  2. Thanks, I have read through the letters and I am sending the 3rd template in the morning, and as you said, see what happens. Its like starting from zero with them, but whatever it takes. Doesn't the fact that the debt was sold to other agencies mean that they would be unable to provide a SAR anyway?
  3. I made an estimate with the statements that I have kept since I opened the account. The SAR would have showed me the exact amounts, plus any hidden PPI charges (which I discovered for the first time when I made my claim against First National and they sent me the schedule of charges). But Littlewoods has been more messy. ...I am stuck, I know. :-|
  4. Nope, they never did, they just sent me a letter saying that they were collating all the information, their letter says: ... Thank you for your recent letter, enclosing a fee of £10 and requesting subject access under the Data Protection Act 1998, to informatino which is being held by our company. I am currently collating all the information and will contact you again shortly. ... Some lady called Amanda Gledhill, oh well. I am at this very moment going through all my papers just to confirm, once more, that I never got any statement from them. The debt was sold to Phoenix (Fredrickson) and I always thought that it would take some fighting as they all refused to help when I rang. I have other claims awaiting, and have had some money back recuperated, but I always knew that Littlewoods would be a tough one...

  6. Hi maroondevo2, thanks for your reply. These were sent out back in April, both the SAR and the LBA. I had to send the SAR request a second time because they never replied to my first SAR. I am so inclined to call them... but I heard some horror stories of phone calls making matters worst. I think they are taking the mickey out of me judging by the way they are treating my complaint. What next?

Hi all, I made a claim to Littlewoods asking for charges totaling £350, back on 5 April '08, and I just found out that it has been two months since I wrote to them and that since their holding letter in May saying that they would provide a final answer by today, no other correspondence has been received since. This means that they are in breach of the two months, any advise what can I do next? I have proof that I wrote to them back in April (recorded delivery), and I have their holding letter, but that's it, any help will be very welcomed Thanks

  10. Hi Sparklez30, I have written a letter to Argos, arguing exactly what you said, and in fact added your first sentence as it explains perfectly my point, and I have decided to post it here. My letter will answer your questions as well: (I will post it tomorrow first thing) ________________ I am writing to you, following your letter of 30 May 2008, with an answer to my complaint regarding PPI/Coversafe for this Card. I believe that you have failed to answer my complaint satisfactorily, for the following reasons: -Your letter states that your ‘store assistants do not provide advice in relation to insurance products but instead I was sent a full policy documents and details of my right to cancel’. The term and conditions of this policy were not explained when I signed for the card, and this makes this policy void under the FSA rules. I never received any documents offering me the possibility to cancel this insurance policy, and I am certain that you haven’t got a contract or term and conditions signed by me agreeing to this policy, because I never received such a thing. I only signed for a loan, which had been ticked by your store assistant, who never explained that I was signing for an added insurance policy as well. -Four months after I took the card with yourselves, I moved from xxxxxxx to xxxxxxx in October 2004 and I was unemployed for over a month, but no policy was then enforced to help me through my unemployment, despite me making you aware of my situation when I rang to change my address. The policy didn’t help me with the stress of the move either, which was the reason I couldn’t work during that period. -I only signed for a loan, which, in the signed copy, is swiftly attached to this policy, ticked by your assistant. For these reasons, I still believe that the policy was mis-sold. Your letter of 30th of May doesn’t argue that it wasn’t. It only states that it was, in fact, sold to me even though I wasn’t aware of it. As result of this, I must conclude that it is not necessarily true that just because I signed for the policy that it still wasn't mis-sold. It is when I looked into my statements that I realised that under the conditions stated above this should have never been taken, although I never had a chance to refuse it, due to the circumstances in which I signed the loan (in a shop, without any time to look at the document), and because I never received a chance to cancel this policy. The amount of £55.51 + £4.44 interest is appropriate and reasonable and I would therefore request a second time that you refund these premiums to me. I look forward to a full and prompt response to this letter and for the matter to be concluded within eight weeks or I shall be contacting the Financial Ombudsman to investigate my complaint. ________________

Hi all, I kept all the statements from Argos since I opened my account back in 2004, and calculated that they have charged me over £55 in PPI/Coversafe payments, so I wrote to them to request my money back. The same letter has been used to request money from GE Money and I never had any problems, they paid straight away. ...But Argos has sent me a copy of the agreement with my signature, and to be honest I didn't even remember having signed for it. I did say in my letter that the policy had never been explained to me (because it wasn't), and that the staff member who created the document didn't have any insurance background, but they refuse to pay the monies back. Where do I go from here? have I already lost this case? Any help will be very appreciated.
  12. Agree with davethorp and Weird Al Yankovic, Lloyds offers you a debit card, no cheques or overdraft. I just had my new account opened with them for a fresh start, and it has been pretty easy. 'Do they offer online banking and direct debits from the account and can i open up new accounts when i'm logged into online banking?' Yes I must say, the co-op account mentioned here sounds very promising, since offers one with no overdraft at all, which is something I have been trying to find for a long time (to avoid those stealth going-into-the-red transactions which to be honest would be worth if they were left unpaid, sometimes). Anyway..., good luck finding the best account

  14. got it. I have sent a SAR letter today, the rest will follow as you said. Thanks for taking the time on this, I hope it helps others as well (loans on bank accounts are another reason for banks to abuse with inflated charges), it is very satisfying to finally find out. Thanks!

  16. Hi again jowalshy! Thanks for your reply. My fault, I didn't word my thread properly; what I really meant to ask is if a loan can be treated the same as a credit card charges reclaim? I am not sure if the charges on a loan from Barclays are being reimbursed regardless of the OFT test case, since the loan looked like a Barclays normal bank account.
  17. I wondered if someone could enlighten me on this: If a loan was given to support a bank account, and charges were applied to it, how do we treat this case? Can the charges be requested now or would they have to wait until the OFT case ruling comes out? Your advise will be very welcomed!
  18. BT wireless package received and installed following instructions. Over two months later, something fails (we think following weather conditions) and therefore we are unable to get any signal for almost a week. Call to BT to find out... Indian bloke says 'unable to help because there is no wireless signal', therefore not BT's fault (). Priceless

  20. I just read your second reply, I am sending SAR's to both Littlewoods and Fredrickson, and get to the bottom of this. I know Fredrickson took the biggest chunk, so after this little incident I will pursue the whole amounts and not settle for anything less. I would have been happy with a settlement amount TBH , but this has now become personal.
  21. I agree with you, I will need some proof first. My first letter was a basic letter asking for my charges back (which worked when asking for the charges back from barclaycard), just letting them know that I am intended to recover charges. I am sending the S.A.R - (Subject Access Request) today, with a £10 cheque, and I will have to wait the result and build up from there. Littlewoods did indeed apply charges to my account while on their hands, I kept some of their statements, this is just another trick to blow me off their books. I am annoyed about the fact that although they are aware what our intentions are and they keep hiding behind cheap excuses.
  22. Thanks for your reply jowalshy I originally contacted Littlewoods (the card supplier) and they have told me to contact Fredrickson Int (the company that bought the debt). I am going to write to Fredrickson, but if they tell me to contact Littlewoods, I will be stuck between the two of them, while passing each other the ball! Would it be safe to start the claiming process with Littlewoods?
  23. I have heard different versions as to what to do when claiming my charges back off credit cards/store cards. If the debt was sold to a different card, and I want to claim the charges, who do I contact, the original store card, or the company the debt was sold to? Any advise would be very appreciated
