  1. Hi, After sometime away I'm back with the dreaded Welcome finance and MKDP. I had a car loan with Welcome taken out back in 2003. I got into a dispute with Welcome about the loan back in 2006/2007 regarding the fact the loan still had PPI on it even though I had requested it was removed. I started the process of SAR/CCA with Welcome in Dec 2008 but they cashed the postal orders and received the recorded letters but did nothing - I later found they'd gone into administration and this is probably why my dispute fell by the wayside. Now I was checking my credit report and the loan was purchased by MKDP back in 2010 and then defaulted. Now where do I stand with them? I still have the original postal order and recorded delivery receipts from the post office with Welcomes address on the bottom so they were delivered back in 2008. Can I start my dispute again (though they don't exist so might be hard) can I statute bar the debt as it was originally back in 2003 though according to MKDP I made a paymnet for £30 31/3/2008 which I have a feeling was a information request but hard to prove. Info on my credit report: Account type: Hire Purchase Account status: Default Date last updated: 18/02/2013 Account opened: 31/05/2003 Account opening balance: £3858 Repayment frequency: Monthly Default date: 01/01/2010 Original default balance: £3858 I was looking at paying it and just getting it out the way, but after finding out even paying them off doesn't help as a satisfied default is just as bad as a default. Any help greatly appreciated
  2. Well I'm back after sometime away (well waiting for Welcome), after requesting my CCA and SAR back in December I heard nothing from Welcome at all. No CCA's sent no response to my SAR. Then this morning I get an unpleasent surprise in the form of 2 letters from a debt collection agency requesting monies for my two accounts outstanding. Now this is where I need help - I still have the receipts for the Postal orders sent and they were cashed, but after reading the letters i sent this part infact: "Should you not respond within 14 days I expect that this means you agree to remove all such data. Furthermore you should be aware that a creditor is not permitted to take ANY Action against an account whilst it remains in dispute. The lack of a credit agreement is a very clear dispute and as such the following applies. * You may not demand any payment on the account, nor am I obliged to offer any payment to you. * You may not add further interest or any charges to the account. * You may not pass the account to a third party. * You may not register any information in respect of the account with any credit reference agency. * You may not issue a default notice related to the account." Now surely this means they have broken the terms of the requst as well now? But more importantly where do i go from here? The debt agency want their money, Welcome are not being forthcoming regarding my requests for data, seeing as they had nearly 5 months to respond to me and never bothered.   3. ok today, after sending in above letters, I get a call from my account manager. Starts telling me they have received my letter and it is on its way to head office. Letter?? i send you 5 letters in all have you read them?? WF opps yes we have and we are sorting them out. I then point out that way they are way over allowed time limits and they should of got to me sooner. Met with silence, doesn't really care about statutory time limits I guess. Then I also point out that as stated in the letter all correspondences should be in writing from now on ie no more phone calls. WF agrees this but then tries to pull an amazing stunt. Asks me to confirm me details 1) address - yep its correct 2) Contact details ie phone - yep correct 3) job title - humm not happening mate 4) work phone number and employer - yet again not happening mate. Are they really that stupid or deceitful that they feel they can try and pull the wool over your eyes?? Of course sure here's my Job title, company name, and Contact number so you can bypass me and start hassling my employer about the agreement!! Honestly i feel they have must in-house training sessions on being stupid. The Quote 'never argue with an idiot, they'll bring you down to their level and beat you on experience' springs to mind concerning this lot. Anyway, I guess its a case of just sit and wait now for whatever head office is going to try and spring on me. Anymore tips on how to get rid of these numpties would be greatly appreciated. After sending in a request for all my CCA's (payment included) and a SAR - i have had zero correspendences. I understand they have 40 days to comply with the SAR but as for the CCA they have 12 ... I have given them 16 days so far for the CCA and no response. I therefore rang my branch to chase it up last night (09/12) and got fobbed off, in meetings, did we recieve it etc etc...even though the recorded delivery was signed for. So my questions is whats my next stage? Is there another letter I need to send to get this moving or ?? Any help appreciated Thanks Twist
