware in April 2009 that he had this apparent overpayment. They did nothing for the tax year 2009/2010 or for 2010/2011 and the first he knew was when he received a letter in February 2012. By my reckoning ESC A19 DOES apply as they have had possession of 2 further P14's (in April 2010 and April 2011) but failed to act upon this information. They also allowed the arrears to build up over 2 consecutive tax years. I am unsure as to what my next step should be. My oh was PAYE meaning he had no control over the amount of tax he was paying and has presumed, quite rightly, that he was paying the correct amount. I am also confused as to why the tax reference number they quote belongs to his employer from February 2009 - February 2011 and not the tax code of the agency. Do I just re-write to them, using their dispute sheet, stating what I have written above? Help....anyone?
  2. Just spoke to a very lovely woman at the magistrates court. They get this a lot, apparently, where people cannot attend because of distance. She has written down everything I have said and wants me to take bank statements and the 2 copies of the TV licences I have (one is valid from 1st Sept 2011, the other 1st November 2011). The TV licensing people are saying I have NEVER paid them a penny, so I can prove differently. I can take all this stuff in to Hastings magistrates, much more convenient. The TV licensing people will be informed that I am pleading not guilty.
  3. Ok, so I received a letter back from the court today. The case was adjourned until the 4th May. They need me to go and confirm my plea. I think the mitigating circumstances have probably confused them as they show I'm not guilty BUT I still cannot get to the court as it's still too far away. That was my main reason for non-attendance to start with. I'll probably be found guilty anyway despite my licence being paid for the months of September and October (which I can prove with bank statements) and then I rearranged the DD to backdate the licence November 2011. However, after speaking with the TV licencing people it appeared I did not need a licence anyway (so the money they have had shouldn't have been paid in the first place). Also, the statement I apparently signed has added extras included, things I did not say - I didn't get a copy of it, so I can't prove this.
  4. I haven't mentioned Sky to anyone at the court. My point was as I no longer have it I don't need a licence. I'm more than happy to let them in although I now know I can just ignore them.
  5. Also, I am only being prosecuted for September 2011. The time I DID have a licence and they received a payment of £29.10 for this. I did not have sky in September, had no aerial, no freeview box etc., etc. I did have my Xbox but you do not need a licence for Netflix, Lovefilm or any of the on demand channels that are now available. We set Sky up on the 13th March, never watched it and my Dad changed his password a couple of days after this. This was because the TV licencing people had varying opinions as to whether I needed one as my TV was not hooked up to an aerial. Eventually they told me I would, so I got rid. I'm not paying £145 a year just for the F1. Not worth it. Instead, tomorrow, we go to a friends house to watch the Malysian Grand Prix.
  6. We set it up for the Grand Prix. We now don't have it as my Dad changed the password to his sky-go. There has only been one F1 race and we didn't watch it
  7. The court date has been and gone and I haven't heard anything back yet. I just couldn't get to the court (and anyway, to plead not guilty they list it for another date, but would not move to the court near me). I just wouldn't have had any money to get there. I did put a full statement in with mitigating circumstances explaining that I never actually needed the licence anyway. Half the people living near me won't need one either - since the switchover on the 21st my area is a black area and no channels are being received....not yet anyway. We get enough choice of programmes and films with Netflix, Lovefilm, 4OD and iplayer - all through the xbox (which cannot receive live TV AT ALL). No need to fix up an aerial. My little boy now gets his CBeebies fix through iplayer the day after they were shown on TV. He knows no different. Maybe everyone should do the same as that would really screw the TV licencing people up
  8. Oh, I like that I'm in deadlock with them at the moment. They have replied to my email about me not sending a financial statement and they have asked yet again for it (including full documentation, bank statements etc., etc.). They can kiss my backside. They have also said they will send someone round regardless. This is their final response to this matter. So, I have emailed back and said: "Thank you for your letter dated 19th March 2012. As previously advised, I will not be forwarding my personal financial circumstances to Credit Solutions Limited as you are neither a judge nor a court. You have no right, in law, to demand this information from me. If you feel that CSL are above legislation and can indeed demand this information, please forward the relevant statute/law/legislation to me at your earliest convenience. I have given enough information about my circumstances