  1. Righto, I am sending the following letter tomorrow, can you guys have a look at it and make sure its ok? Thanks Dear HR Lady, I have been informed that you are currently dealing with my case. If this is not the case, I would appreciate it if you would pass my letter on to the correct party, and inform myself who is dealing with it. It has now been 3 weeks since my letter dated 11/05/2009 and I have received no response. I have however received a letter from Big Boss Lady regarding my dismissal which arrived 20/05/2009, which is 3 weeks after my dismissal. I can only assume that this was sent in response to my letter. The letter bears no relation to the events that happened. There was no formal disciplinary hearing held, and I know the manner in which my dismissal was conducted is against The Companys HR policy and employment law. She states she fully considered the evidence, yet no evidence was presented and she refused to discuss any matters of the case with me, nor was I allowed to see the references when I requested to. She also makes mention of an employment screening process oversight, yet does not go into what relation that bears to the case and my supposed gross misconduct, and she previously stated I was not being dismissed for gross misconduct when I specifically asked if that was the case. She has asked me to sign a copy of the notes and send them back to confirm they are a true copy of what happened. They are not a true copy and will not be returned. Lastly, and most seriously she states that as result of my actions and previous notifications(of which I have had none) details relating to my conduct will be recorded on a fraud prevention database. This allegation of supposed fraud is a very serious, and has not been backed up by any evidence. I consider this to be libellous and am deeply offended by this. Having consulted with my solicitor, If I have not had a response to this letter within 7 days, I will have no choice but to take matters further.   2. I have had no response, So I will send them a letter stating that If no response in 7 days I will take things further. I have since had a letter from Big Boss Lady that has no relation to the letter I sent in. It states I am sacked for gross misconduct on 30/04(she specifically stated it was not gross misconduct). However it took 3 weeks to arrive, and I have proof it was sent after my other letter arrived(thank you recorded delivery). It also asks me to sign an account of the "meeting" to state it is true(which it is not) and states that due to my actions I will be added to a national fraud prevention database. The last part is an accusation of commiting fruad, which I am sure must be a serious offence. Can I make a seperate case for libel or defamation of character beased on this accusation? Thanks.

  4. I recently Started signing on, and have heard through the grapevine I can get help with expenses such as a New Matress(which I badly need as I have a bad back) and clothing, on top of my JSA. Any Idea what this is or how I can claim it? Thanks
  5. I do not have any probationary period in my contract, I have already sent the other letter but as Yet have had no response. If the reference in question is the one I am thinking of, it can not be anything but libelous,as my Ex manager holds a grudge against me.
  6. Ok, they seem to be ignoring me. I saw a solicitor and she looked at everything and said I had a case for wrongful dismissal and breach of contract. She said I could go to tribunal on those grounds, but if she was to represent me it would cost me. Therefore if they do ignore me, I will have to go to a tribunal.

  9. Hi, this is the letter i am sending, any comments? Dear Big Boss, I write further to my dismissal on 30/04/2009. It has now been over a week, and I still do not have the reasons for my dismissal in writing, as eventually promised by yourself. As part of my contract of employment I am entitled to one weeks notice in writing. You specifically stated that I was not being fired for gross misconduct, and gave the reasons of: 1. It is not company policy to rehire previously dismissed staff. This issue was resolved before I started employment, and I have this in writing from the head of HR. 2. Unsatisfactory references. You have refused to state who the reference is from or how it is unsatisfactory, however I have previously discussed the matter of a possible bad reference from Previous Manager with Current Manager, and she informed me not to worry about it. I therefore request a copy of the reference you consider to be unsatisfactory and the reasons for it. Your refusal to give me any form of notice is a breach of my contract of employment, and as such I am still employed by the company and expect to be paid until the date I receive one weeks notice in writing. I wish to raise a grievance against you due to the manner I was dismissed and your refusal to discuss it, or provide me with anything in writing. An e-mail is not considered acceptable, and you refused to give me any notice period or anything in writing, nor was I informed of my rights before or after the meeting with yourself. I also require a full copy of the companies grievance, dismissal and appeal procedures, as I am no longer able to view them on the Intranet. I intend to follow company procedures as far as possible before taking my case to an employment tribunal, and I have already taken advice from a solicitor on this matter. I would also like to raise the fact that personal possessions of mine were not returned and I have since been informed they were thrown away.   10. Its been a week now and nothing. So far i have been dismissed, but thye dismissal has not been done by the books, and I have had nothing in writing as to my present state of employment, notice period or appeals process. Where's my next step.
  11. Hi there, Just over 3 months ago I was employed by a large insurance company. Today, I sit at my desk and am asked by the Big Manager if she can have a word. I am called into the office and informed that my employment is being terminated as its company policy not to rehire people who have been previously dismissed and as I have had unsatisfactory references. I was given the all clear to re-apply for this job by the head of HR, and have it in writing so thats number one reason out the window. As for number 2, i know exactly who has given me a bad reference, and I will be dealing with him separately(He has given me a bad reference as I filed a grievance against him and won, my performance was top notch in that job) And I have told the company about this previously and they were fine with it. I was told i was being given no notice. I asked who had given me the bad reference, they refused to show it to me, tell me what it said or who it was from. I asked for the reason i was being dismissed in writing, they refused. I refused to leave until I had something in writing, at which point they said they would send me an "e-mail" and if I didnt leave security would escort me from the premises. I left. I know they have screwed up royally over the way they have sacked me as my attendance has been exemplary and my work has been top notch. What do i do? Please help, I really want this job back.