  6. well I have just been on the phone to Welcome - contacted my account manager to confirm my account numbers for the letters. Bit of a turn up for the books asked them about my 1st account number regarding the car for CCA purposes, they have 0 records regarding that account, only the new one after PPI request went in. Yet im sitting here with an invoice for cash to a Welcome account number, on a Welcome invoice. So I have already put the CCA request and S.A.R - (Subject Access Request) request in the post and im intrigued how they are going to get me a copy of the CCA for the car account when they have no record of it. Damn good job I decided to keep that invoice *little update - so im getting all the paperwork in order...turns out 1 A/C regarding the car they have yet another A/C the car they don't ...looks like I have paid monies into a wrong account (well not me i paid in cash - and got signed invoices) - but the person taking the cash has put down a non existent account number. The plot thickens
  7. Well when I initally bought the car, through Yes car loans (this was back in 01) the loan was through Welcome - I believe at that time all Yes car loans were through Welcome. Hence when I went to have the PPI removed I was directed to Welcome finance and they then pulled the fast one of removing the ppi but re-writing the loan so it was still the same amount. Anyway i'll post up the CCA when I get it and we can go from there.
  8. Hi guys, Thanks for the quick replies ... I had a feeling somethign was up with the car as when i approached them regarding it before and asked for account number they only has the re-written one on file. So when I reeled off the original one they could not locate it (Welcome this is). Hence suddenly my account got moved and interest frozen on it. I don't have the orginal loan agreement but I do have the original account number, so I will contact them regarding the CCA and see if i can get a copy. I have seen in a number of thread their CCA's on older loans were not always up to scratch and with my loan being from 2001 I feel this may be the case for me. Postgj you mentioned about the deposit being used for insurance and if this is the case 'game over', what did you mean by this? I have an idea but is it a case of misselling or missuse of funds, therefore making my CCS invalid. If this is the case am i entitled to monies back etc? As for the personal loansi think they are on the back foot with this one already but im already in the process of requesting a SAR/CCA for both accounts and go from there.

Hi all, Im new here so i though i'd say a hello (even though i've been reading these forums for a while) and ask for some advice regarding my ever so pleasent dealings with Welcome I have 2 loans with Welcome and personally I just want rid of now, I’ve had it up to here dealing with these fools, no matter how I try discussing things with them Im either met with an incompetent fool or an arrogant manager who feels the best tactic is to shout me down. I have a person loan with a balance of £950 outstanding (in default as well apparently!), although after requesting statements for this loan the original amount was for £1250 including interest (I think) with the loan being taken out on the 16th December 2004. Now after adding up all payments made to date I have paid £1980.00 but according to the I still have £950 outstanding – so I am disputing the amount outstanding and would like some advice on how to take this forward as I’ve hit a wall so to speak with them. The other loan was for a car through ‘Yescarcredit’ (yes I know I was stupid to go down that route but at the time I was desperate). The loan was originally taken out in 2001, but some how got re-written in 2003 – although all I asked was for the PPI to be removed as I didn’t want it. So they removed it then re-wrote the loan so I ended up on the same amount. So anyway after paying and paying I am left on £3950 even the original loan was for £4500. So in 5 years apparently I have paid a grand total £550. This loan is in default apparently as well now, though I have managed to get interest frozen on it. I have had the ‘head-office’ chap ring me up recently and say I could settle the car loan for a one off payment of £900. But this has got me thinking are they desperate? If they can reduce it that much does it man in fact I don’t owe any more money and they are clutching at straws?. I’ve even come close to taking out a high-interest loan with some other company just to pay these guys off, so I can get rid, but frying pan into the fire sprang to mind. I checked my credit report earlier today and it green all the way till Welcome then 2 big red defaults. Totally messing up my chances of credit etc and I am just sick of them now. Any help or advice on how to get rid of them etc would be greatly appreciated . Thanks