by stating I am in receipt of Jobseekers Allowance. No further information is required. I want it noted that I have tried, in numerous emails, to set up a payment plan by standing order for £1 a month. This is all I can afford until my circumstances improve. I would like it noted that Credit Solutions Limited have refused this offer and have refused to forward details to enable me to set up a regular payment. Also, please be advised that if you send a doorstep collector, despite me completely forbidding you to do so, I will contact the police and have your employee escorted away for harassment. As I have told you explicitly NOT to visit my personal address you have no right, within law, to do so. However, if you can find legislation that states a debt collector can ignore my rights, please also forward that to me. As you have still not given me your details so I can pay you by standing order I am presuming you do not wish to receive any money. If this is case then I expect no further correspondence from CSL or any other company registered under CSL (such as Power2Contact). As you are refusing to acknowledge my complaint in an acceptable manner I will be forwarding all correspondence to the OFT and The Financial Ombudsman Service for their perusal (as you recommended). Please note that the OFT are already aware of CSL's practices in this matter and it will be used when considering CSL's ability to hold a credit licence. Please note this is also my final response in this matter and I will not enter in to any more correspondence or payment arrangements with CSL or Power2Contact (or any other company hidden behind another name but is indeed linked to CSL). Regards" Not to sure about the wording, but I fired it off anyway. I have a cat, a snake and a hamster....the snake will bite if harassed and it gives quite a nasty nip. My cat is rubbish and runs away and hides when anyone knocks at the door and my hamster is just way too friendly to be of any good. The other half would just send me to the door (it's his debt) to frighten them off.

  12. I read a really good blog about someone who has received countless threats since 2006 and nothing has ever happened. He doesn't need a licence and told them so. I can't put links on here but if you google "letters from bbc television licensing" it's the first link. The guy who came to my door basically said the same - as I had a TV I need a licence. I believed him. They have told me to ignore any letters I get. So I will. No doubt I will eventually get a letter addressed to the occupier. If they use the "you may have bought a TV" line on me I will simply tell them that that doesn't mean I am watching live television. It just means the one I had broke so I replaced it. Anyhow, you are under no obligation to let them in. It says so on the back of the licence. I was told that because I am on benefits with a young baby then that is taken in to consideration for the fine. After filling out the I&E sheet I was left with next to nothing a month. Hopefully it'll be around £50 but if it is more then I will have to appeal for more time. They cannot get blood from a stone. I have no non-priority debts - my money goes on basic utility bills, food and stuff for my baby so I can't even skip a payment with these just to pay them. Will find out after the 23rd I guess.

"Please note that to substantiate your account being paid in installments, we require justification by means of a financial statement detailing all monthly income and expenditure. This should include details of any benefits that you are receiving and full supporting documentation inclusive of copies of benefits and wage slips where applicable. Please forward the necessary documentation to the above address immediately for your proposed installment to be considered." To which I may just send this (found it in amongst someone else thread). Unless, of course, someone has a better one. Dear I acknowledge receipt of your letter dated 14th March asking for a financial statement. I have been advised that this 'personal' information is just that - personal. However, following your request, I obtained a Court orientated Income and Expenditure Form which I understand only a Court and/or Judge can legally have access to, and filled in the details required therein. Following the revelations about my financial status that completing this form brought to light, I would like to thank you for pointing me in the right direction. From this information it is obvious that I have no disposable income at this present time. It has been suggested that following discovery of this situation that a county court Judge, would, in all probability Order that I can afford no more that £1 per month to each and all debtors, which of course includes yourselves. If you would now kindly send me details in order that I can set up a Standing Order in this amount, I would be grateful. Regards Any good? They also neglected to reply to my questioning about their field collectors. I have added this to the end: I would also ask for confirmation that the "threat" of door step collectors has now been eliminated. Please be advised that even if I do not receive a response I will assume Credit Solutions Limited understand the law.