  13. Right, i have been fobbed off twice over the phone about the reference, so I turned up at the office demanding it. The HR manager was out and I pointed out that I had previously been promised the reference and it had not arrived. They refused to give it to me so the Assistant Director had a talk and said he would sort it out. Fast forward to today, and I get a letter. It states that all references requests need to be made in writing to the employer in question as a subject access request under the DPA and quotes from the Information Commissioners Office website. They then state that I am to send a letter enclosing £10, that they have 40 days to respond and that she feels that she must point out that they are not obliged to provide this under the data protection act. I have been promised this verbally and they are now refusing. Whats my next step? Thanks.
  14. Thanks for the help. I had a rather long argument with the HR manager, who tried to tell me first off that all reference were verbal, I then stated that she was a liar, as I had seen letterheads of some of the companies that had supplied references in my file. She then backed down and told me it would be posted to me first class today. Thanks for the help on this one, it probably wont be the end of the matter though.

  16. Hi there, Anyone who has read some of my previous posts know that I had a serious problem with my manager at sony centre. Now, thats all done with and has been for months(I won BTW) and I applied for a different job recently. Today I was told I had been turned down for the Job due to a bad reference from the Sony Centre, and when I asked to see it, they said they couldn't show it to me as my ex-manager has specifically written on the letter that I was not allowed to see it. I know this is rubbish, and my manager is being vindictive as I beat him and embarassed him quite badly due to his shocking behavior towards staff. Which law do I need to quote to see my entire file they have on me, including reference from employers? Thanks in advance.
  17. Hope someone can help here. I got a job with Norwich Union 2 weeks ago. I have not had a contract but have had verbal and e-mail confirmation of starting with start dates etc. Everyone else who interviewed with me and started with me doing the same job has had their contracts though. I had some problems with HR(they stated my deed poll was not legal, I told them it was) and today they came back and said that my deed poll was fine, but in the last two weeks the recruitment process has changed so I now need to fill out a screening form. If I dont fill this out, I dont have a job, and if they dont like what they see I still dont have a job. I attended an interview and got verbal confirmation. A week later I got a letter stating that they had revoked the offer due to myself having been fired for gross misconduct. This is false, 7 years ago I worked for them for 2 weeks and left as the manager was an ass. I sated their info was wrong and they investigated. I later got a phone call and an e-mail confirmation of the offer of employment. The exact confirmation I had that I was starting this job was "Hi captain wesker Further to our telephone conversation, I confirm that I am pleased to inform you that in light of your recent e-mail we have reconsidered this matter, and in view of the length of time that has elapsed since the circumstances raised, we are prepared to reinstate our offer of employment with immediate effect. However, this offer is subject to satisfactory references from your most recent employers. As discussed we have agreed that you will start your new role tomorrow, Tuesday 27th January. recruitment girl from the claims business unit will be contacting you to confirm your first day arrangements. I would be grateful if you could bring along your change of name documentation to satisfy our Asylum and Immigration requirements. I wish you all the very best in your new role. Kind Regards hr girl" The Form they want me to fill out is a lengthy book entitled Norwich Union Pre Employment Screening Form. No one else has had to fill one or out or provide the information required. I am not comfortable with giving them the info they want. Here is but a short list of things they want: Right to work and Criminal records is standard, I have no problems with giving them that. Here are some others: credit checks information regarding any CCJ's I have and how I am satisfying them Wage slips from the start and end of employment for any jobs in the last 2 years Bank statements with the same info Formal documents providing the terms of any redundancy accomodation car hire and card recipts from any travelling formal documentation from travel companies evidencing any travelling writen evidence of any voluntary work evidence of planning permission and bank accounts for any "lifestyle projects"(not sure what that is) evidence of course fees for university Student loan company statements evidence of pension payments. Now, not all of those apply to me, however those that do are personal financial information that have no relevance to my job. What can I do? I dont want to get fired, but then I dont want to provide this info. Can I go down the discrimination route? Can they fire me if I have a bad credit report? Pease help as I need to go back on monday with something. As far as I am concerned the e-mail is confirmation of employment, with the only stipulation being employment references.   18. Hi there, I have sent a laptop off to tesco insurance, and they have proclaimed it beyond econimical repair. It was a Sony NR21Z, and They have based the calim on a current model of the FW21L I have been offered £700 worth of vouchers to spend at currys/pc world, even though I bought it at the sony centre. If i dont want the vouchers it would be £500 cheque. They have also said that they will keep the old laptop, and if I want the hard drive back I have to pay for it. The only problem with the laptop was the screen. The rest of the laptop works fine(I checked by hooking it upto an external monitor). Questions: 1. Can they really offer me vouchers for the full amount, but less in a cheque? I really dont want to buy a laptop from either of those places. 2. Can they really keep the old laptop? 3. Can they really charge me £30 to return the old hard drive? Any other advice would be appriciated. Thanks

  21. Luckily I have never had to deal with any bailiffs before. Is it a case of wait and see if anyone actually turns up? The house belongs to a family member, who gets cash in hand rent from me, in case that makes a difference.
