  1. Does my 'account in dispute' still stand now the alleged debt has been sold on? . .Do I have to start a new 'account in dispute' with an CCA request to cap quest? . . I have told them that this account has been in dispute since October 08?

  4. Dear James, Hi, I am currently having dealings with a debt collection company regarding a debt that I do not consider I owe them. They are now saying that they are going to obtain a copy of my credit report from Experian and use it for deciding what steps to take next. Can they legally do this without my permission? Lloyd, Essex Dear Lloyd, A company must always get your permission to check your credit report. When you apply for credit you will usually consent to the lender checking your report at various stages in their relationship with you; including at the outset to help decide whether to grant credit in the first place, and then on an ongoing basis to help manage your account while ever you remain a customer. Importantly, if a debt is sold on to a debt collection firm, this consent stays with the debt. This gives the collection firm the right to access your credit report to assess your overall financial situation and to make appropriate decisions about engaging with you and collecting the outstanding balance. Now, if there is a dispute about whether you owe the money in question then the firm should look into this for you and, if they believe the debt is actually valid, provide evidence to back this up. If, however, you actually dispute any connection with the debt at all – perhaps it’s a case of mistaken identity? – you should make this clear to them and they should take prompt action to rectify the situation. If it isn’t your debt then the debt collection firm should certainly not be checking your credit report. The Office of Fair Trading's debt collection guidelines dictate how firms should act in situations like this and if you believe the guidelines have been broken you could have a case to take to the Financial Ombudsman Service. I suggest you first try to resolve the matter directly with the collection firm and, if necessary, with help from the collection trade body by the Credit Services Association. You can get advice from their website. Importantly, any footprint registered by a firm checking your credit report to collect debt should not affect credit scoring.
  5. Hi, I have also had my Halifax debt purchased by capquest a few months ago... I sent them a polite letter explaining the debt was/ is/ and has been I'm dispute since October 2008 ... And that the Halifax have never produced a credit agreement..... All I received was a ' we have received your letter and we are looking into our next plan of action ' etc etc ...... Hey presto, I ALSO. Received this letter this morning.. With no mention of the credit agreement... I take it, they CANNOT DO THIS ???? Has anyone got a lovely informative letter I can reply with to show them am not a pushover ... Anyone.?? Would be most appreciated ... Thanks in advance

  7. nope live in rented and dont work.. funny thing is.. i wasnt working back when they threw the credit card at me either.. was cos my ex husband was working.... funny how they will throw credit at you.... then moan when you question it....

  11. my GPB letter says CONTACT US NOW.... so no asking me to contact iQor... but it also has the questionable words 'a county court claim may be issued without further warning' i mean i may change my name to elvis and go and live on cocobongo island...... i may turn up on thier doorstep naked to discuss this matter....... you get the drift... ;-) lol Tigger
  12. BUMP to my thread...... I am STILL getting chased by DCA after DCA.... most recently iQor, who even after a 'bemused letter' as the account is in dispute, they have set Geoffrey Parker Bourne Solicitors on me, and they have sent a letter today saying Legal action Pending... DO I send yet another bemused letter to GPB? or do i write back to Halifax...? I have been contacted by more dca's than i've had hot dinners.... - ok, well not quite so many.. ;-) Any advice greatly received..... but the waiting game goes on AND on AND on....... Tigger

  14. how do i subscribe to this thread?? in a similar situation with haliprats and all the dca's youve mentioned... just received solicitors letter from Geoffrey Parker Bourne on behalf of iQor today... saying legal action pending... I'd send bemused letter to iqor and they replied saying haliprats said they'd complied with CCA and they were to carry on pursuing the debt.... GPB must be thier next scare tactic...? it says I've got to contact GPB direct and not iQor... do i send similar bemused letter to GPB ??? hows everyone getting on with thier stuff... any more news?   16. this is the thing... he is a bloke.. he hasnt got a clue what his account numbers were back then. he knows he did have bank accounts with them.. he went to them when he got in financial trouble and they offered him a credit card, and a loan... to help' tide him over the bad time till he got back on his feet' surely if these were credit agreements that Lloyds TSB would have them... I am more thinking that RW bought the debt with not much info, and are maybe clutching at straws...? Just dont know what to do to get the information i need, because I dont beleive RW for one minute.. hehe The info they provided after the SAR has 'loan' on various parts.. mabe even a 'cons loan'.. i need to dig it all out again to see.. regardless of what type of loan, surely it must have an agreement to go with it.? even thier statement received a few days ago with the letter telling me of these accounts had 'loan' on top of it... ? I'm very confused..

Hi, thanks for you reply, yes was paying nominal payment.. these debts come off the back of my OH's divorce and he quite frankly panicked at the time and didnt look at what they were for.. silly i know, but he was in a mess after having just had to sell his house to pay his greedy ex wife.. but he defo knows they werent money run up on a bank account.. this is £12,000 in total.. i dont know a bank alive which will let someone run up that much.. he didnt even have a overdraft he says..?? he has not paid anything since we sent the CCA requests. thanks
  18. Hi all, I sent CCA requests to my OH's 3 dca's nearly 2 years ago.... I got an 'application form' from link, who have not even tried to chase for payment since..?? Wescot did not reply to the CCA at all but then the SAR request went in, they sent a letter saying i had to send his Passport to verify who he was, but then a letter the day after saying his account had now been closed.... nothing since... Now Robinson way, replied saying they were 'locating' the copy of the agreement.. then sent a letter saying they did not have it to produce.. I have since had a letter back from them after a 'polite' reminder from me that they should not be chasing for money.... and now they tell me that they do nto have to produce anything as it refers to 2 bank accounts... and give me 2 sort codes and 2 account numbers... Now my OH said this is for a credit card and a loan with lloyds TSB .. so where do i stand now?? I was thinking of writing to LLoyds TSB for information on those accounts, to shed some light on all this... as RW want money as its not credit.?? They also stated in thier letter that they 'bought' this debt in 2003.. Surely if they took him to court, it would be thier word against ours if there is no proof? I just want to delve a bit deeper to have something to throw back at them... Any thoughts from anyone will be gratefully received.. thanks