  14. Mt other half got a 2 year contract for mobile broadband with Vodafone in January 2011. This came with a laptop. When we originally got the broadband, the signal was fine (not brilliant, but it worked). Since moving we no longer get a good enough signal to load a page. The signal either shows poor or no signal available. In the last 3 months we haven't been able to use it at all. Vodafone refuse to lower the allowance per month from 3GB to 1GB to at least try and make the bill cheaper for us. They also will not allow us to cancel the contract without having to pay the remainder. This is obviously annoying as we are paying around £25 per month for something we cannot use! I understand we have to pay the cost of the laptop though, but no matter what we have told Vodafone they are refusing to help us. They just tell us that Vodafone have the best signal in the country etc. Any ideas on what we can tell them/write to them to help us? I really do begrudge paying for something that we cannot use. We have had to get BT broadband installed just to get the internet which of course is another expense.
  15. Even if I took my little one I can't afford to do a 80 mile round trip. If I pleaded not guilty they would put if for trial BUT they wouldn't move it to the court near me. There is no way for me to attend. Just going to have to take it on the chin. If I get a visit from an enforcement officer I will gladly let him in as I have nothing to hide.
  16. It's £29.10 per month. That is what I had to pay. You have to pay for the licence in 6 months, but I think your 6th payment covers you for the 7th month too. I have no idea. I can show you the payments to them by uploading a copy of my bank statement (with important details blanked out). I meant lovefilm, not filmfour, which is on demand. I've told my Dad to change his password so we no longer have access to sky. Therefore we now have no way of receiving live TV. You mentioned the laptop. This is on loan from a friend for a few days while she's away. It will be returned in 3 days.
  17. This is the OH's debt and he does indeed owe the money. I have no qualms about that. They just have to realise that I will decide how much I will pay depending on what I can afford. They don't like that. People who know their rights are pretty much disliked by DCAs (one would expect). It's only for about £120, so not much anyway. I just found their attempt at trying to say they can visit me was laughable .

  20. These are new, never before seen by me until I received a letter from Power2Contact telling me they were going to visit. Some Googling pointed me in the direction of CSL using Power2Contact as a "scary" guise. They have had nothing from me yet.
  21. I could never be at their level. They are so far below me it would take me 2 lifetimes of serious sin to get close to where they are. DCA's are easily beaten. I have done it before, I will do it again. Their experience is through bullying people who do not know their rights, intimidating those with threats of anything from bailiffs to stealing and selling your soul. They want to keep sending me letters full of drivel, that's their call. They want to keep ignoring my proposals for payment, so be it. I will not, sorry CAN not be intimidated by DCA's. But thanks.
  22. Oh Fred, how I would love to pay them 1p a month. Unfortunately they don't seem to want to give me any details so I can pay them. No giro slips, no standing order details. I am not going to do as they tell me and set up a DD. I'm no fool I'm also disinclined to pay by debit card through their website. I don't trust them I've asked again for their details and explained my proposal and reasons for such a small amount. I am doubtful of a reply. At least I can prove I asked. I love email.
  23. My TV isn't hooked up to an aerial as there isn't one, we have no freeview box and there is no analogue service here anymore. This isn't a technicality....I have spoken to the TV licencing people and they told me I don't need one. I have an xbox and watch 4OD, Netflix and Filmfour through that. No TV. You only need a licence to watch "live" TV. Also, when you live on £400 a month, £29.10 (which is what they want) every month is almost 10% of my income so in fact, to me, it's a lot of money. However, I do not see why I should buy a licence when I have no possible way of watching live TV (on demand programmes do not count and that is all Sky is on the xbox). Anyway, for this court summons - as they have decided that I would have to travel 40 miles to attend (which I cannot afford to do) I may have no choice but to plead guilty by post but include all mitigating circumstances. That's all I can do. Due to my low income it'll probably cost me £50 - cheaper than travel costs and childcare (as I will not want to take my baby to the court).

I've shot a complaint off to the OFT and will send CSL another email telling them to shove it.....I have a cat who could be my agent, although people knocking at my door does tend to frighten him some what meaning they may not get a response from him. They are bumbling idiots (in my opinion).
