  1. Sorry to hijack this post but I have 2 outstanding debt searchers appeared on my file. They are from a company called cnm they have told me who asked them to search and I have never had any dealings with these people. I have spoke to them and they say it is regarding a debt i am paying from many years ago through a ccj. I have not missed a payment to the court and have never had any contact with anyone else. Can they just add this search when they have no interest in this debt as it has been through court?
  2. My defaults went and then I opened a bank account. Within 3 months they were back with 2 credit searchers from a company called CNM. Dont know what this is all about but have a feeling the CRA must have informed someone. The only debt I am in dispute with is Cabot which is stat barred. I know a default was on and then went off and is now back. Worried sick as i have my own business now and worried the bank or CC company will see it and cancel my stuff. Have even sent a letter in desperation ( stating the account is stat barred and they should have not defaulted me ) and offered an amount ex gratia if they remove the default. God im fed up spent years gettin straight and then all this hassle, dont know where to turn now not had a reply from them either.
  3. Thanks for the reply Shall I just ask for the data to be removed in the letter? Do have have to mention anything specific. When you say about the 7 day letter is this after the 14 day one has lapsed? Thanks

  5. Hi there I have posted on another place but this might be the place to get the correct answers i hope. I had a lot of problems in 1998 after a breakdown and been off work for over a year ( wish i knew about a site like this then ). Anyway I got advise from my local council who helped me through that period setting up repayment plans with all my creditors. The years past and in 2006 I received a letter from Cabot ( although at the time it had nothing on the letter saying it was them just a telephone number to ring ) I spoke to them and they said it was for an outstanding debt to Barclaycard and I needed to arrange to pay it. I immediately ended the conversation and the next day spoke to the debt councellor at the council who told me to speak to them again and tell them mity was staue barred because it was seven years since i last heard about the debt. These people were horrible to talk to and very aggressive in their telephone cconversations. Basically I told them to take a run and jump ( but in more words than that ) Having been hounded for the first couple of years after 50k being chased I knew not to speak or give numbers or anything. I did send them a letter in my own words telling them that the debt was statue barred and I have heard nothing since. My life is much better now and I am going along nicely until I check my credit report and I have a default from Cabot in 2005 on my record with Equifax, I have one on Experian which has been added this week but is dated 2005. I have not checked Call Credit but I expect it is there. My question which no-one has been able to answer yet is, Can these people place a default on an account that was Statute Barred. That I have never had an account with or made any agreement to pay any amount of money. All my other credit history is clear now and I will get hit again for another six years on something I have laready taken six years to get off. After digging a bit more on equifax I find that searches have been done in July from in one box associate and the other box is Barclaycard / BhS so I presume these people now know my credit rating was excellent these days and are out to sting me. I am ready for a fight but need to know where I stand to deal with it. This I feel is totally moraly wrong to knock people down forever and now I have found this site I will not only deal with this but will start to help others who find themselves in the situation i was 10 years ago and that was totally devastated!! And I owed over 50k and got through to fight another day.

Hi Sosumi I just can't understand how they can put a default on a statue barred account when I have not entered any agreement with them, not accepted I owe them anythying, and have not heard anything from them since I told them It was statue barred and I was not going to pay anything to them. No default notice ( coz i had one from the cc company in 1998 ) so this is what i'm trying to get some furthur advice on coz the financial ombudsman and other financial leasing Association ( i may have the middle word wrong there ) are both saying they wont deal with it, so i dont know what to do,

  10. Hello everyone I am new to this so will give you the full details as this is doing my head in. In 1998 I had a breakdown and ended up off work for over a year. My wife and I went to a local council debt councellor and went through all our outgoings and incomings. We were told to pay only the main accounts Mortgage ect which we did and defaulted on all the rest. The person working with us sent a standard letter to all creditors staing an amount we could pay and an infantry of all our incomings and outgoings. This was all set up and we continued to pay off everything, my health improved and I changed jobs re-assessing what we were able to pay all the time. Things got better and better and we then re-mortgaged our property and made settlement payments to all the creditors we owed. In 2005 I received a letter from an unknown company at that point with a telephone number saying someone was going to come to my house to see me. On ringing up it was a company called Cabot Financial who said they were looking to collect a debt from a credit card company. I said I had to check this out and put the telephone down telling them no one should call at my home and all correspondence should be done by post. I got back in touch with the debt councelling and was told they were trying to harras me and because it was 7 years after the event I should tell them it was statue barred. Cabot were a nasty bunch and becuase I had no joy over the telephone I wrote to them stating these facts and that was that. I have heard nothing off them since and now have my own business and really feel as though i've got my life back on track. I checked my credit report recently and lo and behold they have put I have defaulted on 2005. This has only just shown this month on my Experian and on checking Equifax its on there too. But with no repayment plan or anything. I telephoned Experian and asked what has gone on and explained what had happened in the past and they said that they should not default the account because it was defaulted in 1998 and you cant be defaulted on the same account twice. They advised me to speak to the financial ombudsman who said because they were not registered under them till o4/07 i should contact the FLA who have told me they are not under them. I am starting to worry as I have worked very hard to get myself on track and am ultra careful with my accounts ( I have 3 credit cards now ) and all my accounts on my file show no problems no missed or late payments, just this new blemish. Can they do this to me forever? I am hoping to move to a normal mortgage and want to move my business to a limited company but darnt do anything now i've seen this. Any advice would be greatly appreciated Thanks
